    1. It seems that Ricky Lo is also a tenant of Imperial which is owned by Mother Lily. He just mentioned “US”!

    1. you sound pathetic @ 1.03 can you just stick to the issue?

      Delete
    2. Exactly.

      Delete
    3. and ang rent may contract yun.. kung nag sign sila ng contract for 6 month extension meaning nun umalis man kayo babayaran nyo pa rin yung remaining months or kung ganyang nangyari iresolve nyo yung issue with the owner hindi yung parang nag 123 kayo at di nakipag-usap sa may-ari agad sabay stop payment

    4. 7:04 Di na nga pwede tirhan due to flooding and other inconveniences like sira elevator tapos tatapusin kontrata? Isip isip

  4. So un pala nangyari. Anyway it's d owner who is accountable in d first place not d tenant.

    1. The owner should've insured their unit.Para doon singilin. For valves, pipes leaks etc it is the owner or the building management who is responsible.

Halatang nagmamalaki sila Kisses at Nanay niya.

Major repairs like busted pipes are always the landlord's responsibility.

      Delete
    5. True, ang dapat nagpapaayos si Landlord not the tenant.
I also live in a condo, yung mga repairs c/o the landlord.

  5. Walang tubig, walang elevator. Bakit ako titira pa don. Kaya nga umuupa ka lang. Hindi ikaw ang maintenance

    1. Tama. Void na ang contract nila for not having water and elevator service.

  6. Kahit dito sa abroad, it is the landlord or owner’s responsibility to make the rental property habitable. It’s not the tenant’s fault. Binabash nyo agad ang tao.

    1. I own a lot of units, talagang pag ganyan leaks, pipes etc owners maintenance yan or if not the owner should complain to the building management.Their own engineers would look at the issue and fix it.

      Delete
    2. true owner talaga or management ang reliable regardless of the cost lalo kung di at fault ang tenant. wala ba silang contract na pinirmahan prior to renting the unit? it should be stated in the lease contract kung sino ang liable. some pa nga if the unit is not livable the owner or management provides temporary shelter sa tenant while fixing the problem

      Delete
    3. it's not always the case where landlord shoulders everything. you have to report the incident when it happens. if landlord wasn't informed in the timely manner tenant will be liable for damages.
if the leak wasn't informed to the landlord and caused further damage, landlord can sue. i know so cause it happened to me. landlord sued me cause i didnt report the leak that caused the unit's floor damage resulting in changing the whole flooring of my unit. landlord took me to court. it went through mediation instead and result was i was to pay 50% of the damage.

    4. 1:29 girl applicability of a contract goes both ways. Kung nay sumabog na pipes at di pinaayos ng owner immediately, that could subsequently lead to inhabitable unit. And that is also breach of contract. Which precedes the event of kisses and company leaving the premises. If one party breaches a clause of the contract, the contract is null and void unless specified in the clause. Ganern yun. Mema ka

      Delete
    5. True, the absence of water and elevator voided their contract already.

      Delete
    6. hindi nag communicate yung tao, bigla pa umalis. alam naman ni rap/LT na they need to fix the water if accidental and pag kasira. medyo malabo story nito. meron kulang info ang binigay.

      Delete
    7. @7:49 - na inform ang owner, reason why the parent asked for the 2 balance PDC's, for some reason, hindi naibigay kaya nag request sa bank to stop the payment.

Hindi Bigla umalis, according to Ricky Lo's post, they suffered for several days without water and no elevator, nag bayad pa sila ng lahat ng dues sa bldg at Naglinis sa unit. Now, si Rap kumukontak sa kanila kasi hindi nya na ma encash yung advanced checks. for what reason kailangan nya eh encash yung check, hindi na habitable yung unit nya, bakit nya pa kukunin ang bayad?

      Delete
    8. Anong pinagsasabi mo 6:52? Nabasa mo ba yung lease agreement?

      Delete
    9. Nagusap usap yang nanay ni Kisses and yung unit owner.

    10. Also own several units. If the tenant has been living there for more than a year, it's his/her responsibility for repairs and noticing it and reporting it to the lessor. Nakalagay sa contract yan. Maraming baboy na renters. Both are responsible but sana renter was aware of the problem and had it reported before causing more damage.

      Delete
  7. Ayun so kaya naman pala pina stop paynent kasi di ma natapos ang kontrata. At di naisauli ang 2 remaining post dated checks nila. Anyways, admin will have to decide kung sino ang magshoulder dapat ng nasira.

It is simply calling her and her mother out.

Major repairs like water pipes are the owner's responsibility not the tenant...

    2. Coulnd’t agree more.

      Delete
    5. 2:54 Tama si 10:55. Minsan it pays to research and know how things work muna bago kumuda para hindi kayo napapahiya. Nagbayad yung nanay ni Kisses ng utilities etc so alam yan ng bldg admin and unit owner since sa bldg admin naman usually nagpapareading para magsettle ng bills.

      Delete

Next pano kang naka out ng condo with your own items ng wala kang Clearance sa Admin?!?

      Delete

      Delete
  15. Hmmm, no water and no elevator. Those two facts voided any contract she had with the owner. She has the right to the two advanced cheques because they were already out of whatever contract she had with the owner. She did inform the owner which was reason why she requested a stop payment from the bank when she didn’t get back her two post-dated cheques from the owner. Clear enough.

