Rxandy Capinpin's Official Statement

I always say to my students: To have a proper portfolio, you need to get a professional model. To get a professional model, you need to pay them up.

I love my job, as a fashion photographer and an instructor, it allows me to push my creativity beyond its limit, realize concepts no matter how unconventional other may deem them to be and above all it gave me an opportunity to meet amazing people who shares the same passion.

It is thru my job that i met Jeremy in a collaboration shoot we did a year ago. Through handler Chiqui Gil, Jeremy was invited to join the team, and he agreed to join the shoot.

Fashion people knows the concept of a collaboration shoot… the entire team -- consisting of models, stylists, makeup artist, photographer, and hairstylists -- organized a collaboration shoot primarily for their portfolio and secondary for submission to magazines or newspaper for publication.

Our photo shoot with Jeremy and other models was submitted to a major daily in time for the opening of the school year since our peg was Back-to-School fashion. But there were other editorials that were lined up during the weeks of June 2013 so our editorial was pushed back every week until it was already July. That was the reason why we had to wait for the opening of a new school year to push for our editorials publishing.

As per policy, publications issue payments to the team members of an editorial in the form of a personal check only after the pictures are published. That is why I, together with everyone involved in the shoot, have not received any amount for the said shoot (PAYMENT AFTER ONE MONTH OF RELEASE OF EDITORIAL).

Jeremy has been calling and texting me for his tf for the said project. Though I am not obliged to pay him, I took it upon myself to give him his expected amount.

Time went by, text messages were exchanged, calls were made, entertained and others were missed… until May 16 when posted on his FB account about the matter. It was an unfortunate exchange of explanations, string of emotions and equally strong words, most of which i regret that i even posted, for they were lapse of judgement on my part during those specific moments that i felt misunderstood, attacked and judged, specially by people who doesn't even know how the story came into being.

I can go on and on explaining my side of the story, and people can continue to give their opinions and worst ridicule, but my heart and spirit are broken because at the end of the day this is where i end up in my intention of the task of paying up Jeremy his tf even if none of us involved in the shoot has received a single cent

I have no motive in ignoring or hiding from Jeremy, as what most people perceived it to be and made it appear to be because, let us put the record straight, I DONT OWE JEREMY ANY AMOUNT. For the times that Jeremy assumed or perceived that i ignored him or hid from him i would like continue to say that it was not my intention.

It is my earnest desire that this issue comes to rest. Moreover it is my prayer that people reading all the posts about this matter would be informed enlightened before they form judgement on both Jeremy and me.

  1. Whatever you do to save your face, you still duped youR model, learn a lesson from that experience. Professionalism does not disrespecting and being non committal to your models. You used the person's time and effort to pose for you, that man deserves compensation for his days work whether your client paid you or not.

    3. So many loopholes in this obvious damage control letter. "He took it upon himself to give Jeremy his expected amount" daw but sir it is already a year a no tf was settled. If this what was explained above is true, then it will only take him a minute or two to answer the model's call and remind him of the agreed payment arrangement.
      If the model has been hounding you for your TF, it's the biggest clue to this Randy guy to know that Jeremy did not understand the supposed agreement if indeed there was any.
      You just say "please be reminded that we all agreed to be paid after the publication of the article and just so you know it might be publish just this June 2014. I'll update you as soon as I have words from the publication".
      But no, what he did was hide from the model, not reply, drop his calls. I can just imagine the load used in all the sms and calls just to follow up for a year for the late TF. I bet you it's already more than P2k.
      And yes I think the alleged text of paying him "tomorrow" and excuses about Philippine mobile networks on why there are missed calls. In this industry, when you missed a call related to work, the professional thing to do is text the person when you are available to answer.
      And if you owe a person a certain amount, even if that person calls you name, your debt will not be erased.

  5. However much statement you release now, the earlier FB postings you and your partner wrote had shown how you handle transactions with models. Wouldn't it had been better if you clarified things with the concerned parties before it escalated to online rants?

