Repost: Nadine Lustre and Legal Camp Not Bothered by Lawsuit of Viva

Nadine Lustre and her legal counsel, Atty. Lorna Kapunan, are not bothered by the breach of contract suit filed by Viva Artists Agency (VAA) against the actress stemming from her decision to terminate her management contract.

“We welcome the complaint and we are confident that the truth will come out about VAA being predatory, oppressive and abusive not only of Nadine but its many other talents,” Kapunan told ABS-CBN News Friday night, shortly after Viva’s announcement that its talent management firm filed the complaint before the Quezon City Regional Trial Court.

VAA alleged that Lustre, who unilaterally revoked her management contract last January, violated her “valid and existing agency and management agreement by contracting independently with advertisers, promoters, and other third parties, in utter disregard of the exclusivity of her contract.”

It also reiterated that Lustre remains its exclusive artist until June 2029, based on valid contractual agreements.

Kapunan, however, disputed Viva’s stand and insisted it was the entertainment group that should be sued for breach of contract.

“The contract is an Agency contract and Nadine is the Principal — and it is the right of the Principal to terminate the Agent when it is not performing its commitments under the Agency Agreement,” Kapunan said.

“We are prepared to prove VAA’s material breach of the contract. We are likewise prepared to show that VAA is guilty of tortious third party interference by its threatening/ pressuring third parties dealing with Nadine in good faith and scaring them with potential court cases.”

Kapunan also cited Lustre’s undertakings, separate from VAA, since the start of 2020.

“Nadine is now self-managing which she has every right to do especially during this difficult pandemic,” she said. “It is her prerogative to continue to earn without VVA getting an unconscionable amount in agency fees which it does not deserve. This is not Nadine’s fight alone it is for all talents/artists who are similarly situated.”

Aside from her music recording, Lustre has had a steady stream of endorsement jobs this year, and has remained with ABS-CBN.

Acknowledging Her Issue

Broad-minded Celebrity (BC) decided to consult a therapist before an issue gets out of her control. The good thing with BC is that she’s open to seeking treatment from a medical professional rather than refusing to acknowledge that she has a potential problem.

BC stepped back and evaluated her relationship with Amiable Man (AM). During their relationship, BC observed how much she adores being with him. She has become clingy and would not want to leave his side. These days, her friends laugh her off, as she originally wanted to give AM a hard time when he expressed his interest in her. However, her plan failed because the attraction was too difficult to resist.

AM met and sometimes exceeded her expectations; thus, BC was content with him. BC feels he is her forever, but still, she could not deny the changes she has been experiencing. She has been wondering why intimacy with AM is so strong that she feels she’s hooked on their private moments. She could last many rounds with him. She often initiates their moments and he’s all game. BC acknowledged to a friend that she has not felt that way in her previous relationships.

However, BC cannot just drop everything for AM, even if the longing is irresistible. She has to honor her commitments. Like many celebrities, BC knows she can be sued if she reneges on the terms of her endorsements. Hence, before her feelings for AM overwhelm her, BC has taken steps to make sure she’ll be in control.

Repost: Viva Artists Agency (VAA) Sues Nadine Lustre for 'Continuous Violation' of Contract Lasting Until 2029

Viva Artists Agency (VAA) on Friday filed a lawsuit against actress Nadine Lustre, whom it said remained its exclusive artist until 2029, over her alleged “continuous violation” of her contract.

The talent management firm of the larger Viva Entertainment group filed the complaint before the Quezon City Regional Trial Court.

VAA alleged that Lustre violated her “valid and existing agency and management agreement ... by contracting independently with advertisers, promoters, and other third parties, in utter disregard of the exclusivity of her contract.”

The case, according to VAA, seeks to stop Lustre from “continuously violating” their agreement, and for the actress to “honor” her contract with them.

Lustre entered a 5-year, exclusive contract with VAA in 2009, the group said. That contract was renewed in 2014 for another 10 years, or until June 30, 2024. The same contract was then renewed for another 5 years in 2015, moving its end date to June 29, 2029, according to VAA.

“During this period VAA developed, built, and nurtured Nadine’s career to make her one of the most sought after artists in the entertainment industry,” the agency said.

