Annulment is null and void right from the start ang marriage while divorce is may bisa pero ipapawalang bisa. The only reason na di ma-illigimate ang anak ay pag "psych icapacitated" ang reason. Reasearch muna uy!

      ..hindi illegitimate ang mga anak sa annulled na kasal as long as legal ang kasal nila sa simula..pero kung ang kasal is declared as void ab initio,yun ang illegitimate..pag annulled,meaning legal ang kasal ninyo sa simula dahil sinunod nyo ang requirements..pero kung may mali sa kasal ninyo sa simula pa lang,gay ng hindi authorized ang nagkasal sa inyo, ay hindi kailangang ipa annul! ipa void nyo lang yan at illegitimate ang mga anak ninyo,sorry..

      ..ang valid marriage ay annulment ang paraan para null and void,but the children are still considered legitimate after the annulment coz the marriage is valid from the beginning..this means na comply nila ang requisites sa marriage
      ..on the other hand,ang void marriage ay invalid na sa simula pa lang..hindi kailangan ng annulment,simple lang ang processing para ma void..ex. kris aquino’s marriage to james yap..one reason sa void marriage ay married ang isang party sa iba..in this case,illegitimate ang mga anak..

    17. Hindi po. One of the exceptions po ang ganitong case. Under Family Relations po children conceived or born during the existence of a valid marriage are legitimate (will remain be) even after annulment under Art 36

    18. Of course they’re legitimate. They were married to each other when the children were conceived and born. Annulment won’t affect the legitimacy of the children. Check Article 54, Family Code of the Philippines.

      Declaration of nullity, yun yung null and void from the start ang marriage for reasons such as below 18 and walang consent, no marriage license, fake documents etc etc so if this is the case its as if no marriage took place
      Annulment on the other hand valid ang kasal but you want to void it once granted the marriage will be void pero may record pa din ng kasal and as for the children they will remain legitimate since they were born during a valid marriage.

    20. It depends on the grounds of the annulment. If the annulment was caused by declaring a marriage as void ab initio (ie bigamous marriages), then children will be considered as illegitimate. However, if a marriage was valid but was just nullified on the grounds stated in our family code, then they are still considered legitimate.

    22. Kapag ang ground ng annulment ay Psychological Incapacity, children born under that marriage are considered legitimate. Kung hindi naman yun ang ground, illegitimate sila. For example, bigamous marriage o kaya ikinasal sila at the age of below 18 regardless kung may consent pa ng parents. Ganon.

    23. Tama si 12.28. Depende sa ground ng annulment yan. It depends if inallege ba niya na ground falls within void marriages or one of those under voidable marriages. Kapag void, general rule is illegitimate sila except if the ground alleged is psychological incapacity o kaya hindi mo naparecord yung judicial declaration of nullity of previous marriage mo then nag asawa ka ulit, void ang second marriage mo nun under Art 53 of the Family Code dahil nga hindi mo naparecord yung judicial declaration aforementioned, regardless yung anak mo sa second marriage ay legitimate padin. Pero pag yung ground na inallege is under voidable marriages, legitimate padin ang anak mo kahit walang bisa na ang kasal.

    28. depende sa ruling ng korte. may mga decision na sinasabi na hindi illegitimate ang mga bata, and that they will continue carrying their father's name and all rights of legitimate children. i should know, i am a product of annulment. ;)

    4. 10:24PM sa kasal mas appropriate na sabihin sa bride ay Best Wishes, sa groom ang congratulations. But sa divorce or annulment, kung sinong nagpetition, kapag nagrant na, sasabihan na ng congratulations. Wala lang, mema lang.

    1. Don't judge couples whose marriages did not work. It does not automatically mean that God was not in their relationship. It happens. For A LOT of reasons.

    2. Dont be judgemental about people wanting to nullify a marriage. They have reasons that we know nothing about. When people separate, it doesnt mean that God is not at center of their relationship. Sometimes someone needs to get out of a marriage to keep their self respect and sanity but I am sure they still believe in God.

    3. Agree, 11:26. Maka-Diyos ako pero I am pro-divorce. Mahirap kasi nakatali kung hindi na talaga pwede, but it does not mean na God is not the center of their marriage kaya nagkaganoon. Maraming factor at hindi natin naiintindihan kasi wala naman tayo sa buhay nila. I am still married though.

  7. It doesn’t matter whether the kids becomes illegitimate or whatever . That’s not really an issue. It’s the toxic marriage and the Narcissist father thats always been the problem . The kids are fine even without their biological father , it’s not always about blood . They will probably experience more love , care and respect from Sunshine’s new bf than their own father would ever give them . Let them be , they all deserve to be happy . They’re better off not being connected to their deadbeat father in any way .

    1. nope, sa Estado po ang annulment. Kung katoliko ka naman aside from your legal annulment pwede ka din magfile for Vatican annulment kung gusto mong makasal ulit sa church pero hindi ito ibibigay sa iyo hanggat hindi ka annulled sa korte.

    1. legitimacy is also important. Hindi naman sa usapan ng kadugo pero ito ay upang protektahan ang mga karapatan ng mga anak under the family code. More on legal rights, like property etc etc.

  14. When will they allow divorce in the Philippines? Obviously, some marriages don't last and divorce can't be worse than bigamy or annulment..both of which are commonplace nowadays. Besides, a lot of granted petitions for annulment had no real grounds for such..just takes longer and costs more financially and emotionally.

But then again, we shouldnt criticize her for doing so as CM had/have been into several girls already even when they are still together.     2. 6.03 Te, di ako OA. Sa annulment cases, may interest ang State due to its duty to preserve the sanctity of marriage. It is represented by SolGen then ang SolGen idedelegate sa prosecutors to represent the State. Kada hearing sa annulment, present ang prosecutor. Kaya pwede i appeal ng prosecutor or SolGen yan lalo na pag nakarating sa Court of Appeals and/or Supreme Court ang appeal. Abogado ako teh huwag kang ano diyan. Basa basa din. Libre Google.
