Heart Evangelista’s Sister, Camille Ongpauco, is Single

According to a reliable source, Camille Ongpauco, the sister of Heart Evangelista, is technically single. In 2016, Camille married Martin Rosario, her long-time boyfriend, in a civil wedding held at a garden in Cavite. However, after the ceremony, the two were informed that there was a technical error in their documents.

The couple had to rectify the error to the point of approaching each of their godparents to sign the new documents again. In the process of fixing their papers, the couple encountered problems, which led to losing interest and sadly, falling out of love. Technically, Camille’s marriage to Martin was null and void.

Three years later, the presence of Andrew Wolff in the birthday celebration of Heart and Camille’s father was questioned. Netizens were quick to accuse Camille of playing around, not knowing that her “marriage” and relationship with Martin was over. Meanwhile, Andrew has never married and thus, he and Camille are free to be together.

  1. They’re still technically married unless they have secured a judicial declaration of the nullity of the marriage, if indeed the errors are grounds enough to have the marriage declared null and void ab initio.

I don’t think so.

    7. Most likely they have secured a judicial declaration duh. Just cause the article did not state above doesn't mean hindi. That's the logical next step if they want to separate. And easy to get at that.

    8. Baka naman hindi na nai file yung marriage cert nila after the wedding.. susko wag na nga tayo mamroblema. Basta null and void. Kung yung ex husband nga hindi nagrereklamo 😂

    9. "Technically, Camille’s marriage to Martin was null and void." is different from Legally, Null and void. So correct si 4:34pm.

    11. Kung separated na din naman and the separation was mutual before Andrew came to the picture what else is the problem? There so many celeb couples who jump into relationships even before their marriages get annulled. Why should this be singled out by you 4.34. But then again as per article the marriage was null and void meaning no marriage has taken place and marriage is not recognised. So really this is a non issue.

      Delete
    12. 4:34 is right. I have the same case. I still had to nullify my marriage.

    13. How can you legally null and void a document if it is technically null and void?

      Delete

If walang deklarasyun from the Korte, legally you are still married.

    15. To the non-lawyers and non-law students, kahit po sa tingin nyo na "technically null and void" ang marriage nyo, you still need to secure a judicial declaration of nullity of marriage from the court

If you fail to secure a judicial declaration of nullity from the court, legally speaking, you are still considered married notwithstanding the fact that your marriage is "technically null and void".

      Delete
    16. What will you ask from the court if in the first place YOU WERE NEVER MARRIED.

      Delete
    17. @1:08am,there was a marriage ceremony.
Kahit po di registered, you still need to secure a judicial declaration of nullity from the court.

There is already a supreme court ruling on the same matter in the late 90s if i remember correctly from law school.

If the marriage certificate was not submitted to the Local Civil Registrar and Philippine Statistics Authority, then there is nothing to be annulled or be declared as null and void. Seems like none was submitted in this case as they had to have the witnesses sign again. This is pure speculation and conjencture though based only on what we read here.

    12. Ganito yan... so you file a petition for declaration of nullity of marriage. You have to attach a copy of the marriage certificate. If there is none,be it from the LCR, PSA, a Philippine consulate, or some other office or agency, why even bother filing the petition? First year law students know the Family Code but they don't know anything yet about the practice of law.

    13. Freshmen law students know the Family Code but they don't know the practice of law because they have yet to learn Evidence, Civil Procedure, and a whole lot more.

Sure, a marriage certificate is not necessary for the existence of a marriage but without one, what document will a petitioner in a petition for nullity or annulment of marriage present? On what document be the final decree of annulment or nullity be annotated?

  4. What kind of technical error? Is it a matter of form affecting the authority of the solemnizing officer, or their marriage license, or their marriage ceremony?

If there was a complete absence of any of the formal requisites (those stated in my previous paragraph) of a valid marriage, then the marriage is indeed void ab initio. However, it has to be judicially declared. Hence, Camille and her spouse should have initiated an action for declaration of nullity of marriage. They cannot just assume that since there was an apparent error, their marriage is not valid. It is a matter determined by the courts, not by the spouses.

However, if the technical error was just an irregularity in the formal requisites, then their marriage remains valid, but the person/s responsible for such irregularity shall be civilly, criminally or administratively liable.

    1. So long as you are below 18 when you got married, the marriage is void. The consent of your parent is immaterial. Such consent matters only when the couple is above 18 but under 21.

But do not that while your marriage is void, you still have to secure judicial declaration of nullity (not annulment, because those 2 are different) before you can get married. Otherwise, you may face bigamy charge.

Nag nap muna sila sa office nilang may aircon after kumain habang naghihintay kami doon. May deadline din yon. Super stressful talaga sabi pa samin namayat na daw kami and baka daw magkapatid kami kaya daming nangyayari. Magkamukha kasi kami. I don’t see the big deal here, Filipinos are just being judgmental as usual😑 even if she and her husband are still “technically” married but currently separated and in the process of getting an anullment, they’re both still considered SINGLE and free to date whoever they want! What’s crazy is the fact she’s with Andrew Wolf of all people, especially when her parents were so picky about Heart’s past bfs. Not even Jericho or Chiz were approved but Andrew is....👀

    ReplyDelete
  26. Just to make things simple, I think this is what happened:

Camille and Martin Rosario got a Marriage License (ML), which valid only for 120 days. This means that the wedding should be performed and the Marriage Contract (MC) should be registered within this period. The couple were so focused on the details of the ceremony and reception (you know, perfect clothes, flowers, music, guest list, etc) that the date set for the wedding could be too close to the end of the validity of the ML or beyond validity date. Then MC was not registered within the 120 day period. Couple tried to “cure” all the documentary requirements, that is, apply for a new ML, ask ninongs/ninangs to sign, etc. In the process, couple were getting into each other’s necks, fighting a lot and then decided to drop everything.

Hence, there was actually NO RECORD of marriage. When you go to Court for Declaration of Nullity of Marriage, your Exhibit A is the Marriage Contract that you want the Court to declare null and void. The decisions will be annotated in the Marriage Contract. Eh NO RECORD nga di ba? What is there to annul?

What they had on Oct 2016 was a great party!

    1. Dear, please go to law school or read up on the family code.

“A marriage is a permanent contractual union between a man and a woman. While there may be circumstances that may render a marriage null and void, the determination thereof does not depend on the parties themselves. Rather, the same must be brought to court and pertinent laws and jurisprudence shall be applied”
