Repost: DOLE Secretary Says GMA Might Be Penalized for Eddie Garcia Incident

GMA Network may find itself in hot water after Labor Secretary Silvestre Bello III said the network may be held liable and penalized for the on-set injury that caused the death of veteran actor Eddie Garcia.

In an interview over CNN Philippines, Bello said there must be an Occupational Safety and Health (OSH) officer in every establishment to make the work place safe and compliant with health standards, as stated under the OSH Law.

The Occupational Safety and Health Center (OSHC) is already probing the accident.

“Iinspeksyunin nila kung tama ‘yung pagkahawak kay Mr. Eddie Garcia. Kung merong safety and health officer, baka nabigyan ng tamang treatment when he had that accident,” Bello told CNN Philippines.

Should GMA Network be found liable for any violation, the labor chief said the OSHC can file administrative charges against the network even without a complaint from Garcia’s family.

The network may be slapped with a monetary fine or “suspensions of operations”, depending on how grave the lapses were, Bello added.

The OSH law sets a maximum fine of P100,000 per day.

In a statement last June 10, GMA Network said it is looking into the absence of a medical team on the set.

On Thursday, the multi-awarded actor passed away at the Makati Medical Center after he suffered severe cervical fracture or broken neck.

Garcia sustained the fracture after he reportedly tripped and fell while shooting a television series in Tondo, Manila.

Garcia was cremated last Friday and the public viewing of his urn ended on Sunday.

      Is this a case of either/or? Why not penalize them with a stiff fine AND suspension of operations?

      Look, Mr. Garcia died as a result of GMA’s negligence while he was on the job. How much more gravely can the infractions be? Meron pa bang mas gagrabe or lalabis pa sa pagkawala ng buhay??? This is now adding insult to injury. How did it come to this?

      Kaya nakaka frustrate dito sa bansa natin eh, kasi yung ganyan na pakiwari eh may chansang mapa-walang sala yung mga salarin. You don’t have to be related to the Garcias to feel the inequity of the law in this case. The government agency charged with protecting our rights against negligent acts committed by businesses like GMA, seems to be on the fence on the matter. That or the labor laws governing this incident simply has no teeth. Granted GMA is a network giant; but for crying out loud, Secretary Bello, use this as an opportunity to lead. Show the country that you will uphold the law properly and make things right.

Parang wala namang negligence doon except that di nila nacontrol ang crowd sa pagkaalala ko. Ganunpaman, civilly liable sila for damages kasi may sagutin pa rin sila sa nangyari unlike sa GMA obvious ang negligence

  3. True. It’s very disappointing na network na kasing laki nila doesn’t have the proper preps on shooting. Kalat cables, no stretcher, no medics, etc. Kawawa si manoy buhat nakaupo, it aggravated the neck damage severely.

    3. Ang mali talaga ng GMA wala cla medics na stand by. Action drama kaya dpat laging may naka abang. And ang alam ko bawal na maglakad c manoy, nung last kita ko sa kanya shoot pa un ng movie nya way back 10yrs ago bawal na sya maglakad lakad ng malayo. Tapos walang nakatutok? My gahd

  5. Sana din DOLE, huwag na antayin na may malalaking industry pang gaya ng GMA ang mag violate ng rules. Susko. Mag-ikot kayo sa mga government offices, ang safety hazard, grabe. Sa loob ng mga SSS office, di ba laging jampacked ng tao? Kapag nagkasunog (huwag naman), sure ba na hindi magkaka stampede? May fire exits kaya? May Emergency response team kaya na ma-a-activate? Linis linis din ng bakuran, mga sir and ma’am.

  6. Talagang dapat managot ang GMA. Bakit walang medics on standby? Bakit walang safety officer? Bakit walang trained in first aid na nasa set? Nakakagalit that an icon who is in perfect health died dahil sa kapabayaan nila.

  7. As they should. Para kasing now wala silang kasalanan dito. They may have settled with family - I hope they shouldered all expenses - pero dapat may accountability. Dapat nga may public apology. Hinde un pupunta sa wake to do eulogy and not say anything. PArang wala silang ginawa.

  9. It’s too obvious that they have no health and safety, which is very common in this country. What were Dole and OHSC doing before this accident? Non compliance is so common in this country.

  11. Nagtitipid kasi sa production.alam nang may mga workers at risk such as mr.eddie garcia kasi hes an elderly,tsk tsk. Pansin ko din yung mga teleseryes tsaka shows halata namang tinitipid.
