Letter From a Reader: Beware of Deceptive Marketing of Insurance Company

Dear Fashion PULIS,

I am one of your avid readers. Just call me Tere and allow me to share my story about how I was fooled by Danvil Insurance in SM Megamall.

One rainy afternoon in February, I went to SM Megamall to meet up a friend. Since I was too early for our meeting, I went up to the 5th floor to walk around. While I was window shopping, a male agent approached me and asked me if I have a credit card. When I said yes, he asked me to show it to him and when I did, he told me that I was entitled to join a raffle for a chance to win a car. He also informed me that if I was willing to attend their company's 40 minute presentation, I will receive giveaways like umbrellas and throw pillows. It was raining cats and dogs outside, I forgot to bring an umbrella and I was too early for our meeting, so I accepted the invitation.

When I entered their office, he introduced me to his female colleague. She accompanied me to the reception desk, and the receptionist took note of my credit card number. She told me that before I qualify for the raffle, I have to first listen to a presentation about the company. The male agent came back and brought me inside a room where loud music was being played. I was given a blank piece of paper and information sheets to accomplish. They offered me drinks while I was busy answering the forms.

After I was done with the forms, the female agent requested me to write my future plans on the piece of blank paper. She left for a while and when she came back, she started talking about what I wrote, my future plans and the way I save money. She told me in Filipino, "Ma'am ang konti naman ng ipon mo, pano nalang kapag bigla kang mamatay, paano na ang mga mahal mo sa buhay? Mas maganda diba, kung may ipon ka, monthly mong huhulugan ng 1,800 pesos for 5 years at in 15 years ay makukuha mo na and pera mo na halos doble pa sa hinulog mo." She continued talking about the company, their different insurance policies and then she started selling their plans to me. I told her I was not interested but she kept insisting. It was almost time for me to meet my friend but she won’t let me go unless I present my credit card to her. Since I had no choice, I gave it to her, she took it to the cashier and the next thing I knew, the agents were clapping and congratulating me. I asked her why she swiped my credit card without my permission and she said the transaction could not be cancelled. Since my friend was already waiting for me at the food court, I was forced to quickly sign the papers and she gave me an umbrella before I allowing me to leave the office.

I was very bothered the whole night so the following day, I searched the company online and I found out that this company really employs deceptive marketing. After reading the different blog entries, I tried calling HSBC to cancel the transaction, the agent was very sympathetic but he told me that he can't cancel the transaction unless Danvil cancels it for me. He suggested that I file a dispute instead.

The next day was a Monday, I went to the company’s office but it was closed. I went again the following day and they were many mall goers inside the office. I was told to get a number, and when it was my turn, I told the customer service representative that I wanted to talk to the female agent. She told me that it was not possible so she called for the manager instead. The manager told me that I couldn't cancel the transaction because I already signed the papers. I told him that they won’t let me out of the office unless I gave them my credit card and they swiped my credit card without my permission. I threatened him that if he will not cancel the transaction, I will make a scene and tell all the people inside the office about what happened to me. He got shocked because I started kicking the chair and he finally agreed to cancel the transaction. He issued me a cancellation slip that said CANCELLED FROM INCEPTION and he informed me that my money would be reimbursed to my account after 45 days. When I got home, I immediately called HSBC and sent them through fax the cancellation paper from Davil. Forty five days later, I called HSBC and I was very happy when they told me that the 6,000 pesos was already reimbursed to my account.

In my opinion, the company is legal but the way they use deceptive marketing is illegal. The company also had Prudential Life attached to their name which confused me severely. If I am not mistaken, the complete name is Danvil Philippines Prudential Life, formerly known as Family First. I don't know why the SM Megamall Management tolerates this kind of deception inside their mall. I hope this story serves as a lesson to all your readers. Whatever happens, do not give your credit card to anyone if you do not agree to what he/she is trying to sell you. I think the government agency responsible for issuing permits to this company should also investigate further on this matter.

  2. my brother fell victim to their "bullying" as well. ang kulit daw kasi, di sya pinapaalis, etc. hard-sell talaga.

    he decided to just continue on with the "investment" and hopefully, he'll get the money back (through monthly pension, i think) when it matures (which i don't know when).

    as of now, he's paying about P1550-P1600 monthly, auto-charged to his credit card.. i would really like to believe that this is a legit company (hopefully, i'm right), and eventually my brother get his "investment" back..

