Tito Sotto Cites International Rule on Copyright Claims on Eat Bulaga

  2. So why didn't they have it registered as theirs many decades back? TAPE enjoys the EB Brand noon pa, ngayong year lang nagfile sina TVJ and APT ng claim sa IPO. So, bahala si IPO hanggang sa umakyat na sa higher courts.
    The hosts are considered as TAPE's "talents," when the show began in the late 70s, parang "creative contribution" din nila yang Eat Bulaga name for the noontime show.

    1. I think because of trust. They never thought magkakaganito kasi nga gentleman’s word sila since then. Malay ba nila na itong mga batang jalosjos na tinuring daw silang pamilya eh gusto sila paretire unti unti. Paganda pa ng words ang magka kapatid eh ayun lang ang point matanda na sila mr t, tvj time to exit na kasi ang kabataan don’t like 80s style and yung style ng fun ng tvj. Also ayaw magpagamit ng tvj sa political marketing na gusto ng jalosjos sa kasambahay party list na gagawin nila.

    2. kase noon si Tuviera lang ang kausap nila at hindi derecho sa mga Jalosjos na yan. At palagi nilang sinasabi na pagdating kay Tuviera, word of honor lang ang pinanghahawakan nila, walang gulangan ika nga kaya wala silang naging problema sa mga cooyrights na yan. Kaso pinag retire bigla si Tuviera para maisahan ng mga Jalosjos ang TVJ.

    5. Hindi naman talaga ang registration ang final say para madetermine kung sino ang owner ng isang trademark or trade name. Ang registration ay para siyang evidence na ikaw ang owner pero kapag may ibang taong pumalag ay pwede nila i-contest ang ownership mo. Ang totoong owner talaga ng isang trademark ay yung may actual use, o siyang gumagamit talaga sa trademark na yun. So, sa kaso nato mas may laban sina TVJ.

      At isa pa, ang pagkakaalam ko ang na register ng TAPE ay ang merchandise related to EB pero hindi nila ni register yung for live shows. Ngayon kamakailan lang, nagapply for registration sina TVJ para sa live shows. Ang problema nila is if naunahan sila ng TAPE na magregister para sa live shows, ang pinapaboran kasi ay yung earlier filing date.

      If example nauna ngang magapply ang TAPE for registration for live shows, pwede pa rin magfile ng opposition sina TVJ dahil pwede silang madamage sa gagawing registration ng TAPE kasi yun nga, sila TVJ ang may actual use ng EB na trademark.

      if TVJ are the "creators" of EB, they should register the name of the show and have it trademark back in 1979.

      TVJ also should have become "producers" of the show itself (not allowing other people to produce the show for them)

      TVJ recognized Mr. Tuivera as the owner of TAPE, cause he is a stock holder, but he is not the owner - konti lang ang share niya, it was Jalosjos who owns it.

      Accdg to Corporate Lawyers,
      TAPE registered has its registered, trademark and copyright the title and the format of the show -- and they have been producing Eat Bulaga for the longest time.

      Ang magiging labas niyan - contributor ang TVJ, pero hindi sila ang owner.

    7. Eh kse nga tumanda na sila sa eb na matataas ang respeto nila sa isat isa nila me T. Wla nga silang contract. Alam na alam din naman ng mga jalosjos kong sino nag create bago pa sila napunta nung 1981 eh may EB na. Sadyang makapal lang fez ng mga jalosjos na angkinin yung hinde naman kanila. Ibalik nila ang eat bulaga sa tvj at gumawa sila ng sarili nilang show

Kahit naman before na active pa si Mr. T, if i remember it right, vic or joey mentioned na wala silang individual contract per se kasi tiwala sila sa relasyon nila sa show. Hindi nila expected na magiging magulo kapag pumasok na yung mga mas batang tao ng management

      they worked as a host for 44 years, kung sila talaga ang "may-ari" -- noon pa dapat pumalag na sila. ( hindi nila pina-abot ng 44 years to file for a registration )

      mahihirapan talaga sila, kase hindi rin sila ang producers ng show -- Jalosjos has been producing the show for the several decades now.

    13. 12:27 am, negosyo yan, para makilala ang negosyo i-papa-trademark or rehistro nila yan para yon makilala sa panahon na magbabayad na ng Tax sa goberyno.

      Mga Jalosjos ang nag-pa-trade mark sa Eat Bulaga, sila rin ang nag-babayad ng Tax sa goberyno, at sila rin ang nagpapa sweldo sa mga empleyado, sila rin ang nagbabayad ng mga papremyo sa mga contestant nila at naging producer ng show sa mahabang panahon.

