Repost: GMA Network Responds to Investigation Report of DOLE on Incident Involving Eddie Garcia

GMA Network filed its Comment today on the preliminary findings of the Department of Labor and Employment (DOLE) in the investigation into the incident involving the late Mr. Eddie Garcia.

Prior to the formal hearing, DOLE-National Capital Region Regional Director Sarah Buena Mirasol stated that GMA allegedly committed three violations under the Implementing Rules and Regulations (IRR) of the Occupational Safety and Health (OSH) Law: failure to submit an incident report within 24 hours, to employ or designate a safety officer, and to employ or designate a certified First Aider.

GMA, in its Comment, explained that after completing its thorough internal investigation, the Network initially gave a copy of the results to the family of Mr. Garcia as a matter of respect and thereafter voluntarily submitted a copy to the DOLE on July 5, 2019 in compliance with the law and its IRR.

Regarding the first finding, GMA noted that the IRR, as worded, states that such a case of “work accidents resulting in disabling injury or death” is an exception to the requirement that a report be made within 24 hours from the occurrence. Nonetheless, GMA submitted the report within one (1) month from the accident which occurred last June 8, 2019.

Secondly, on having a designated safety officer in the workplace, GMA confirms that it actually has sufficient number of DOLE-certified safety officers catering to its employees. The “workplace” covered by the OSH Law is deemed to refer only to those places where services of the employees are regularly rendered. The IRR cannot expand the coverage of the law to include temporary, moving, or shifting locations. Extending said requirement of the law through the IRR to all temporary taping locations would unreasonably burden the industry with a requirement which is beyond the contemplation of the law.

GMA maintains safety and security in tapings through extensive discussions among its safety officers, the program’s officers, and staff and its contractors in coordination with Barangay officials having jurisdiction over the locations for security, traffic and crowd control matters.

Lastly, on designating first aid responders, GMA validated that three production staff who have completed the Philippine Red Cross' lecture demonstration on First Aid and Basic Life Support – CPR were present on the location site on the day of the accident. Despite the safety measures undertaken by GMA, it was determined that what happened was an unforeseeable accident.

Moreover, in an article published in The Philippine Daily Inquirer on September 7, 2019, it was mentioned that GMA Network refused to comply with DOLE’s directive to provide a list of the locations of all its teleseryes, which shall be subject to inspection by its representatives. GMA, for its part, said that there was no refusal to provide the information.  The locations and schedules were not submitted immediately because of their tentativeness and the fact that they are too numerous to remember from memory. These tapings are under the supervision of different officers and thus needed ample time to compile. However, a list of regular taping locations and schedules was submitted within the prescribed period.

The Kapuso Network assures that it will continue to cooperate with the DOLE on this matter.

  1. May point si GMA dito... just imagine, yung mga linemen ng telcos, cable and electricity. Usually 2-3 persons sila per team/vehicle, minsan nga 1 lang. So paano ang safety nila? Dapat ba may stand-by medic din sila? ilang linemen na ba ang sumabit at na-kuryente sa poste, hinabol ba sila ng DOLE?

    1. Those Men are employees meron kaming insurance from the company, magkaiba ang artista sa Blue collar job. Company has paid premiums for our insurance, HMOs and other benefits, kung may mangyari while on duty kahit hindi din sakop kami, ang artista are talents only, they pay their own everything. So don’t compare...

      It’s GMA’s responsibility kung ano ngyari kay Eddie Garcia. Kulang kulang sa tao sa set, kahit tentative ang location dapat meron kasamang Safety at Medic, 12-24 hours sila sa location dapat meron kahit 1 hour lang sila dapat meron.

    3. You make no sense. You are comparing apples and oranges. Linemen have safety training and are required to pass them before they can be on the field. Also as a team, they are required to look out for each other and recognize unsafe situations or environment as a team.

    6. Napaka lousy talaga niyang GMA. Dito sa aming village yan nagsshooting malapit lang kasi sa GMA. Mga ika 50 teleserye na nila dito nag sshoot. Nakakahalata na un mga nanood malamang kasi same kalsada, same clubhouse, same bahay, same talahib etc. AYAW NILA MAG-EFFORT. MEDIOCRE AT ITS BEST. Gusto malapit lang. Kaya un nangyari kay the Legend Eddie Garcia. They should have seen it coming.

  3. Kaya dapat talaga magshift na to limited number of episodes at fixed timeline ng shooting, para mawala yung “tentativeness” na excuse nila (among other things). Bukod sa mas matipid, mas napag-iisipan yung concept, story, promo, etc. and most importantly, they provide a safe and controlled environment for shooting scenes kasi planado na kung paano matatapos. Bakit ba takot sa change ang Phil. showbiz?

    1. kerek! sa akin lang naman, bat hindi natin gayahin ang south korea. 2 episodes lang per week ang series. bukod sa hindi sila ngarag sa shooting at mas maraming new actors ang magkakaroon ng opportunities na magkaroon ng sarili nilang lead role para naman fair ang labanan specially dun sa mga underrated actors and directors.

    2. Sino ba nagpwersa na ipagawa nila un kay Eddie? Wala nman diba. Ang standard ba ngaun kailangan tumatakbo ang 80 years old na may baril? So kpag hindi pinatakbo si Eddie Garcia hindi un teleserye? Bakit ayaw nilang aminin na nagkamali sila at palpak tlga sila nung araw na un. Namatay na ung matanda gnyan pa ung sasabihin nila. Eh buti pa ung nagreklamo na di sya nakaihi may tinaggal na empleyado.