  3. This happened to me too way back when the company was named Family First.

    Inalok naman nila ako ng free cinema tickets and when I entered the place because of curiosity talagang hindi nila ako pinakawalan hanggang sa magsara na ang mall. As in ayaw ko talagang ibigay yung card ko kaya lang pinipilit nila ako. Good thing malapit na sa maximum credit limit yung card ko kasi may binili akong appliances nun and so hindi sila na-swipe yung amount na gusto nila.

    To everyone, BEWARE! As in grabe ang tactic nila to the point of harassment na ang dating.

  4. They do have dirty marketing tactics, but you always have a choice. No matter how pushy they are, you can always say no.

    I hope next time you won't give your credit card or any information that freely as you narrated in your story.

  5. This company was originally known as Family First Inc. Back in the late 90's, they were already operating in Megamall. My friends and I were almost duped into signing the form to subject ourselves to a 45 minutes presentation. Being fresh college grads we were, those things did not interested us, we excused ourselves that we'd be going to the bathroom. upon exiting their room/office we immediately took the escalator and went to the food court! LOL

    Anyway, I too heard horror stories about this company and the awful manner how their agents conduct their business. I went back to Megamall 5th level in 2004 and was surprised that they are still in business. Had visited again last year and their agents were mobbing me. Their line was "Sir, me credit card kayo?" I'd reply by saying "meron!" They'd follow up by opening their sales pitch and I'd just reply "sorry di ako interesado!"

  6. I also experienced this one way back in 2008. I was also in Megamall when someone from Danvil asked me if I had a credit card. I told them I have one. They asked me to go inside their office and present to me their savings program plus I can win a car and have free movie tickets. I agreed to go with them since my friend and I were tired and we sort of wanted to relax a bit. However when I saw the scene inside their office, I immediately decided to say no to all their offers because I trusted my instincts during that time. I didn't give them my credit card. They were very mad during that time because I wasn't cooperating. They were telling me, "walang mangyayari sayo kung ganyan ka". It was a very good decision though. A few days later, they were featured in an ABS-CBN show(I forgot the title, it's somewhat a documentary). Their schemes were revealed. And that time they really mentioned that the insurance company was a scam. It was 2008 when I experienced it. How come the company is still operating in Megamall? I wonder what the mall management is up to. Maybe it's just because of the money.

  8. yung sister ko was one of the victim ng danvil. when i told her na scam un they decided to cancel and pull out their money. ang nakuha lang nila is PhP 5, 000 sa binayad nilang Php 50,000 inabot pa ng 3 months bago nila na kuha yung cheque. tsk! tsk!

  9. kaya ako, whenever i go to malls and agents ask me if i have credit cards, i tell them,"sorry, but cash transactions only..." hehehe..as if naman may cash :P

  10. I was almost a victim of this too, sa SM Fairview naman. I'll look for my blog entry and post it here if FP doesn't mind. Anyway, halos lahat ng SM malls meron nyan. In SM North alone, meron sa basement ng main mall & near the cinemas papunta sa Annex. The "agents" will really try hard to get your attention. "Pwede po ba magtanong?" is the most common. Meron pa na pag di mo sila pinansin tatawagin lang "Ganda" like what my sister experienced. Shempre you will not ignore someone who praises you diba? The moment my sister looked up I grabbed her away from the agent. My mom naman stares the agent down, kasi ang hilig nila mangharang talaga. Sana mapaalis na sila sa SM.

    Talo kayo nung friends ko. Sila nabigyan ng free movie tickets pero hindi sila napaswipe ng card.

    Alam niyo ganyan din yung City Limits Scam. Affiliated daw sila sa VISA kuno pero hindi naman talaga. Muntikan na akong nabiktima pero inaway ko talaga yung HSBC dahil ayaw nilang i cancel at pina cut ko yung card ko sa kanila.

  13. Prudential Life Insurance has the same scheme. They'll approach you and ask if you have a CC. and if the client say yes, immediately the agent will accommodate.

    do they wear Blue long sleeves? if yes. nakoo mandurugas yan sila! yes na feature na yan sa ABSCBN's XXX! dahil sa mga illegal way of getting clients.

    im from CDO and nakalat din yan dito yung nega ways of recruiting people. they say na 40 mins pero in reality 2hrs! one day, they approach one local blogger. he didnt like the moment when he entered their office. kaya ayun he threatened to blog the 'different side' of that insurance ocmpany. different meaning, masamang balak sa pera mo! kaya becareful. di yan magandang hanapbuhay!

