Repost: P40M of Kris Aquino Invested in Businesses in Thailand, but Trustee is Still Former Financial Manager

Here’s the answer to the P40-million question in the ongoing saga that is Kris Aquino’s legal dust-up with her former business manager, Nicko Falcis.

Where’s the money now?

A source from Aquino’s firm revealed the exclusive information to Lifestyle that the Thai partners of the firm, where the P40-million had been invested, affirmed that Aquino is the rightful owner of the investment.

Eloi Sy, one of Aquino’s lawyers, confirmed Lifestyle’s source’s statement that Aquino’s money had been invested by Falcis in Rocks PC Co., Ltd. (Potato Corner Thailand), which accounts for 10 percent shares in that company.

The source also said that the Thai partners, including actor Pachara “Peach” Chirathivat of the prominent Chirathivat clan of Thailand, have reaffirmed Aquino, through a text message last October, as the “beneficial owner” of the P40-million investment, which was under Falcis’ name. Falcis was Aquino’s trustee.

A trustee has no legal claim to the amount in question, Sy said.

Aquino’s Thai business partners, the source said, informed her that after a meeting with Falcis, they have “agreed and established” that Aquino is the rightful owner of the “P40 million plus the shares in Mang Inasal” and the 10 percent Falcis assigned in Potato Corner Thailand.

Falcis, according to Sy, is also a partner in the Thai venture.

“While the shares are in Nicko’s name as your trustee to protect your privacy, it is in our corporate records that you are indeed the beneficial owner of the said shares,” the source quotes Aquino’s Thai partners. “You still have the right to vote and also the right to dividends that may arise in your 10 percent in Rocks PC Co. Ltd.”

Qualified theft

Aquino is suing Falcis for qualified theft, for allegedly charging P1.2 million in a credit card intended for expenses in her production company, Kristina C. Aquino Productions, for his personal needs.

The P40-million investment is a separate issue, according to Sy.

“The P40 million was unaccounted for, and we’re trying to account for all the money our client entrusted to Nicko Falcis,” Sy said.

“We had a meeting with Nicko’s sister and his lawyer in September, with the understanding that we were to have another meeting where they would give us the full financial report. They didn’t talk to us again. Instead, they’ve been maligning our client.”

Nothing also has come out of the initial talks on Potato Corner Philippines’ offer for Aquino to buy them out in their Potato Corner + Nacho Bimby partnership, Sy said.

“I asked for an accounting of [the] P40M invested for my sons, and financial reports for our 12 Potato Corner + Nacho Bimby branches and my lawyers and I were ignored,” Aquino wrote on Instagram.

“When Ms Aquino gave Nicko that amount to invest, there was no contract, she didn’t make him sign for it. It was only because she trusted him,” Sy said. “This is so crucial for Ms Aquino because the money came from her sons’ trust fund.”

This past week, Falcis’ camp responded to Aquino’s alleged “bullying tactics,” with his legal counsel, Ponferrada Ty Law Offices, releasing a statement denying claims that they are engaged in “delaying tactics.”

The statement said that Falcis’ counsel filed an “Omnibus Motion to dismiss the cases for forum-shopping, for consolidation of the cases before the Department of Justice, or for suspension of the criminal cases.”

Filing Falcis’ counter-affidavit immediately, it added, “might render our Omnibus Motion moot.”

Rude Girlfriend

When Handsome Hunk (HH) arrived at his photoshoot, the production team was surprised that Clingy Girlfriend (CG) came with him. Usually, CG is as busy as HH and waiting in a photoshoot can be boring. The staff could not just ask CG to leave, as such request might upset HH. Thus, they let CG hang around.

HH needed to be prepared, as the theme was sexy and he had to show his abs. To withstand the heat from the lights and for his abs to look good, a Makeup Artist (MA) was assigned to place the right shade of body makeup on the abs of HH. MA started her work and she had no choice, but to be close to HH and his abs. Unknowingly, CG was keenly observing the scene, which was taking a bit long. When MA started to work on a little below the waistline of HH, CG noticed that HH was enjoying the moment. MA was an attractive woman, which probably did not escape the eyes of HH.

Well, true to her reputation, CG asked MA that she will take over, as she has impressive makeup skills, anyway. MA stood her ground and said that she was fine, as she was being paid for the job. The head stepped in and said that MA should handle what she was paid to do.

When the photoshoot began, CG watched intently. Then, this time, she was the only one who assisted HH change outfits and worse, she started intervening with what HH should wear. HH started to feel awkward and embarrassed, as CG was making her own subtle scenes. The production staff noticed that CG was looking at her watch often, as if saying that the team should hurry up.

Well, whether CG was indeed sending such message was ineffective. Instead of hurrying up, the production decided to reshoot photos that they had already taken earlier. Thus, the time took longer and CG could not do anything about it.

On hindsight, the staff did not realize that rumors about CG’s attitude were true until they had experienced it during the photoshoot. Their experience was worse than the rumor. They felt that CG was very overprotective and assumed the team was going to take advantage or harass HH physically. Unfortunately, younger talents are already emerging and they happen to be hotter than HH, and they might think twice getting his services again.

Former Ilocos Sur governor Luis "Chavit" Singson said that he has acquired the Miss Universe Philippines franchise.

In an interview with the Philippine Star published Sunday, January 13, Singson told columnist Wilson Flores that the Philippine Miss Universe franchise is "already with [him]."

"True, the franchise is already with me, but it has not yet been announced. I think it shall be formally announced this January or February, when Catriona comes back again to the Philippines," Singson said. 

“Binibining Pilipinas Universe will be replaced with 'Miss Universe Philippines.' Noon pa binibigay sa akin ‘yan (It was being offered to me since before), because I’ve been helping them since 2016."

Candidates for the Miss Universe pageant are selected by local franchise owners. These local franchises are owned by either an individual or an organization. The Binibining Pilipinas Charities Inc (BPCI), which runs the Binibining Pilipinas pageant, has had the Miss Universe franchise since 1964. 

Singson said he first dealt with the Miss Universe Organization when the Philippines played host to the pageant in 2016.

"I dealt with them for the hosting of the Miss Universe pageant here in the Philippines in 2016," Singson said. "Instead of talking to many companies before, they just talked to me and I then gave them a non-refundable deposit of $1 million. Who would disagree to that, non-refundable? I gained their trust. Before the signing in 2016, they even first asked me to pay $12 million."

When asked if he's trying to copy the style of US president Donald Trump who once owned the pageant, Singson joked his girlfriends are prettier.

He also confirmed that he's helping stage the Miss Universe 2019 in South Korea. "Before, it was held in Jeju island because it doesn’t require visas for foreign tourists. The 2019 Miss Universe will be unique because for the first time in history, North Korea will participate but no swimsuit portion for their candidate, only the national costume."

Last January 3, Binibining Pilipinas Charities Inc (BPCI) chairperson Stella Araneta said the Philippine franchise is still with them, despite reports that Singson had already been offered the franchise. "It's still with us," she said. "If some people say something else, let them talk about it."

The Miss Universe Organization has yet to formally announce who will keep the Miss Universe Philippines franchise. – Rappler.com
