Major repairs like busted pipes are always the landlord's responsibility. Mabait pa din ang mga Delavins at nag bayad sila ng full month for Oct, bayad ang condo dues at iniwan ng maayos at malinis yung unit.

    1. I own a lot of units,talagang pag ganyan leaks,pipes etc owners maintenance yan or if not the owner should complain to the building management.Their own engineers would look at the issue and fix it.

    2. true owner talaga or management ang reliable regardless of the cost lalo kung di at fault ang tenant. wala ba silang contract na pinirmahan prior to renting the unit? it should be stated in the lease contract kung sino ang liable. some pa nga if the unit is not livable the owner or management provides temporary shelter sa tenant while fixing the problem

    3. it's not always the case where landlord shoulders everything. you have to report the incident when it happens. if landlord wasn't informed in the timely manner tenant will be liable for damages.
      if the leak wasn't informed to the landlord and caused further damage, landlord can sue. i know so cause it happened to me. landlord sued me cause i didnt report the leak that caused the unit's floor damage resulting in changing the whole flooring of my unit. landlord took me to court. it went through mediation instead and result was i was to pay 50% of the damage.

    4. 1:29 girl applicability of a contract goes both ways. Kung nay sumabog na pipes at di pinaayos ng owner immediately, that could subsequently lead to inhabitable unit. And that is also breach of contract. Which precedes the event of kisses and company leaving the premises.       Hindi Bigla umalis, according to Ricky Lo's post, they suffered for several days without water and no elevator, nag bayad pa sila ng lahat ng dues sa bldg at Naglinis sa unit. Now, si Rap kumukontak sa kanila kasi hindi nya na ma encash yung advanced checks. for what reason kailangan nya eh encash yung check, hindi na habitable yung unit nya, bakit nya pa kukunin ang bayad?

    10. Also own several units. If the tenant has been living there for more than a year, it's his/her responsibility for repairs and noticing it and reporting it to the lessor. Nakalagay sa contract yan. Maraming baboy na renters. Both are responsible but sana renter was aware of the problem and had it reported before causing more damage.

    1. Hello, kung ganyan pala ang problema dapat ang admin ang building ang mag iinform sa may ari ng unit na may nasira. Di yan trabaho ng nagrerenta kasi buong building nman pala ang may nasira. Iisipin ng nagrent na nainform na amg may ari. Yes, nagrerent ako kaya alam ko pinagsasabi ko. Lol, kung di man sinagot, sino ba gusto makipag.usap sa tenant na naperwisyo at ke mahal mahal ng bayad eh di nman maganda amg serbisyo. Kulang pa sa kumonikasyon ang admin ng building at mga may.ari.

    1. Baks dapat sa ganyan, unang una tawagan ng nagrerenta ang maintenance ng building o admin kung may Office sila kasi sila dapat ang aayos sa ganyang problema. Pangalawa ang admin o maintenance dapat ang tatawag sa may ari na may nangyari sa unit nya. Ganun dapat. Ewan ko lang kung ganyan din sa Pinas.

  15. Hmmm, no water and no elevator. Those two facts voided any contract she had with the owner. She has the right to the two advanced cheques because they were already out of whatever contract she had with the owner. She did inform the owner which was reason why she requested a stop payment from the bank when she didn’t get back her two post-dated cheques from the owner. Clear enough.

I understand that they don’t have water because of the broken valve, and I agree that it’s the responsibility of the landlord to fix it, but that didn’t give them the right to just up and move. Also, they should’ve informed the landlord. Ang nangyari, according to Ricky Lo, dahil walang tubig, lumipat sila ng BGC. May contract ang Delavins, and hindi po ito sapat dahilan para ipastop ang PDC. Breach of contract po yan. Sana nakipagusap kayo ng maayos. Lahat naman nadaan sa maayos na paguusap.

Early October pa lang nung nawalan na ng tubig at hindi na gumana ang lift, umalis na yung mga tenants, kung tutuusin lugi pa sila Kisses dahil buong buwan ng Oct, nag bayad sila, maski, wala na sila doon.     2. Breach of contract na yung wlang tubig at elevator. Baka ininform na nila ang admin ng building na may sira bago lumipat. Amg admin na dapat mag inform sa may ari kung anong nangyari sa unit at lumipat ang nagrent kasi wlang tubig. Sino ba nman kasi magstatay kung di ka nakakaligo at wlang elev ang mahal pa ng bayad.   19. It's the tenant's responsibility to get it fixed. The cost of repair will be deducted from their rental or deposit. But Kisses and family ignored it until it got worse, which means they are bad tenants. They didnt even communicate with owner. Tinakasan pa nila.

    1. You can not just “takas” if you are renting a condo. Early Oct sila umalis sa unit, Rap was still able to encash the check dated Oct. Hindi naibalik ang Nov amd Dec pdc so pina-stop payment. Ano mahirap inintindihin dyan? Plus the fact na sinettle ng nanay ni Kisses ang bills per Ricky’s article, saan mo napulot na tinakasan nila ang unit owner?🙄

Water, Gas etc is need to address immediately by the landlord. Kung walang tubig for several days and the place is not liveable the landlord will provide you a shelter/place.

