Benjie used to intern for Charbel. He made designs for the company. It is natural for Benjie to sort of develop similar ideas and skills in making patterns and lines. I see a lot of Charbel’s signature in Benjie gowns. Or is it the other way around? Not really sure, I’m just here for the chizmiz. 😝

Charbel—Lebanese, Hollywood-based. Designs gowns for JLo, Britney, Paris Hilton, Shakira, and many other A-list celebrities (is Lele Pons A-list?) and performers.
Coz Benj is a paid worker who has no legal claim to those designs. I’ve read Charbel’s been warning him about the use of those designs, not sure how true, don’t quote me on that. Baka napuno si mamang Charbs.
The way Benj has been handling this issue may have added fuel to the fire too.

Super. From what I know, Benj was an illustrator of Charbel. So basically he was jud sketching the design from Charbel's mind. I also saw Charbel's works from his IG and I can really see the similarities in their designs. I think I'll take Charbels's side.

Charbel most likely provided mentorship sa umpisa to ensure that the designs benj produced while he's an intern fit his company's aesthetics and quality standards, then eventually started giving benj work and responsibilities na siya mismo dapat ang gumagawa (like most immigrant worker-employee relationshp tbh). Benj prolly got embittered na iba ang nakikinabang sa gawa niya so he took advantage of the fact na wala silang legal agreement. I get it, if nagdaan ka sa process na ini-sketch mo yung design, pumili ka ng fabric and iba pang material na gagamitin, tapos tinahi mo...it does feel yours so I get na it doesn't feel like you were doing something wrong at all na gamitin mo yung design for your own brand. But kelangan din siguro iconsider na yung buong aesthetic ng mga design at yung techniques na ginamit to make the clothes eh hindi natutunan ni benj on his own or hindi galing sa sarili niyang proseso, kundi directly na ipinasa sa kanya ni charbel. Kung may strong sense of integrity ang dalawang ito one would've completely started from scratch and not rehashed past designs that he made while he was working for somwbody else, while the other would've offered to give back the designs that his intern made under him nang kusa (unless those designs were paid for, then he should give him the chance to buy them back from him)

I dunno, it seems like limited ang understanding ni pinoy designer regarding plagiarism/ownership ng intellectual property, pero mukhang it's coming from a place of ignorance and not lack of integrity(hopefully). Wrong, if he got paid to work for the business owner then, he already got paid for that product. No legal agreement required. The money paid to an employee means that the owner paid for the product. Gets mo.
Hmmm....if you work for someone or any company, all the product or work you have done belong to the owner of the business or company. You were hired as a worker and got paid for any product you’ve produced. You as a worker have no claim to that product anymore. It is that simple.
Hay naku, simply lang yan. If you are a paid worker, nothing belongs to you. You are paid to produce, you don’t own anything, the owner of the business owns everything. It is that clear.
Both have mistakes on this: 1. Once a fashion house employs you, everything including sketches, concepts even toiles are automatically owned by the employer. Kasi you are working for them and you get paid.
2. Charbel should have a contract where you can never have a design relased outside the fashion house with 90% similarities.
3. Benj should have alter those sketches kasi legally alam niya those designs were already seen by his previous employer, as a designer you need to develop and evolve your style para hindi ka stagnant in a fast paced industry like fashion.
And most of all, both of them like any other gown/dress designers have similar silhouettes, process and aesthetics. 'Nothing is original, the only difference is your personal taste'. And that is my dear called POSTMODERNISM in design theory.

Kapag employee ka. All your works belong to your employer while you are working with them. They paid you for that and that is your job. Pareho lang yan ng ibang profession tulad ng mga architect, web designer etc.
You said it yourself, he is your ex-boss. It implies that your designs are paid for by him and that makes it the company's work product. It is not a collaboration if you already got paid for every design you submitted to the company. Design company has the rightful claim over the designs.
Ang isa pa pala...Benj was the one who executed and fleshed out the design. Pangalan niya ang nasa tag ng damit. It’s just funny how Charbel used photos nila Gazzini etc and claimed them as his, pero Benj was the one who executed the designs. Charbel could’ve arranged his attack differently, hindi ganyan.

As far as I know this has been the norm, there's just no way a designer can design all of those clothes on their own dahil sa time constraints, especially those giant fashion brands na apart from clothing may bags, shoes, sunglasses, eyeglasses, etc. Yung creative director parang general aesthetics lang yata yung inooffer.
When the big designers started their business they do the designing, pero siyempre pag malaki na ang company nagiging boss na lang sila. Kahit naman saang company ganyan.