  14. I saw their episode sa abscbn and they were reported to the proper govt agency (forgot which one, DTI ata?) and nagkaharap and victim, the managers & lawyer of the company. The money was returned in full to the victim. The govt agency said they'll investigate but its disappointing to know that they're still there, even here in SM Cebu! Why does SM condone this kind of tenant?? They prey on the weaknesses of Filipinos na we all know naman na we as a people are not confrontational and we have that "Sige na nga lang..." attitude.

    Im a former cashier and guys, TAKE NOTE! Want to share a couple of tips about credit cards & credit card machines :
    - Your credit card transaction can still be VOIDED (meaning returned as like your CC was never charged in the first place, as opposed to the 40-60 day wait to credit back the amount to your CC), provided that the credit card machine used to swipe your card has not been SETTLED yet. Establishments/shops usually settle their machines at the end of the day, when theyre about to close. So if its w/in the day, you still have hope! Now, you also need the credit card slip for the transaction to be VOIDED. If the salesperson refuses, like in the situation above, DEMAND & just operate the machine yourself! (Take note this is for dire situations where you are being fooled or scammed already). Anyone who graduated highschool can operate a credit card machine. Just look for the option VOID on the screen and follow the instructions. You need your credit card slip for this bec you need to input the transaction number. When done right, another credit card slip will print out with the vords VOID at the bottom. It will be like your credit card was not charged at all!

    - Your credit card can still be charged if the person has your credit card number as well as your 3-digit verification code. They dont have to swipe your card for this. This is called "manual charging".

    FYI, not a lot of cashiers know about these esp those from dept stores. There is actually a lot you can do w/ a credit card machine.

    Hope these tips will help you out in the future and please, dont abuse this knowledge. :)

  15. I used to work for a credit card company and madami kaming complains nare receive na same case as the letter sender. We call this hard selling. A few advice:
    1) do not give your credit card to anybody unless magbabayad ka na sa binili mo
    2) in case na swipe without your consent, do not sign the transaction receipt. Get your credit card then leave. Credit card co. will charge you but you have charge back rights, meaning pwede mo ipa reverse yung transaction. Mas mabilis yung processing than getting a notice of cancellation na pahirapan kunin at mas matagal ang processing time

  17. Pardon my ignorance but I can't understand how one can be harassed or "bullied" into forcing anyone to make a sales transaction with anybody.
    Why even show or give your credit card to them in the first place? Isn't it that the only time you take out your card is when you are going to make the purchase?
    I can't understand why one can't just walk out the door. Or why one has to even show his card when talking to these sales people?
    I get really annoyed with all these sales people shoving their fliers in the mall. I have had my share of confronting sales people who follow me and make kulit about what their promo is. There was even one time when 2 sales people "cornered" my senior citizen parents into looking at their items and was starting to pressure my folks into buying. Needless to say, I gave them a mouthful and threatened to report them to the mall admin if they continued to pressure my folks into buying anything from them.
    The fact is, they really can't do anything if the other party does not accommodate.

      If this is the way these marketing people are dealing with the mall-goers then they truly deserve a mouthful. I have had encounters with these type of sales bullies and I gave them what I think they wanted at the time--war.

  18. Yes their practice is very wrong. But why on earth would anyone hand over his/her credit card to a stranger when you weren't intending on purchasing anything to begin with? And you allowed the receptionist to write down your credit card number? It's sad what happened to you but we also have to learn how to look out for ourselves. I hope you wrote SM Management and the government agency handling such cases bec. if not, then I doubt they will stop.

    My mother got scammed by an insurance company (forgot which. I'll ask her) without using credit card, ID's, etc. Buti na lang one time nagkataon she called the company, and then someone there tried to confirm a subscription/payment of sorts. My mother was surprised because she didn't do any such thing.

    Sumugod sya doon and puno't dulo, yung mga nasa loob mismo sila magfforge ng signature mo sa documents para makapag-avail ng ibang service na hindi mo naman gusto/kailangan in the first place.

  22. it also happened to me here in Ilo-ilo, good thing after we made a scene inside their office the transaction was cancelled. We are really disappointed that up to this day they still exist and even opened up more branches namely at Robinsons Place Ilo-Ilo...

  23. This is super true. I was super harassed by the Danvil people kahit sinabi ko na I already have an existing insurance and several investments. hello. kung di ko inaway the girl at di ako mej nagtataas ng boses ko sa loob, hindi ako papakawalan. ANNOYING WASTE OF MY TIME!!!

