  1. So, does the annulment make the children illegitimate?

    1. Wala naman nang difference sa rights and legitimate at illegitimate children so ok lang siguro

      Delete
    2. ..of course not!as long as kinasal kayo, legit pa rin mga anak ninyo..but cant say the same sa mga kinasal na dineklarang null and void from the start..

      Delete
    3. Of course not!

      Delete
But annulment of marriage will not make legitimate children illegitimate.

      Delete

      Delete
    7. sa mga of course not ng of course not dyan as if sure na sure kayo, qlamin nyo muna ang Family Code! Illigimate ang anak pag annulled ang kasal. Iba ang Annulment sa divorce. Annulment is null and void right from the start ang marriage while divorce is may bisa pero ipapawalang bisa. The only reason na di ma-illigimate ang anak ay pag "psych icapacitated" ang reason. Reasearch muna uy!

      Delete
    8. No since dala pa rin ng kids ang pangalan ni Cesar sa birth certificate.

      Delete
    9. of course illigitimate kasi null and void ang kasal. walang kasalang naganap. they are conceive out of marriage.

      Delete
    10. The kids were born WITHIN the marriage, so they're not illegitimate even if the parents got annulled, you idi*t.

      Delete
    11. 3:25 at 5:15 no

      Delete

..there are two types of marriage, valid marriage and void marriage
..ang valid marriage ay annulment ang paraan para null and void, but the children are still considered legitimate after the annulment coz the marriage is valid from the beginning..this means na comply nila ang requisites sa marriage
..on the other hand, ang void marriage ay invalid na sa simula pa lang..hindi kailangan ng annulment, simple lang ang processing para ma void..ex. kris aquino’s marriage to james yap..one reason sa void marriage ay married ang isang party sa iba..in this case, illegitimate ang mga anak..
      ..gets mo?

    16. true depende sa grounds

      Delete
    17. children who were born to a marriage that was later declared void due to the psychological incapacity of one or both of the spouses under Art. 36 of the Family Code are still considered legitimate

      Delete
    18. Hindi po. One of the exceptions po ang ganitong case. Under Family Relations po children conceived or born during the existence of a valid marriage are legitimate (will remain be) even after annulment under Art 36

      Delete
    19. Of course they’re legitimate. They were married to each other when the children were conceived and born. Annulment won’t affect the legitimacy of the children. Check Article 54, Family Code of the Philippines.

      Delete
    20. Kindly correct me if im wrong there's declration of nullity of marriage and theres annulement
Declaration of nullity, yun yung null and void from the start ang marriage for reasons such as below 18 and walang consent, no marriage license, fake documents etc etc so if this is the case its as if no marriage took place
Annulment on the other hand valid ang kasal but you want to void it once granted the marriage will be void pero may record pa din ng kasal and as for the children they will remain legitimate since they were born during a valid marriage.

      Delete
    21. It depends on the grounds of the annulment. If the annulment was caused by declaring a marriage as void ab initio (ie bigamous marriages), then children will be considered as illegitimate. However, if a marriage was valid but was just nullified on the grounds stated in our family code, then they are still considered legitimate.

      Delete

      Delete
    23. Kapag ang ground ng annulment ay Psychological Incapacity, children born under that marriage are considered legitimate. For example, bigamous marriage o kaya ikinasal sila at the age of below 18 regardless kung may consent pa ng parents. Ganon.

      Delete
    24. Tama si 12.28. Depende sa ground ng annulment yan. It depends if inallege ba niya na ground falls within void marriages or one of those under voidable marriages. Kapag void, general rule is illegitimate sila except if the ground alleged is psychological incapacity o kaya hindi mo naparecord yung judicial declaration of nullity of previous marriage mo then nag asawa ka ulit, void ang second marriage mo nun under Art 53 of the Family Code dahil nga hindi mo naparecord yung judicial declaration aforementioned, regardless yung anak mo sa second marriage ay legitimate padin. Pero pag yung ground na inallege is under voidable marriages, legitimate padin ang anak mo kahit walang bisa na ang kasal.

      Delete
    25. yes correct 12:28 depende talaga sa grounds. Pag illegitimate pwede nyang ampunin.

      Delete
    26. Legitimacy is the status of children born to parents who were legally married to each other at the time of the child's birth or a child conceived before the parents obtained annulment

      Delete
    27. Kailangan mong ampunin ang sarili mong anak kapag illegitmate? Ano'ng klaseng batas iyan?

