  1. Nakagency raw yung driver. So kung may prob sa bayaran, it's between driver and agency. Kung hindi nagbigay ng tamang bayad yung bea's camp sa agency for the driver, eh di sana yung agency ang naghabol kay bea.

    2. nope. in case of non-payment of benefits, bea and the agency are solidarily liable sa driver.

    7. nope @2:43. lahat ng kumukuha sa agency ay may undertaking or solidary liability agreement na in case of non-payment of benefits, solidarily liable sila. kumbaga, hindi pede ma-agrabyado ang employee sa pagtuturuan ng agency and contractor kung sino ang magbabayd, bwak bwak bwak @ 2:43

It just means that the driver CAN go after bea for unpaid benefots EVEN IF nagbayad si bea sa agency. Bea can then sue the agency after. Huwag masyadong defensive agad.

    10. Whatever wealth B has come into, she worked for it. And because of that wealth, she has the resources to fight this legal harassment. The GF sued B in behalf of the driver. Problem is - B is not his employer, agency yun. Between his agency and the driver ang responsibility. Pero yung legal responsibility talaga, between maid and agency yun, not you as the client ng agency. So nao ang standing ng GF at she sued B? Kaloka. Harassment lang yan.

    7. 1:16 not B's responsibility. The driver was supplied by a driving agency. Payment for the contract was secured by the agency. So bayad sila B sa agency. 32. We got our company driver supplied through an agency. May rotation sila kasi 3 drivers sa company namin for our CEO then on call sa staff yung dalawa. The company pays them directly. The CEO's driver na assigned sa amin for the duration of the contract na, yung dalawa naman, rotate kung sino assigned ny driver agency kada week. Our company paid the agency in advance for the 2 year contract. Therefore, lahat ng benefits, pay and employment conditions ay responsibility ng agency not our company.

In the same way, the 3-month driver ni B ay sole responsibility ng driving agency, not B or her camp. Anong kalokohan to?

    ReplyDelete
    Replies
    1. 2:33 Bea can implead the agency if matuloy na makasuhan siya or she can sue the agency for reimbursement after paying. Solidary liability just means the employee can go after either or both of them but the solidary debtors can settle still among themselves.

BUT I don't believe na entitled pa sa benefits na hinihingi yung driver unless may contract talaga. Walang overtime pay at night shift differential ang drivers under the law.

      Delete
    2. 3:46 the contract is between the driver and the agency, not bea and the driver so Bea is not involved in any contract with the driver. Besides, its not the driver that sued, it's his gf. Does this make sense? Nuisance lang, wasting resources lang. Parang to slander lang ang purpose.

      Delete
    3. I'm not defending the driver. And definitely the GF has no standing to file a case in behalf of the driver.

I'm just commenting on the nature of solidary liability under the labor laws. Contrary to what most commenters here think, hindi siya unfair. It's for the employee's protection kasi, precisely because he is not privy to the dealings between the principal employer and the agency. You said it yourself that bea is dealing with the agency. That's why the labor law imposes solidary liability on the agency and the principal employer. And then the principal employer (bea) can sue the agency. Solidary debtors can sue each other. Walang problema dyan. But first, the law protects the employee. That's the law.

Procedurally, it would be correct for the driver (NOT THE GF) to file a case against either or both bea and the agency. But as to the merits of the case, ibang usapan na yun.

    6. 7:01 solidary argument aside, the case has no foundation. It is akin to filibustering. The contract is between the driver and the agency. B's camp is a client of the agency, the agency being a service provider. The driver is the employee of the agency , an instrument to the agency's provision of that service. In fact, because of the behavior of the driver and his instigating GF, this is more akin to harassment. Why involve B? The client in the first place is her brother, not her.