    And no,
    I didn't even get an umbrella. hindi po iyun FREE like how that say na you just have to sign something. they give it to you "free" kapag nag sign up ka.

  24. nako ilang beses na nafeature yan sa tv. family first yan dati. scam talaga yan! siguro kaya hindi mapaalis yan sa sm malls, kasi alam nto naman management ng SM profit lang ang habol. baka aside from rent, may commission din sila. i'm just speculating though. kasi nakakapagtaka na nirerenew pa ng sm ang contract nila eh despite the fact na marami nang nagrereklamo dyan sa danvil/

  25. SM does not own danvil and SEC is the regulatory agency that investigates these so-called marketing practices. I have been a victim of timesharing and I reported and wrote a letter to the SEC. They acted on my letter right away and were fast to resolve my case. I got my money back. To those who have been victimized, file a report. Remember, no complaints, no investigation.

    I learned a valuable lesson from this: THERE IS NO SUCH THING AS EASY MONEY (lotto lang ang easy money ngayon.

  27. I'm surprised Family First is still at SM. About five to six years ago, one agent practically dragged me into the office kasi daw I was carrying a blue bag (their "color of the day"), and that I won something. Since I had two hours to spare, I decided to humor her and see what it was about.

    The agent was trying to convince me to join, saying that if I save a certain amount per month, I'd have several thousands of pesos in a few years. I wasn't convinced, I told her that if I wanted to save, I'd do it on my own terms. She then asked me what I did for a living. I told her I was a student, she then asked what school I attended. She then proceeded to mention the names of famous students from my school who, according to her, were their clients. I still wasn't convinced. I repeatedly told her that I wasn't interested and that I had to go because I had to meet my friends. The agent was very insistent, she even called another agent to try to convince me to sign up with them.

    More than an hour has passed, and every twenty minutes or so they'd announced that someone else has signed for the program and give him/her a round of applause. I had two of my guy friends pick me up from their office because the agent wouldn't let me leave. I finally told her that I had to use the bathroom. Aba! She even accompanied me to the bathroom. Buti na lang one of my guy friends waited for me outside of the rest room and flatly told the agent that we were leaving.

    I don't remember anyone asking me to give them my credit card or the receptionist getting my credit card number though. Maybe they have been more aggressive with their selling. But yes, you should be really careful with the information you give out to strangers/agents.

  29. Nakakalungkot kasi na every "insider" knows what's going on and yet they still support these people and their schemes. Si DR niloko ni PQ pero anong nangyayari hanggang siraan lang during lunches?

    Parang buong Pilipinas ba, masyadong lenient porke "sikat" yung tao. And we wonder why such crimes continue operating?

    May kilala ako galit na galit kay BB pero BFF naman nya yung isang adik adik na draga. Am I naive to ask such a question, or ganun lang talaga? Hangga't mayroon kang mapipiga sa ibang tao, you wouldn't let them go kahit pa alam mong they're rotten inside?

  34. To arci, really? Di ka makakatanggi kung pinuri ka na obvious namang bola lang? That's funny! Parang sabik na sabik na masabihan ng maganda ah!

    Di ko rin maisip bakit di nyo kayang umalis sa office ng Family First/Danvil? May handcuff ba? Wala naman di ba? Minsan di din nakakaawa mga victims nito. Kasi naman mapuri lang or mabola lang ng konti nahuli na agad kiliti. Kahit ba makulit ang agent di ba kayo nakahalata na kung di nirerespect ang wishes nyo binabastos na kayo? Haay... mga tao talaga. Kaya madaming manloloko kasi madaming nagpapaloko.

    But it's good this was posted para naman sa mga di pa nakakaalam ng tactic ng mga yan.

    Nagcomment na ko dito pero nabura eh ang hirap na ulitin. Haba eh. But it's about rude staff members. Di pa ko naloko nito kasi ang cheap ng approach ng mga tao saka nasabihan na ko ng parents ko.

  36. I feel sad for the letter writer but when a stranger starts asking if you have credit card, that's a red flag. I get that all the time and I always reply "if I have a credit card? That's none of your business". They usually go away after that. I only answer that question when I'm at the cashier of a store about to pay something, if the SA asks if I have a credit card then I respond and ask if they have a promo or something.

  37. Isn't it stupid that people actually believes this scam?!?! First of all, why the hell would you show your credit card when you don't intend to make a purchase?? Second, these mother-effin' agents have no right to ask you whether you have a credit card!! I am always in Megamall and when someone approaches me, I instantly say, "Go away" or "You have no right to ask me that question."