  22. Meron lease or contract na 1 year kahit umalis ka ng less than a year babayaran mo ang renta. At kailangan ang nag rent or umuupa ipinapa alam sa may ari ang problema. Hindi yung basta basta ka na lang aalis. Akala ko mayaman at edukado dapat alam ang kalakaran sa mga ganitong klase na transaction. Ano ba yan?

    1. @1:46 - Umalis sila because the unit is unhabitable, No water and mag hagdan ka hanggang 12th floors at pababa everyday, hindi ka pa ba aalis nun? Basahin mo ulit yung post ni Ricky Lo, nag stay pa sila for several days after the incidents, nagbayad ng dues sa bldg at NAGLINIS.

      Carrie, the mother asked to get back the 2 checks, hinayaan na ang October kahit early Oct pa sila umalis. Kanino kukunin ang checks? sa Lessor, so malamang well informed si Rap sa nangyari at hindi "basta basta" umalis yung nag renta.

Landlord provides a livable unit meaning may tubig, kuryente, elevator, etc. Tenant pays rent every month. Kung yung livable unit hindi naibigay ni landlord, si landlord ang nauna magkaroon ng breach of contract.

As someone who's been a condo tenant for 5 yrs, I am on the Delavin's side here. No elevator, no water means the unit is inhabitable. Before you start yapping about beach of contract on the Delavin's side, please consider that the first breach of contract was on the owner's side when the unit became inhabitable. Laging 2 sides yung contract. Di puedeng yung tenants lang ang susunod sa contract.

  23. Naku Rap, huwag kang mag pa rent ng unit mo kung ayaw mong mag labas ng pera para sa maintenance at major repairs nito. You own the unit, it's your responsibility to maintain and fix it, not your tenants. Reason why it's called rent...

Mali ba na gusto niyang kausapin ang tenant para alamin kung ano ang nangyari? Karapatan niya yun. Palibhasa wala siguro kayong property na pinapa rent kaya hindi niyo maintindihan.

  24. Grabe naman nag aral ba sila ng property management. I fix nya within couple of days dapat pag me water leaks. Pwedeng magkaroon black molds yan health issues not just legal matters. Alert ka din dapat sa mga properties mo di puro sahod lang.

Di ginamit nila kisses pero na encash agad ni rap tapos ngayon magagalit at maghahabol dahil pina stop payment yung naunang binayad! Sus. Magpaparent ka dapat sagot mo ang maintenance at repair. Di naman nagagalaw ng tenant ang valve. Tabi ng water meter labas ng unit yun pero part ng unit na binili ni rap kaya di yun sagot ng tenant

  28. Naunang nag post on this isssue si Lolit Solis na manager nila Rap Fernandez and Lorna Tolentino defending her clients na owners ng unit. Buti na lang at nag post si Ricky Lo, to know the 2 sides of the story... Lakas ng loob ni Rap mag demand ng 2 months payment sa mga Delavins, hindi na livable yung unit niya. Sobrang abala na sa mga tenants niya. Anywhere else around the world, it's always the landlord's responsibility to maintain and fix major repairs like busted water pipes and to make sure that his tenants are always happy renting his unit...

    2. 4:31, for sure sinabi ng tenant ang problema sa landlord, alangan naman hindi, since bayad sila. Even building management is aware of the issue. Hinihingi ng mga Delavins ang 2 months advance cheque payment nila sa owner, since they moved out already coz the place is not livable anymore. HIndi binalik ni Rap the owner yung mga cheques, dapat lang stop payment na since they moved out of the unit already.

  29. Kahit na anong masira sa rental property or unit kung hindi naman deliberately sinira ng tenants like the water pipe ay responsibilidad ng landlord ipagawa at their own expenses. Kung ayaw ipagawa ng landlord, ang tenants pede nyang i-break ang lease contract sa property and get their deposit and rent money back. Kami nga dito sa inuupahan namin biglang nasira ang fridge. Ayun pinalitan ng bago ng landlord namin. Biglang ayaw din mag-start ng clothes dryer, ayun pinagawa ng landlord namin. Kasi ang tenants nagbabayad ng mahal na rent. Kaya dapat lang ang landlord make sure na livable ang property nila and gumagana ng maayos ang mga appliances like washer and dryer, fridge and stove/oven.

  31. Sa Tenancy Agreement, ay cap ang repair costs. Anything above or in excess of what has been agreed on, say PhP5k, Landlord ang may sagot. Pag may inconvenience na ganyan lalo pa sa side ng Landlord e may right ang Tenant na umalis without penalty. At kung sa side naman ng Tenant, may right ang Landlord na paalisin ang Tenants at di na isauli ang deposit.
