FB Scoop: Bag Seller's Statement Regarding Selling Fake Hermes Bags

Boutique Owner Sued for Fake Hermes Bags


AN owner of a boutique was charged before the Quezon City Regional Trial Court for selling fake Hermes bags worth over P8 million to one of her customers.
    
Charged with estafa was Kristine Marjorie dela Cruz, proprietor of Penderie Boutique located at Building 11, groundfloor 101, 18 Sct. Tuazon corner Sct. Castor, Bgy. Laging Handa, QC.
    
The filing of the case was based on the recommendation of Assistant City Prosecutor Ralph Michael Cataquiz after finding probable cause to indict her in court.
    
But in his seven-page resolution, Cataquiz dismissed the case of Dela Cruz’s co-respondents Valentin Santos, Francis Nikka Arizala, Juan Paolo Serrano and Maersk Ronquillo, as they had nothing to do with the transactions.
    
The case stemmed from the complaints of Yolande Sze who claimed that out of the 16 Hermes Birkin bags she purchased from Dela Cruz on several occasions, only two worth P1,480,000 were authentic.
    
Sze narrated that sometime in October 2012, one of her friends told her that he had chanced upon the respondent’s boutique that offers for sale of brand new designer bags.
    
She said she and her sister went to the said boutique where they met Dela Cruz who assured them of the genuineness of the high-end Hermes bags.
    
The respondent further assured her that the bags she was selling were from “main supplier,” who according to her  “belongs to upper class of the society enjoying superior economic status.”
    
Because of said representations, Sze was induced to buy her first Hermes Birkin bag in November 2012.
    
The complainant and Dela Cruz made an arrangement wherein the latter would email the pictures to Sze her items for sale.
    
Sze then would give her checks payable to Dela Cruz, to the boutique or pay to cash, whenever she would buy the bags.
    
The buyer-seller relationship between the complainant and the respondent continues until sometime in the early part of third quarter of 2013. In all of those transactions, Sze was able to buy 16 pieces of Hermes Birkin bags with total amount of P9,140,000.
    
The complainant added that during those transactions, Dela Cruz never issued receipts to her as proof of the purchase.
    
But in July 2013, a friend of the complainant noticed the bag she was carrying have some signs of being fake which prompted her to consult several bag experts.
    
She was also forced to seek opinion from Hermes France wherein the latter had confirmed that 14 of the 16 bags she purchased from Dela Cruz were fake.
    
In their joint counter-affidavit, Dela Cruz and her co-respondents denied the allegations, saying it is impossible for the complainant to have purchased those bags from the boutique because during such time, the corporation did not exist.
    
Prosecutor Cataquiz, however, ruled that Dela Cruz defrauded complainant by delivering her the subject 14 fake Hermes bags to her prejudice in the amount of P8,595,000.

  3. Why would she even buy Hermes bags from a non-Hermes store in the first place? She can afford to buy naman, why not sa Hermes store na lang siya total may branch naman in Makati.

    2. FYI You can buy LV bags in South Korea minus taxes and other charges, which are cheaper than here. Kaya sya nagiging discounted price lalo na kpag in bulk ka bibili. Had a friend who got a huge deal in LV sa South Korea at binenta nya un sa mga classmates nya sa AIM. My friend also used dollars na nabili nya nuon pa kaya in a way nakamura sya

  9. Oh my! Actually their store is a little shady na nga if you see it and they're selling luxurious bags. Hirap talaga pag online ang binibilhan mo. Isa pa yang Marga Canon na yan nagbebenta din yan ng fake bags. Pag nagreklamo ka sasabhan ka na matagal na sya sa industry ng online shopping. Please let this be a lesson to everyone who is buying from online selling. Buy from the store if you want their bag. Always remember to go for the QUALITY.

    6. There's nothing wrong in buying online as low ng as you that the seller is legit and only sells authentic items. U wanted quality, and a sense of luxury, u really would opt to buy these brands. But at the same time u would want the affordability in buying these luxury. To be honest between a P46k LV speedy mono that's brand new over a P20k of the same brand and style, preowned but almost new, I'd go for the preowned one. No one can really tell that I'm buying a 2nd hand luxury other than me. U just have to be cautious and research on the credibility of the seller

  11. If there were payments made thru checks at nakalagay ung name nya then that is enough proof for a transaction that took place. Kung hindi totoo ang sinasabi ni customer, why go all the trouble to ruin your owner's reputation? Hiring lawyers costs money dear, so why all the fuss? If your owner can prove malice behind such claim then may laban ka, otherwise the court will side with SZE, you better explain why there are encashments for such amounts as well. And to SZE you need to prove transaction has been made, cctv footage, bank deposits or even messages over text. Mareretrieve pa ng network mo yun. Trust me if you have the money to pay for bags then you also have money to get these or better yet get the store's attendants as witnesses. You can strong arm them in giving you a testimony, you can't bribe them but you can find a legal avenue to make them squeal.

    1. Magresearch ka nga tungkol sa Hermes bags dear! Its one of the most coveted bags. Pag sa store ka bibili, hindi lahat ng klase available on the spot. Mas mahal pa nga ang presyo ng bag sa mga Resellers compare sa Hermes store, pero bumibili pa din sila sa resellers, its because wala silang makuhang stock sa stores. Laging out of stock. PAg sa resellers sila, andyan na kagad yung stocks. Imagine, hindi naman mga tanga yang mga yan para magbayad ng mas mahal pa kung may makukuhaan silang mas mura sa stores.

    1. Actually Ate, there are times mas mahal pa nga sa mga RESELLERS. They put premium sa mga hard to find colors and leathers dahil out of stock ang store. Research research muna bago magcomment.

  18. Kung gusto mo talaga ng Hermes purses or LV at can afford ka nman why buy at a fly by night kind of boutique? May official website nman ang Hermes or punta ka ng US, Japan, France, Norway, Switzerland etc nakapasyal ka pa at tyak na authentic ang bag na mabibili mo. Kung nghihinayang ka sa plane ticket at accommodation eh di sa pinas ka na Lang bumili di ba meron Hermes store sa Greenbelt 3.

Reading all this comments...alam ko na agad kung sinong b at nagmamarunong at walang pambili ng auth branded bags...but luckily, most of the comments have knowledge and belongs to upper class...at sa mga epal, wag kayo magcomment na dapat sa Hermes greenbelt na lang sya bumili....wala kayo naitulong at hanggang ecobag lang kayo....   35. Totoong mandurugas yang si Kristine Marjorie Dela Cruz aka "Tin" "Marj" Kristine Marjorie Uy. Alam niya binebenta niya fake talaga. OO may bentang orig yan Penderie pero nagbebenta rin talaga sila ng fake. Mismong kamag anak eh binentahan niya ng fake kahit na aware na siya na fake ang mga bags. Bukod jan sa pagbebenta ng fake eh nang estafa narin yan.