    People, you are responsible for your own credit cards, first question pa lang nila if you have a credit card, obvious na obvious na scam na e! Grabe may mga uto-uto pala talaga! tsk tsk tsk

Even a teenager with a supplementary credit card knows you shouldn't/aren't obliged to show your credit card to anyone or worse to sign forms, listen to any pitches that you are absolutely clueless about. We are usually at fault for our own downfall. Mental note nalang next time. Lesson learned.

  41. She wants to share her name so you know that this is true. Better than any of us who just sign anonymous. Don't insult her unless you can say were never duped in your life by anyone. Some people know how to get the vulnerability of people. We Filipinos don't really know how to be that rude to just walk out so we accommodate, to a fault. People will learn from her story.   42. years and years ago...i was also attracted to the "free movie tickets passes" makinig lang sa presentation.. so syempre strategy nila is the more cards you have the more prizes you are entitled to... so ayun na nga... hard sell talaga.. but i stood firm.. so finally pinaghiwalay kami ng bf ko (hubby now.. i finally told the agent miss di talaga kami bibili... then stood up and went to boyfies table.. buti na lang kase he is almost swayed na.. haist! Luckily naman binigyan pa din kami movie tickets hahaha...motto yata nila is never say never.. at commission basis kaya ganun sila kapursigido..

  43. The fact that these companies still operate and employ deceptive marketing tactics show that a lot of people are vulnerable and fall prey to these schemes. This blog post is a good way of informing the public about such scams.

    I suggest that if you ever get harassed by these "insurance agents," get mad and don't be afraid to make a scene. If they try to detain you, threaten them, and say you'll call the police. No one has the right to detain you against your will. If you had the misfortune of being a victim of this scam, file a complaint with the mall, the mayor's office, the SEC and DTI. Lahat lahat na.

Naexperience ko na din to sa SM annex, Prudential Life naman nung una hindi ko alam na insurance na pala yon, nung pag pasok ko sabi ko sa guy na kumakausap sakin i have to leave na kasi may nagiintay pa saken. he said "pumasok ka na dito e, pakinggan mo muna yung iexplain ko." sabi ko aalis na ko, nakipag patintero pa sakin tong guy na to sa asar ko tinulak ko nalang siya para umalis sa harapan ko.

  47. I am an insurance agent and before I let the client sign the papers, I first explain to the client what he is getting into. He din basta-basta ang premium na ibinabayad sa insurance. It's life savings din naman. Legit insurance companies do not do ambush selling to clients. If you are a good agent, you give the client time to read and think about your proposal. hindi yung hinaharass ka to sign the dotted line.

    I wonder if these Danvil people have licenses? You have to be licensed by the Insurance Commission to be able to sell insurance products.

  48. How can you not just walk out? Do they bar the door to keep you from exiting? Why would you be forced to hand over your credit card? Do they threaten violence if you don't?

    Sorry, I agree that the practices of these agents are unscrupulous and unethical, but it's just hard to sympathize with the "victims" when it's you who goes along with them. I guess it's in really in the Filipino culture to avoid conflict so people just give in "para wala nang gulo". The sad thing is, companies take advantage of this behavior.

  49. Having a credit card is a privilege and it comes with responsibility. If you can't be strong enough to control the use of your credit card, you shouldn't have one.

  50. Hahaha. I remember the same scenario happened to me and my best friend sa St. Francis Mall naman. Since lagi akong nasa St. Francis for shopping, I often see these agents na nagtatanong kung may credit card ako. One time, I was with my bff and we decided to fool those agents. They asked if we have credit card and we said yes (we're only 20, ha!) and yun nga may freebies daw.. Then to the point na they were asking if we have the card now (eh, wala naman talaga, debit lang) so we told them debit lang. They were asking too if hindi bababa ng 20,000 yung laman ng debit card namin. We acted like we were VERY adults and we said, "Yes, kaka sweldo lang eh." Then they keep on asking us if we're really 21. The hitch, my bff accidentally said we were only 20! Kainis!

    I think it's best to annoy them and trick them as well. Ganti ganti lang. Hehehehe

  51. to my fellow brethren the reason why these people are so aggressive was because mapapasok ka lang nila sa office nila 500pesos na. Yung agent naman they need you to get a policy para may incentive sila. take note I know someone who worked for them napaaral niya anak niya sa Ateneo na ang work niya eh magpapasok lang ng tao sa office nila.