      Eat Bulaga is an entertainment business. By law the noontimeshow provides entertainment, accepts and receives commercials and has to pay government Taxes and has to pay their employees.

      you cannot own a "name" of a business that generates an income but you are "not" the one paying for the corporate taxes to the government.

      Hindi pwede yon Tito Sen.

    14. As long as Tito, Vic and Joey are not paying the government taxes for Eat Bulaga and failed to register it under their name, they are not the owners.

      a person needs to register the name of his business, pay for government taxes and invest money on the business

      Tito, Vic and Joey failed to register the name of EB, did not pay the government taxes, did not put out any money for the show -- in short, they are regular employees.

    15. 12:44 Noong 1979 po yung producer ng Eat Bulaga is Production Specialists na pagmamay-ari ni Jalosjos. I think a quick google search would show you that. Makikita sa history ng Eat Bulaga na it was Jalosjos, through Tuviera na kanyang employee noon, who offered TVJ to host a noontime show na iproproduce nila. May feature article ata nito somewhere. I do not understand why Tito Sen would deliberately left that information out sa kanyang interviews. From the very start, Jalosjos was the one who produced Eat Bulaga and they were hired as talents. Noong 1980 nalugi ang Production Specialists. But in 1981 nagkaroon ng TAPE. Binayaran ng TAPE yung utang ng Eat Bulaga at ito yung nagpatuloy na iproduce yung show. In short, nag take over yung TAPE. Binigyan ng share ni Jalosjos si Tuviera sa TAPE dahil sa efforts nito for Eat Bulaga. If may creative contributions ang TVJ sa show as talents, it does not mean they own the trademark na na ginagamit ng company for the longest time. This is not undermining yung sacrifices ng TVJ for Eat Bulaga and yung contributions nila. Pero halimbawa if isa sa mga hosts ng Its Showtime pala ang nakaisip ng name ng program, does it follow na sya nagmamay-ari ng trademark na It’s Showtime? If binayaran ka ng isang company at yung work mo ay magcontribute ng ideas na pwedeng gamitin nito, if umalis ka sa company, pwede mo ba alisin sa company ang karapatan gamitin yung creative
      contributions mo for the company? Ang concept ng copyright po ay iba sa trademark. And no I am not from the Jalosjos family.

    16. There's such a thing as business at the speed of trust. Pero they should have protected themselves by buying majority of the shares, lalo na at hindi nila kabisado ang new gen ng mga Jalosjos. 4 decades of "trusting" does not quite cut it, obviously.

    17. 6:00 am, tama ka. Kung "love" talaga ng TVJ ang Eat Bulaga, they should bought majority of Eat Bulaga stocks and shares, hindi upfront employees lang as TV hosts. They should go behind the camera and become the main man of EB.

      hindi sana mga Jalosjos ang may-ari ngayon.

      Tito Sen left our huge information to the public. From the start nandyan na ang mga Jalosjos -- it was Production Specialist as producers -- he changed the name into TAPE by 1981 and paid all their debts to the hosts.

      Jalosjos hired Mr. Tuviera as his "wing man" for the show, and Mr. Tuviera looked for hosts and hired TVJ.

    2. dati kasi di sila open na sabihin Jalosjos ang may-ari kasi bad reputation.. nakasanayan na nila si tuviera nakalimutan na iba may-ari… pareho lang yan sila mga tuso… dapat mag retire na sila lalo si joey at tito kasi wala naman na silang dating sa tao… ang tagal na hila lang sila ni Vic Sotto

  5. This is wrong. The general rule is that the creator is the owner, except if there is a contract that provides otherwise. Case in point- Kris Aquino’s iconic “kris” handwriting that was used in kris tv and all her merchandise. It’s her handwriting, her own creation, but, it was patented by ABS-CBN, hence, the copyright issue at the time Love You, Hater was shown. Another- a book commissioned by A, from a ghost writer B. It’s B’s creation, but ownership belongs to A.

    Titles, names, short phrases, and slogans are not protected by copyright law. Similarly, it is clear that copyright law does not protect simple product lettering or coloring, or the mere listing of product ingredients or contents.

      the "names or phrases" which are used in business entities as a "trademark" for a business identity to generate income is protected by copyright.