    ReplyDelete

  18. Well. I understand that they don’t have water because of the broken valve, and I agree that it’s the responsibility of the landlord to fix it, but that didn’t give them the right to just up and move. Also, they should’ve informed the landlord. Ang nangyari, according to Ricky Lo, dahil walang tubig, lumipat sila ng BGC. Breach of contract po yan.

Tapos gusto pang kunin ang bayad for Nov and Dec??? Hello, ang kapal naman nung owner...

      Delete
    2. Breach of contract na yung wlang tubig at elevator. Lol, it's a miscommunication between the unit's owner at admin ng building. Hindi betweeN k at R.

      Delete
  19. It's the tenant's responsibility to get it fixed. The cost of repair will be deducted from their rental or deposit. But Kisses and family ignored it until it got worse, which means they are bad tenants. They didnt even communicate with owner. Tinakasan pa nila.

    1. You can not just “takas” if you are renting a condo. Early Oct sila umalis sa unit, Rap was still able to encash the check dated Oct. Hindi naibalik ang Nov amd Dec pdc so pina-stop payment. Ano mahirap inintindihin dyan?

      Delete
    3. Wrong. It’s the owner ( or landlord’s responbility) kung meron sira sa property.

      Delete
    4. Wrong! Its Landlord responsibility hindi naman yan na nasirang aircon lang na pwede pagawa nila kisses then reimburse sa kanila ng landlord. Water, Gas etc is need to address immediately by the landlord. Kung walang tubig for several days and the place is not liveable the landlord will provide you a shelter/place.

    5. The owner of that unit should've insured the unit against damages like this leak sila at ang building management ang maguusap tungkol sa mga leaks.

      Delete
    6. You know nothing about the law. You are so wrong. The owner is responsible for that kind of damage, he is responsible for the maintenance of the unit and insurance, not the tenant. He is also responsible for the availability of electricity, water and elevator service, etc.

  22. Meron lease or contract na 1 year kahit umalis ka ng less than a year babayaran mo ang renta. Ano ba yan?

    ReplyDelete
    Replies
    1. @1:46 - Umalis sila because the unit is unhabitable, No water and mag hagdan ka hanggang 12th floors at pababa everyday, hindi ka pa ba aalis nun? Basahin mo ulit yung post ni Ricky Lo, nag stay pa sila for several days after the incidents, nagbayad ng dues sa bldg at NAGLINIS.

Carrie, the mother asked to get back the 2 checks, hinayaan na ang October kahit early Oct pa sila umalis. Kanino kukunin ang checks? sa Lessor, so malamang well informed si Rap sa nangyari at hindi "basta basta" umalis yung nag renta.

      Delete
    2. Thanks for explaining well, @3:23. I admit isa ako sa taas na nagsabi na fault nila Kisses na nilayasan nila yung unit pero I understand the situation better now.

      Delete
    3. 323 malamang may security yang building.

      Delete
    4. 3;23, yes, granted na sira nga ang elevator and walang tubig, dapat nakipagusap sila sa condo owner, and yung condo owner ang gagawa ng paraan para maayos. Also, basa basa din ng sinabi ni Ricky Lo, they renewd their contract for another 6mos, that’ll be until December. So, binded sila ng contract, and pag may contract, hindi nila pwedeng bale-walain yun, hence, the breach of contract. Unless, may makukuha sikang new tenant agad agad. Kahit pa sabihin mong binayaran nila lahat ng bills and nilinis nila ang condo, which is their responsibilities as well, dahil kung hindi, sisingilin sila for cleaning and for the utilities tht they used.

      Fyi, not 1:46

      Delete
    5. Wrong. The contract is for a livable unit. No water and no elevator service voided that contract. Gets mo.

      Delete
Ang contract is a 2 way agreement between 2 parties. Landlord provides a livable unit meaning may tubig, kuryente, elevator, etc. Tenant pays rent every month.

As someone who's been a condo tenant for 5 yrs, I am on the Delavin's side here. No elevator, no water means the unit is inhabitable. Before you start yapping about beach of contract on the Delavin's side, please consider that the first breach of contract was on the owner's side when the unit became inhabitable. Laging 2 sides yung contract.

You own the unit, it's your responsibility to maintain and fix it, not your tenants. Reason why it's called rent...

  26. Whether there is a communication issue or not between 2 parties, the responsibility still is the owners, period.

    1. Either mema, or sadyang slow lang talaga. Jusko yung iba dito, kelangan pa yata naka-bullet points lahat simula umpisa para ma-gets kung anong nangyari. Lol.

  28. Naunang nag post on this isssue si Lolit Solis na manager nila Rap Fernandez and Lorna Tolentino defending her clients na owners ng unit. Buti na lang at nag post si Ricky Lo, to know the 2 sides of the story... Anywhere else around the world, it's always the landlord's responsibility to maintain and fix major repairs like busted water pipes and to make sure that his tenants are always happy renting his unit...

Even building management is aware of the issue. Hinihingi ng mga Delavins ang 2 months advance cheque payment nila sa owner, since they moved out already coz the place is not livable anymore. HIndi binalik ni Rap the owner yung mga cheques, dapat lang stop payment na since they moved out of the unit already.

  29. Kahit na anong masira sa rental property or unit kung hindi naman deliberately sinira ng tenants like the water pipe ay responsibilidad ng landlord ipagawa at their own expenses. Kung ayaw ipagawa ng landlord, ang tenants pede nyang i-break ang lease contract sa property and get their deposit and rent money back.

May unsettled bills pa raw from September-October

Anything above or in excess of what has been agreed on, say PhP5k, Landlord ang may sagot.