    3. 2:22 actually sa South Korea, one episode per week ang shows (drama, entertainment, etc) kasi kasi ang mga idols, actors, hostd, comedians, etc di exclusive ang contracts sa mga networks. Kaya kayang mag fill up ng maraming shows per network at saan2x napupuntang projects. Kaso para sa network here in PH, it's gonna be more expensive. Imagine in one day ilang shows meron (aside from Showtime, News, etc) and then we have 7 days in a week. Ang daming slots na dapat ma fill-up. You have to come up with so many concepts and shows sa isang week for one network para lahat unique. Gonna be so expensive. Di ka rin sure kung papatok ang gangang systema. The only show that can consistently get away with it is MMK kasi unique storyline per episode.

Hmm, then i guess another solution is to fill those timeslots with foreign shows like way back when, tapos yung apat(?) na shows na normally laman ng primetime lineup ilagay sa iba ibang araw weekly. Another possibility is to bring in independent filmmakers and producers to shoot episodes, tapos ang role lang ng network is to decide whether they would purchase the episodes for airing. Sadly though, sariling kagagawan yan ng mga networks. It seems like nagsimula yung sistema ng lagare nung inestablish nila yung network exclusivity.

    6. No, 2:13, tama yung comment sa taas. They air 2 episodes per week for their primetime drama shows (their 10 pm slot, without commercials). Sa atin, tadtad ng commercial ang 1 hour slot, 30 minutes lang talaga halos ang per episode.

    7. I agree with 2:22. They actually air 3-4 dramas per week sa isang time slot that ranges from 12 to 24 episodes. Maganda nga yung ganun. Pinag-isipan talaga kung ano ang ie-air lang per night. Wala masyadong filler episodes para maging maganda ang flow ng story. Kaya ng networks natin yan, at yun nga, new writers and directors could be discovered para naman maiba ang mapanood natin. Hindi puro kidnapan at revenge seryes.

  5. My gosh. They keep giving excuses. It just ticks me off that they can't just accept responsibility when the point it, it happened on the set during work hours. Very evident naman sa video yung nangyari din.

    2. Korek! Saka asan ang mga medic nung natapilok si Eddie sa cable? At bakit kung sino na lang ang nagbuhat sa kanya kung may medic pala? Tapos inabot ng ganon katagal bago sya naihanap ng taxi na magdadala sa kanya sa hospital? Wala bang may sasakyan sa set na pwede ipagamit kay Eddie Garcia para maitakbo agad sa hospital? Halos 30 minutes daw naghanap ng taxi!

  8. Ang daming palusot nang network na to. An actor died because of neglect and by not having the required inspector or personnel to make sure that the work environment is safe and that a qualified emergency person is at hand. Too much blah blah nonsense as always.

  9. Hmmm...the evidence is so very clear. He died because he tripped on loose cable(s) that were on the ground. The cables weren’t covered and secured as they should have been as per health and safety regulation.

  10. Palusot pa itong GMA. So are they admitting that they do not provide safety officers sa location shoots because it is not the workplace? So baka di rin covered ng insurance ang mga hinihire nila? So saan ba ang workplace ng mga artista at staff na nagshoshoot in different locations?

    1. A workplace is wherever you do the work. I work in mining outside of the traditional building but we are expected to observe and follow all health and safety practices and procedures. No exception.

  15. Excuses! Excuses! A legendary Filipino actor is now gone and yet GMA still doesn’t want to own up to its shortcomings.
    Mga TV shows sa Pinas pinapalabas either daily or nightly hindi once a week kaya lagare mode ang production team at artistas. Kawawa naman.
    Kakaumay na every day or night, yun at yun din mga palabas.
    Walang variety kaya di makapag evolve ang Pinoy TV.

  17. alam nyo kc oras na ni manoy. kahit maglatag ka ng sandamukal na safety precautions if will ni god talaga diba. aksidente na walang gusto mangyari. sabi nga may nagbabala na kay manoy na magingat sa pagkadapa. ayun nangyari nga.

  19. Accidents are accidents. Okay. But after that? Have you seen the video.. Is that the right way to carry a patient hindi stabilize yung buong katawan parang binuhat nlng basta basta. If they really say na may staff sila for first aid
    .we all know thats not the proper way to carry a patient after an accident. Stabilize. They could have done more damage just by carrying him the wrong way.. This should be a learning lesson to their industry and to other companies, health is wealth ika nga. I cant help to compare shows in gma and abs. Look at AP ilang taon na yan.. Ilang stunts ng ginagawa nila.. And yet alaga ang buong staff nila.. This should be a wake up call for them. If you make a project, make it sure din na alaga ang talents mo and staff.. All this BTS staff and talents gives us good show.

  20. ang konsensya lng ng direktor coz pinaulit-ulit pa dw ang scenes kay eddie,sa abs nga de puro lng nakaupo & nakatau ang lng scenes coz mahina na,di na pedeng takbuhan,syempre sabihin nya kaya nya pa.

  21. I think GMA should own up to their mistake and be held liable. Ang initial report non inatake daw sa puso during shooting. On the night of the incident, napanood ko ang video at yon agad ang napansin ko...napatid si Eddie Garcia sa cable at obviously misleading ang initial report. Besides napansin nyo ba kung pano binuhat si sir Eddie? Kung may presence ng medic at that time, I dont think ganon ang gagawin nila.