I know na english is part of the curriculum sa atin, but yung mga may advantage lang, either socioeconomic or high intellectual capacity, ang nakakamaster ng english. Ang isang middle class na bata na nasa private school at may nakapaligid na mga middle to upper class who speak english on a daily basis vs ang batang halos di makabili ng libro or hindi makapasok sa eskwela dahil walang baon eh magkakaiba sa pagbuild ng knowledge dahil maraming barriers yung isa to learn, unless yung inherent characteristics nung bata ay special to the point na naovercome lahat ng obstacles. Let's face it, hindi lahat ng nasa prestigious na eskwelahan at mga inglisero nandun because they're part of the 10% or so ng mga pinakacapable, pinakamatatalino, at pinakatalented tao sa pilipinas. A lot of them are there dahil they were average people who have access to tutoring, exam preps, and tuition funds, but they're no jose rizal. FFS, mocha went to UST at marunong magenglish.

ReplyDeleteSuper. From what I know, Benj was an illustrator of Charbel. So basically he was jud sketching the design from Charbel's mind. I also saw Charbel's works from his IG and I can really see the similarities in their designs. I think I'll take Charbels's side.

Charbel most likely provided mentorship sa umpisa to ensure that the designs benj produced while he's an intern fit his company's aesthetics and quality standards, then eventually started giving benj work and responsibilities na siya mismo dapat ang gumagawa (like most immigrant worker-employee relationshp tbh). Benj prolly got embittered na iba ang nakikinabang sa gawa niya so he took advantage of the fact na wala silang legal agreement. I get it, if nagdaan ka sa process na ini-sketch mo yung design, pumili ka ng fabric and iba pang material na gagamitin, tapos tinahi mo...it does feel yours so I get na it doesn't feel like you were doing something wrong at all na gamitin mo yung design for your own brand. But kelangan din siguro iconsider na yung buong aesthetic ng mga design at yung techniques na ginamit to make the clothes eh hindi natutunan ni benj on his own or hindi galing sa sarili niyang proseso, kundi directly na ipinasa sa kanya ni charbel. Kung may strong sense of integrity ang dalawang ito one would've completely started from scratch and not rehashed past designs that he made while he was working for somwbody else, while the other would've offered to give back the designs that his intern made under him nang kusa (unless those designs were paid for, then he should give him the chance to buy them back from him)

DeleteI dunno, it seems like limited ang understanding ni pinoy designer regarding plagiarism/ownership ng intellectual property, pero mukhang it's coming from a place of ignorance and not lack of integrity(hopefully). The way he defends himself sa mga issues niya like yung pageant costume design na inspired ang concept from miss indonesia(?) and now itong allegedly paggamit niya ng mga designs na ginawa niya as intern under someone else's business makes you think na kulang ang understanding niya in terms of those things. Correct me if I'm wrong, but unless he purchased the right to those designs back from charbel then he doesnt have the right to use them. He can be influenced by the aesthetic, but yung exact same designs na ginawa niya under charbel, he's gotta let those go.

ReplyDelete1. Once a fashion house employs you, everything including sketches, concepts even toiles are automatically owned by the employer. Kasi you are working for them and you get paid.
2. Charbel should have a contract where you can never have a design relased outside the fashion house with 90% similarities.
3. Benj should have alter those sketches kasi legally alam niya those designs were already seen by his previous employer, as a designer you need to develop and evolve your style para hindi ka stagnant in a fast paced industry like fashion.
And most of all, both of them like any other gown/dress designers have similar silhouettes, process and aesthetics. 'Nothing is original, the only difference is your personal taste'. And that is my dear called POSTMODERNISM in design theory.
I work as a designer in a known label overseas bdw. :)

ReplyDeleteKapag employee ka. All your works belong to your employer while you are working with them. They paid you for that and that is your job. Pareho lang yan ng ibang profession tulad ng mga architect, web designer etc.

It is not a collaboration if you already got paid for every design you submitted to the company. Design company has the rightful claim over the designs.

It’s just funny how Charbel used photos nila Gazzini etc and claimed them as his, pero Benj was the one who executed the designs. Charbel could’ve arranged his attack differently, hindi ganyan.

As far as I know this has been the norm, there's just no way a designer can design all of those clothes on their own dahil sa time constraints, especially those giant fashion brands na apart from clothing may bags, shoes, sunglasses, eyeglasses, etc. Yung creative director parang general aesthetics lang yata yung inooffer.
