    3. It's a personal crime, the network cannot file in behalf of the victims. Put the law on their hands?

    4. Really curious as to what ‘everything’ encompasses. Did you mean filing a criminal case? For acts of lasciviousness, only the victim (or if he/she is a minor, his/her parents or guardian) can file a criminal case against the accused. ABS-CBN has no legal standing to file the case on behalf of Miguel. Terminating the other guy’s contract with them is all that it could do, legally.

    3. 9:42PM, in a criminal case involving sexual abuse, rape, seduction, or acts of lasciviousness, the aggrieved party/victim should be the one to file a complaint against the aggressor at the police station or at the Prosecutor’s Office.

Ang pwede lang gawin ng ABSCBN is to make the aggressor administratively liable like nullfying the career contract/dissolving the career of the agressor.

No employer has the right to character assassinate a former employee maski criminal pa siya. Ang talagang kulang sa ginawa ng abscbn is support sa victims but as to the perpetrator, their hands are tied. Read 8:24's comment.

      Delete
    5. 6:34 character assasination ang ikakaso nung tao pag ginawa nila yan since wala silang evidence kung nangyare man. ang magagawa lang nila is to quietly pull him out sa station nila. and nope 9:14, tinanong nila yung victim kung gusto niya kasuhan siya lang ang may ayaw. so wala na silang magagawa dun.

    7. 10:54 they cannot do that because hindi sila ang nakakita ng acts of lasciviousness.

      Delete
    8. If I remember correctly, acts of lasciviousness is a personal crime.

Rape on the other hand is different. If totoo na may rape na nangyari, the management could have filed on behalf of the victim. But of course if ayaw ng victim (i.e., if she believes it will bring more trauma to her), it would be better for management to stay out of it and support the victim only when she is ready.

      Delete

    10. 10: 57, I am 6:53 and I am NOT 8:46. I am in the legal field and it appears that those who share my view also know the law. Pinapaintindi lang namin. I sympathize with rhys and all victims of sexual crimes but this pitchfork wielding against abscbn is unproductive sa victims and baseless, legally speaking.

Definitely dapat may more support ang abscbn sa victims in terms of counseling and legal fees, but ONLY IF THE VICTIM WANTS TO FILE A LEGAL CASE. Malinaw sa video that abs asked rhys of he wanted to file a case and rhys said no.

Sa tingin ko maraming haters talaga ang abscbn dito, as a long time FP reader kaya hindi niyo na iniintindi ang situation maski ineexplain na nga.

    2. Pano nga magkakaso kung ang victim itself wont file a claim. IF they decide to save their career and drama

      Delete
    3. Hindi nila pwedeng kasuhan kasi hindo naman sila ang proper party to do that. I know abs is a very hated company pero may batas tayong sinusunod.

      Delete
    4. Only the vactim van file the case. No one else. Kahit Company pa na nag employ sa knilang 2 since the company isnt the direct victom. What the company can do is terminate him / his contract since i assume vioaltion yan ng p&p nila or possibly sa contract din if may claude nian sa contract.

  15. Mga tao dito grabe emotions ang pinapairal. The filing of the case should be done by the victim and not the company. For sure this has been discussed internally. There were suggestions or advices from their management and their families were engaged.

It’s not news blackout if you want to protect the privacy of the people involved, especially those who were wronged. If the victims would like to make it public, it is entirely up to them… in their own pace, own time, own ways.

    2. This, 💯! Nakakainis ang daming dunong mag file ng case, akala nila that easy. The victims should file those cases, yung network can only offer support. This guy naman the victim, he could've gathered his witnesses and evidences, then directly filed a case para mas solid yung actions nya, kesa nag live sa muna sa social media acct nya.

    3. 7:22 agree sa unang part but disagree sa second. Maybe rhys doesnt want to file a case. Gusto niya ng mob justice, cancel patrick ganun. Mahirap kasi iprove sa court ang he said she said na kaso. I dont begrudge him if this is the best justice he can get.

So malamang at that time yung Rhys eh hindi ready, pwede mas iniisip ang career kaya ni-let go ang nangyari sa kanya. Or he could just be scared and ayaw ma-judge ng mundo.

How do you violate the victim's wishes why offering support to him again now? ABS statement does show that they care more about their image and sa unang sentence palang binaliktad na agad yung alleged victim. Other PR people would FIRSTLY give a supportive message.

  20. Daming shunga. Mga marites, hindi abs-cbn ang direct victim. So the company cannot file a case on his behalf. The best they could really do is to terminate him. Yung biktima malamang tinanong na 'yan if he wants to file a case and surely ayaw nung victim to avoid any scandal. If he wants to file a case surely kukunin ang mga tao sa ABS to testify. I had a workmate who now works in that network and she said naka-blacklist na eversince yang Quiroz sa any of their agencies at sister companies.

So either way, may consequence ang pag mamake public nito, hindi lang sa mngt. If the victim/s really intend na makakuha ng justice and are mentally lrepared din, they would have filed cases before. Ang kaso e hindi dapat pinipilit ang victims mag file agad or make the issue public since may mental toll yan s knila reliving the trauma. Kaya nga ang iba bwan o taon ang inaabot baka ishare ang story nila or file a case.

Should they have fired patrick?

Should they have blacklisted patrick? Yes, same as above.
