Insta Scoop: More than Copying Designs? Benj Leguiab IV and Charbel Zoe Continue to Exchange Barbs at the Personal Level

The truth will set us free and God is my witness. I don't want to post this because i have highly respect to my ex- head Designer, even we don't have a legal agreement i accept to keep this confidential in both of us. But you force me to tell the truth. 4 years ago i left the company but why you telling people that my presents designs now are yours? Way back 2013-2014 i worked in kuwait under the name of Charbel Zoe Couture as his Assistant Designer. In 2015 i Go back to Philippines and i wasn't able to go back in kuwait so i decided to stay in my home town to have my own job and to continue working with myself. In 2016 i started my career as a Fashion Designer using my own Brand Name, in 2017-2019 by the God's grace my career in Fashion Industry become successful, i have a lot of clients even outside of the country, my Brand name become well-known in the pageantry and celebrity artists. Yesterday i got news about my ex boss named Charbel sharing my work/Designs gown on his Instagram that he is the owner of that design, he's grabbing these creations that is totally mine. He spreading to his statements that i Stole his Sketches and designs, he used to edit one sketch to show the people that the design i made for Gazini is his design. Now this is the proof that some of the sketches and designs he has posted on his instagram is totally my sketch/Design i made this during the time i was working on him, He messaged me on instagram telling that i stole 300 copies of sketches/Designs -by means How could i stole the sketches and designs that actually i am the one who made those stuffs. A lot of people don't know the story about my relationship with my ex boss, the put me a conclusion that "why my style having a big resemblance in his creation" - simply means me and charbel had worked and collaborated together before and all my designs and ideas is only in one style..

      I think there is something called Proprietary Property. So if Benjie made these designs while on CZ’s payroll or while interning (paid or unpaid), they legally belong to CZ.

      Masakit man isipin na original idea ni Benjie nga designs nya, he could not use them without getting permission from the legal owner. He could be sued for infringement.

    Magtagalog nalang, mas madedefend pa ang sarili at makakahugot. It’s not bad to try to speak English, but if you cannot express yourself properly why bother, aral nalang muna.

    Gets naman kung anong pinaglalaban nila but when you’re throwing bricks at one another, saying offensive words in English doesn’t make you any classy.

    Kung may nanakaw na design, eh di idemanda.

    2. Hindi nga nya ginamit ang mga nasa lookbook na design. 2015 pa na mga designs yun. Gumawa xa ng mga bago ngayon na sa kanya na mismo. Well mentor nya dati si Charbel so malamang may mga resemblance ang mga gawa nila but it's never okay na you'll claim it kasi feeling mo ideas mo yun. It's a big NO. Ang problema kasi sa empleyado minsan, porket nakatulong sa employer feeling na nila eh dahil sa kanila kaya kumikita ang hanap buhay, totoo din naman yun pero dapat wag di kalimutan na nung wala silang trabaho, binigyan sila ng pagkakataon ng employer nila magka hanap buhay kaya nga si Benj naging bihasa sa pagiging designer dahil malaki din ang naitulong sa kanya ng mentor nya.

    1. Benjie used to intern for Charbel. He made designs for the company. It is natural for Benjie to sort of develop similar ideas and skills in making patterns and lines. I see a lot of Charbel’s signature in Benjie gowns. Or is it the other way around? Not really sure, I’m just here for the chizmiz. 😝

    2. 12:30 charbel mentored benj but during the time benj worked for him, benj was the one who designed the gowns at wala silang papel na pinirmahan so by default, pag aari ni benj ang disenyo nya at di pwedeng ankinin ni charbel. Naiinggit siguro ang charbel na ito pagkat umaangat na ang dati nyang empleyado. Wag ganun te, maging masaya para sa iba lalo na tayo ang naging dahilan ng pag angat nila.

    2. ninakaw daw ni Benj ang lookbook nya nung 2015 and laman ng lookbok eh mga sketches nmn ni Benj na ginawa nya for Charbel while itong si Charbel pa trip trip lang kong saan saan. Feeling nya itong mga gawa ni Benj ngayon ang laman ng lookbook na yun kaya kiniclaim nya. Sabi ni Benj hindi nya ginamit ang mga designs na yun pra na din wlang issue. See? Hindi nga matandaan ni Charbel kong yung mga new designs ngayon ay ang laman ng lookbook eh kasi di nmn xa ang gumawa. Malamang kong titingnan nya almost magkakatulad gawa nila eh syempre siya ang mentor and collab sila before. And besides halos lahat ng designers ngayon halos magkakaperaha lang ang gawa. People in other places that are heavily multicultural use the English Language as a medium for understanding, with less emphasis on technicalities. Dubai, Vietnam, Thailand, etc. speak the same broken English due to different linguistic backgrounds, but they understand one another. Many of them know 2 to 3 languages, and here you are implying you are better because you think your English is better. Lol. So ignorant.

    2. Hay naku. Nakakaloka yung mga ganitong insult. I know na english is part of the curriculum sa atin, but yung mga may advantage lang, either socioeconomic or high intellectual capacity, ang nakakamaster ng english. Ang isang middle class na bata na nasa private school at may nakapaligid na mga middle to upper class who speak english on a daily basis vs ang batang halos di makabili ng libro or hindi makapasok sa eskwela dahil walang baon eh magkakaiba sa pagbuild ng knowledge dahil maraming barriers yung isa to learn, unless yung inherent characteristics nung bata ay special to the point na naovercome lahat ng obstacles. Let's face it, hindi lahat ng nasa prestigious na eskwelahan at mga inglisero nandun because they're part of the 10% or so ng mga pinakacapable, pinakamatatalino, at pinakatalented tao sa pilipinas. A lot of them are there dahil they were average people who have access to tutoring, exam preps, and tuition funds, but they're no jose rizal. FFS, mocha went to UST at marunong magenglish.