Randy can even give jeremy the contact number of the publisher to verify personally kung nagbayad na ba talaga sila at para mawala duda na nagsisinungaling lang si randy.. common sense lang diba.. which clearly you and randy dont have...

      Another thing.. there are tons of ways para macontact mo ang isang tao.. call, fb, email, mail, txt and you can even pass a message to some of his friends or family... again.. common sense...

      Kung gusto magbayad at magexplain may paraan.. ang ayaw may dahilan...

  20. What professionalism entails is that you ensure that both parties are clear with the terms of compensation and answer all questions that pop up along the way. The party most expected to be professional did not act professional. A real professional thinks of repercussions of his actions and are accountable for them.

A promise with an expected implied timeframe based on common interpretation. Why did Randy behave in a way that he had no intentions of paying?

  27. Even IF he's telling the truth, he obviously did NOT explain the payment process to the model. This statement is very fishy. I doubt it would have escalated if he only told the model how the payment works. But given this, it's highly doubtful that he's telling the truth. As someone said above, this is damage control. Echoserang b, in short. I think that, if he's telling the truth, either the other models involved, or perhaps the make-up artists, etc. would be able to vouch for him that they also weren't paid. So if he's telling the truth, he should get others involved to speak up. But obviously it's not happening.

    You have no business becoming an instructor because even this edited statement reeks of incompetence at various levels. More importantly, you have no ethics as a fashion photographer -- you just put your profession in a bad light.

    You regret having posted comments in his FB account? Then your lack of circumspection in here, and even branding it as your official statement, further puts you to shame.

    Sometimes, all you've got is one shot. If that's true for you, hey, you just blew it big time.

If Jeremy had been texting, it would have been very easy to explain by text the no publishing - no TF "rule." Also, if paying Jeremy was a self-initiated act regardless of "rules," why was Jeremy expecting it in the first place? It would have been because there was a promise or an agreement - one which was not kept. Models will not bug their photographers if there was no really good reason behind it.

  38. If he took it upon himself to sell the portfolio shoot to a publication as an editorial story, then the photographer is responsible for paying the model. Whether the publication paid the photographer or not, he should pay those whose images have been used in the coming up with the editorial. He sold the story to the publication, therefore it is his responsibility to pay for the supplies he used in production--models included. I'm sure bayad naman siguro yung mga camera at mga props na ginamit sa production.

    1. Problem is, baka puro abono na rin sya. Puro palabas ang pera, wala nang pumapasok. But the bigger problem, if wala sya pambayad, he should've faced Jeremy and told him that the payment would be delayed and enlightened him on how the industry works. Baka nga maawa pa di Jeremy sa kanya. Pero kasi, he's ignoring Jeremy, so ayan, lalo lumala ang issue.

  41. Some people, I am not saying sya ha, are really taking advantage. More often than not, the victims will not complain for fear that sisiraan sila (like reklamador, maraming tanong, etc.), or di bibigyan ng trabaho. If the arrangement is between the model and the photog (or whoever), bakit ide depend yung bayad from whenever the publication will pay?

    1. Exactly. Kaya andaming naiisue na artista rin dahil sa mga echoserang nakapaligid sa kanila during pictorials and shoots. The way Randy handled the discussion with Jeremy on social media speaks for itself. Idagdag mo na yung isa who called Jeremy names as the way to defend his contribution to this whole mess.

  46. Mr Capinpin. I dont want to judge you becuase I dont know you personally. But this letter is just to cover your face after what the model posted on his FB account. A simple "Sorry, I will try to fix the problem right away" would have been more decent and sufficient . Based on the reaction from the people here on FP, readers are not dumb to realized who is telling the truth and who isnt. While you still have time, call the guy and apologize, most importantly, pay him. End of story

  54. Yung Erica Devantes na nagde-defend kay Jeremy sa fb ay girlfriend nya. Erica was formerly known as Hazel Espinoza in showbiz back in the 90's. Para lang ito sa mga nagtataka kung sino un Erica sa fb na nagtatanggol kay Jeremy.