      For example,

      I will put up a food chain business, and i will call it "Jollibee" -- sympre kakasuhan ako ng original "owner" ng Jollibee".

      or

      i will start putting up a film production company, I will call it Viva Films or Star Cinema -- i'm sure ---hahabulin ako ni Vic Rosario or Lopez Family or Mr. Katigbak.

    at bakit hindi sila nag-producers ng Eat Bulaga -- at bakit hinayaan nila na iba ang mag-produce?

    gusto nila ipag-laban ang noontime show -- pero ayaw mag-labas ng sariling pera to run the show?

    1. Correct. Hindi nila inakala na darating ang araw na ito. If they want to own it, then they should've produce it by themselves. Masakit man aminin pero empleyado sila na pinapasweldo. Hindi sila ang may ari ng kumpanya.

    2. 12:18 i agree na dapat matagal na nila inayos yung mga kontrata and ownership rights, pero bakit kailangan nilang maglabas ng sariling pera to run the show. Just FYI, pwede kang maging producer without being a financer. The money can come from investors not the producers personal cash. Many longrunning successful shows sa US, binibigyan nila ng honorary producer credit yung lead actor because that person is very important to the success of the show. Hindi ibig sabihin na yung talent ang kailangan magbayad, kaloka

  11. Im surprised na sa tinagal tagal nila na nag show and with all the original concepts, name of show na idea nila tvj, hindi nila naisip ipa copyright? With Tito Sotto na sobrang tagal sa government, hindi niya naisip yan batas na yan para ma secure nila? Obviously, wala talaga masyado alam sa laws. Ngayon na lang na may problema na sila at may mga abogado na nag eexplain .

  13. I’m not in the Philippines but typically, registration results in a presumption of ownership, which is rebuttable. It does not preclude a dispute. Is that not the case in the Philippines?

    1. Yes. That is the case in the Phils. for trademark. TVJ can still contest the registration because they are the ones actually using the trademark.

  14. Anong source nya? This is not in scope of any International or global copyrights law. Eat bulaga is a domestic/local show so the copyright law that applies is domestic.

    1. Correct. Pinipilit ni Solon kuno na creators daw per int'l law, eh from what I know, even int'l brands here have to be registered locally.
      Also, since EB Began, Production Specialists, Inc. (which later on became TAPE, Inc) produced the show. Late 70s (Production Specialists) then 1981 (TAPE). Jalosjos owns these companies.
      They produced EB.

    2. Sa totoo lang hindi copyright law ang applicable dito kundi trademark. Magkaiba ang copyright sa trademark. Dapat hindi na lang magsalita si tito sen baka kasi makahanap ng defense ang TAPE.

  16. ung mga segments gusto rin nila angkinin na kesyo copyright ng writer, eh diba employed lng din nman ang writer ng TAPE or ng isang company, and sa corporate usually ung trabaho ng mga tao nito is owned by company kasi nga ginawa mo bilang employee ung trabaho habang employed ka at pinapasweldo ka nila, so nde dapat pede angkinin ng writer ang mga segments na nagawa nya nung mga panahong under sya ng TAPE management.

  21. Pagbali-baligtarin mo man, TAPE Inc owns the Eat Bulaga logo, 'Eat Bulaga' and 'EB' kasi sakanila naka register sa IPO. Regardless sino ang nag create, i doubt if may kasunduan or nasa papel/contract niyo yan.

    May 27 lang kayo nag file ng registration (check IPO's website) so mlamang ahead of that, may namumuo nang tension between TVJ and TAPE Inc.

    Pero yun nga, TAPE Inc. owns Eat Bulaga logo, 'Eat Bulaga' and 'EB'

  24. Bigla dami na naman law experts dito. Based dun sa interview nun CEO ang gusto nila may kapalit ang tvj kapag nag retire daw. At kung nalulugi bakit pa nila pinatagal ng 44yrs. Sana nun nag silver anniv ang EB pinatigil na nila. Kaso nakinabang din sila while TitoSen was in senate. Kailangan protection ng older Jalosjos while in prison. Ngayon gusto nila bigla agad magretire. Sana noon pa meron maganda retirement plans ang mga workers baka na grab na nila noon pa

Feeling ko mas nagkaroon pa cguro ng chance na maayos ang problema ng TVJ at TAPE kung hindi sya nagpainterview ng nagpainterview at pinagkalat problema ng EB. Now that umalis na ang EB, sana tumahimik na c Tito Sotto at wag ipagsabi mga pinaplano nila especially kung legal matter na pinaguusapan. Don't let your enemy find out your next move. Kya mas gusto ko c Vic Sotto sa kanilang tatlo eh tahimik lng. C Joey din mahilig magparinig.