      Benj—Pinoy, used to intern for Charbel in Kuwait. Now independent designer, mostly pageant gowns.

      Charbel—Lebanese, Hollywood-based. Designs gowns for JLo, Britney, Paris Hilton, Shakira, and many other A-list celebrities (is Lele Pons A-list?) and performers.

    3. Coz Benj is a paid worker who has no legal claim to those designs. I’ve read Charbel’s been warning him about the use of those designs, not sure how true, don’t quote me on that. Baka napuno si mamang Charbs.

  19. kahit mag design pa sya ng 1000 or 10000 sketches if during that time drinowing mo at ginawa yan habang employed ka pa under him eh di hindi mo pag aari yan. technically the company owns it. hindi mo pwede i claim na sayo yan kahit ikaw pa ang nag drawing! kasi bayad ka nya as empleyado.

    1. Super. From what I know, Benj was an illustrator of Charbel. So basically he was jud sketching the design from Charbel's mind. I also saw Charbel's works from his IG and I can really see the similarities in their designs. I think I'll take Charbels's side.

Charbel most likely provided mentorship sa umpisa to ensure that the designs benj produced while he's an intern fit his company's aesthetics and quality standards, then eventually started giving benj work and responsibilities na siya mismo dapat ang gumagawa (like most immigrant worker-employee relationshp tbh). Benj prolly got embittered na iba ang nakikinabang sa gawa niya so he took advantage of the fact na wala silang legal agreement. I get it, if nagdaan ka sa process na ini-sketch mo yung design, pumili ka ng fabric and iba pang material na gagamitin, tapos tinahi mo...it does feel yours so I get na it doesn't feel like you were doing something wrong at all na gamitin mo yung design for your own brand. But kelangan din siguro iconsider na yung buong aesthetic ng mga design at yung techniques na ginamit to make the clothes eh hindi natutunan ni benj on his own or hindi galing sa sarili niyang proseso, kundi directly na ipinasa sa kanya ni charbel. Kung may strong sense of integrity ang dalawang ito one would've completely started from scratch and not rehashed past designs that he made while he was working for somwbody else, while the other would've offered to give back the designs that his intern made under him nang kusa (unless those designs were paid for, then he should give him the chance to buy them back from him)

Kampi ako sa Pinoy dito, kasi mga ibang designers sa America lalo na ang mga ibang lahi (arab, Latino) eh gagamitin talaga mga intern para lng makapag bakasyon habang ibang tao na gawa ng work nila , ugali ng mga pasosyal yan dito sa America, kukuha ng someone dedicated sa work tas aabusuhin ng todo, jusko laganap sa California at Florida mga ganyan

I dunno, it seems like limited ang understanding ni pinoy designer regarding plagiarism/ownership ng intellectual property, pero mukhang it's coming from a place of ignorance and not lack of integrity(hopefully). The way he defends himself sa mga issues niya like yung pageant costume design na inspired ang concept from miss indonesia(?) and now itong allegedly paggamit niya ng mga designs na ginawa niya as intern under someone else's business makes you think na kulang ang understanding niya in terms of those things. Correct me if I'm wrong, but unless he purchased the right to those designs back from charbel then he doesnt have the right to use them. He can be influenced by the aesthetic, but yung exact same designs na ginawa niya under charbel, he's gotta let those go.

  32. Both have mistakes on this:
    1. Once a fashion house employs you, everything including sketches, concepts even toiles are automatically owned by the employer. Kasi you are working for them and you get paid.

    2. Charbel should have a contract where you can never have a design relased outside the fashion house with 90% similarities.

    3. Benj should have alter those sketches kasi legally alam niya those designs were already seen by his previous employer, as a designer you need to develop and evolve your style para hindi ka stagnant in a fast paced industry like fashion.

    And most of all, both of them like any other gown/dress designers have similar silhouettes, process and aesthetics. 'Nothing is original, the only difference is your personal taste'. And that is my dear called POSTMODERNISM in design theory.

  37. Kapag employee ka. All your works belong to your employer while you are working with them. They paid you for that and that is your job. Pareho lang yan ng ibang profession tulad ng mga architect, web designer etc.

  38. You said it yourself, he is your ex-boss. It implies that your designs are paid for by him and that makes it the company's work product. It is not a collaboration if you already got paid for every design you submitted to the company. Design company has the rightful claim over the designs.

  39. Ang isa pa pala...Benj was the one who executed and fleshed out the design. Pangalan niya ang nasa tag ng damit. It’s just funny how Charbel used photos nila Gazzini etc and claimed them as his, pero Benj was the one who executed the designs. Charbel could’ve arranged his attack differently, hindi ganyan.

As far as I know this has been the norm, there's just no way a designer can design all of those clothes on their own dahil sa time constraints, especially those giant fashion brands na apart from clothing may bags, shoes, sunglasses, eyeglasses, etc. Yung creative director parang general aesthetics lang yata yung inooffer.

    2. When the big designers started their business they do the designing, pero siyempre pag malaki na ang company nagiging boss na lang sila. Kahit naman saang company ganyan.

  44. if you got paid for your designs while you worked for that label, sorry to break it to you hun but those designs belong to that label now, it doesnt matter if those designs were your idea