      Delete
Under the law po, ano pong rights nila?

      Delete
    29. depende sa ruling ng korte. may mga decision na sinasabi na hindi illegitimate ang mga bata, and that they will continue carrying their father's name and all rights of legitimate children. i should know, i am a product of annulment. ;)

      Delete
  2. wow congratulations for sunshine! ilang years nya din to hinintay.

    1. so if annulled na, null and void and kasal meaning walang kasal na naganap, pano na ang support sa mga kids na pinaglalaban niya?

      Delete
    2. iba pa yon. Pero ke annulled o hindi karapatan pa rin nila na suportahan ng tatay nila until they are of legal age.

      Delete
    3. Pag ikinakasal Congrarulations.
Pag na-grant ang annullment Congratulations din. LOL!

      Delete

  3. I don't know why God was even mentioned in one's dissolution of marriage? Because I believe that when God is in the marriage in the first place, it will not break apart.

    1. Don't judge couples whose marriages did not work. It does not automatically mean that God was not in their relationship. It happens. For A LOT of reasons.

      Delete
    2. Dont be judgemental about people wanting to nullify a marriage. They have reasons that we know nothing about. When people separate, it doesnt mean that God is not at center of their relationship. Sometimes someone needs to get out of a marriage to keep their self respect and sanity but I am sure they still believe in God.

      Delete
    3. Agree, 11:26. Maka-Diyos ako pero I am pro-divorce. Mahirap kasi nakatali kung hindi na talaga pwede, but it does not mean na God is not the center of their marriage kaya nagkaganoon. I am still married though.

    3. on the grounds that they have enough money to pay the exhorbitant fees of an annulment

      Delete
    6. Yes, ginagawang divorce ang annulment sa Pilipinas minus all the rights of those involved.

      Delete
    7. Hindi naman. Kapag divorce, mas mabilis. Hehe. Haha.

      Delete
    8. @9:51pm, obviously missing the point lol

Annulment is only for marriages invalid in the first place, not for dissolution of real and valid ones

      Delete
    9. mahirap , matagal at mahal magpa annul. But let's not be a hypocrite here, maraming tao nag hiwalay na pero hindi nga lang legal or annulled dahil sa kamahalan nito pero technically they have been separated for the longest time.

      Delete
    10. @12:43 "declaration of nullity" yata yung ineexplain mo.. Different yan sa "annulment"

  7. It doesn’t matter whether the kids becomes illegitimate or whatever . That’s not really an issue. It’s the toxic marriage and the Narcissist father thats always been the problem . The kids are fine even without their biological father , it’s not always about blood . They will probably experience more love , care and respect from Sunshine’s new bf than their own father would ever give them . Let them be , they all deserve to be happy . They’re better off not being connected to their deadbeat father in any way .

  11. Annulment sa simbahan lang yan ano ba? Kaya legitimate pa rin ang mga bata!

    ReplyDelete

      Delete
    2. 9:08 so wrong. iba pa ang annulment sa simbahan. mas madugo and tama si 1:37 kailangan mo yan if you want to get married again in church. kaya most annulled people when they remarry sa huwes na lang, di na sa church kasi mahirap ung annulment sa church. my marriage was annulled 5 yrs ago that's how I know

  13. An offspring is an offspring no matter what. No piece of paper should dictate the legitimacy of children.

    ReplyDelete

    1. legitimacy is also important. More on legal rights, like property etc etc.

      Delete
Third world thinking.

      Delete
    3. correct!

  14. When will they allow divorce in the Philippines? Obviously, some marriages don't last and divorce can't be worse than bigamy or annulment..both of which are commonplace nowadays. Besides, a lot of granted petitions for annulment had no real grounds for such..just takes longer and costs more financially and emotionally.

    1. vote for smart public officials for congress and senatorial seats to pass on divorce bill.

But then again, we shouldnt criticize her for doing so as CM had/have been into several girls already even when they are still together. But happy for her, at least nakawala na sia sa stress nia sa buhay.

    2. 6.03 Te, di ako OA. Sa annulment cases, may interest ang State due to its duty to preserve the sanctity of marriage. It is represented by SolGen then ang SolGen idedelegate sa prosecutors to represent the State. Kada hearing sa annulment, present ang prosecutor. Kaya pwede i appeal ng prosecutor or SolGen yan lalo na pag nakarating sa Court of Appeals and/or Supreme Court ang appeal. Abogado ako teh huwag kang ano diyan. Basa basa din. Libre Google.