‘MULTIMEDIA PRINCESS’

VAA pointed out that Lustre’s “career took off” when it cast her in the 2014 blockbuster “Diary ng Panget” opposite James Reid, launching the wildly popular “JaDine” tandem. The reel and real partnership went on to star in the hit ABS-CBN drama “On the Wings of Love,” among other successful projects, VAA recalled.

Under Viva’s record label, Lustre also released a number of singles as a solo artist, aside from her stint as a member of Pop Girls dating back to 2009.

Lustre’s successful foray into acting and music earned her the “Multimedia Princess” title, as she was dubbed by Viva. As recently as 2019, her big-screen projects under Viva earned her successive best actress wins, cementing her status as an acclaimed performer.

“Despite her continued success as an exclusive artist of VAA for almost a decade, Nadine still chose to violate and disregard her contract with VAA,” the group said.

VAA’s legal counsel, Atty. Chino Roxas, called on Lustre to “honor and respect the sanctity of contracts.”

He added: “Third parties are put on notice that any direct dealings with Ms. Lustre for her services as a performing artist or endorser shall be in violation of Ms. Lustre’s contract with VAA.”

LUSTRE’S CAMP: VIVA CONTRACT ‘OPRESSIVE’

VAA’s filing of its lawsuit against Lustre came nearly a year after it first warned of legal action against the actress in January, when she announced having “terminated” her contract with the agency and that she was now “self-managed.”

At the time, Lustre’s camp said it welcomed “any legal action by Viva so their unconscionable, oppressive and illegal contract with Nadine (and their other artists) can be litigated in the proper forum.”

“It’s about time that a David strikes out a Goliath that has taken advantage of young artists in the industry for the longest time,” Lustre’s legal counsel, Atty. Lorna Kapunan, said in January.

Viva Entertainment, of which VAA is part, is an industry pillar that has for decades produced films (Viva Films) and concerts (Viva Live), among other showbiz ventures.

Its famous discoveries or current contract talents include the likes of Sarah Geronimo, Anne Curtis, Bela Padilla, Cristine Reyes, Yam Concepcion, Xian Lim, and Matteo Guidicelli.

VAA was also home to actor Reid, Lustre’s former boyfriend who had left the agency in late 2019.

Since her proclaimed departure from VAA in January, Lustre has released a full album under Reid’s record label, and has clinched numerous endorsement deals with ads on social media and television. — with a report from MJ Felipe, ABS-CBN News

Noted Personality (NP) stops at nothing to become involved in a good story. No winds, floods, or resources could prevent NP from achieving the goal set for the moment or for future endeavors. First, NP has the support of an organization and incurred extra expenses will be understood. Second, the local government is supportive of the cause of NP. Finally, NP has the tenacity to face any adversity.

Using the local government unit’s available resource, NP was brought to the scene of a big story. However, NP was not satisfied and wanted to proceed to a dangerous area. Rescuers warned NP that the site would be hard to reach. NP was determined even if daylight would soon disappear and the waters would rise. The crew rented a couple of boats to ferry the team. The camera person was instructed to take the visuals.

As the boats attempted to make their way into the dark, a mishap occurred. The boat hit something and turned over. Everyone on board fell into the murky water, NP included. The rescuers reacted quickly and immediately pulled everyone back to safety. The plan was aborted. Meanwhile, NP had to be rushed to a nearby clinic because NP accidentally drank flood water. How far will one go for a story? NP exemplifies the answer, risking life and facing danger to deliver the best for the viewers and help people in need of urgent assistance.

Amiable Personality (AP) has a reputation for making fellow celebrities comfortable and relaxed when she’s with them. Sometime ago, AP saw that Network Talent (NT) had an issue with the production. Rather than remain indifferent, AP came to the rescue. NT took that gesture well and a sign of goodwill on AP’s part.

To show her gratitude, NT said that she will take care of the item so as not to trouble AP more. However, AP said that she will not be inconvenienced and NT should just place the item in the bag. NT followed AP’s instructions. When she reached home, AP unpacked her bag and told An Assistant (AA) of a certain smell coming from somewhere.

AA identified the source of the smell in her bag. AP immediately said to separate her other stuff for disinfection and the smelly thing. AA asked what to do with it. AP instructed AA to place the thing in a bag and throw it away. After which, AP and AA speculated how much smell could stick, and they could only look at each other.

Meanwhile, AA could only smile upon finding out how AP has remained charming and diplomatic, short of becoming hypocritical, over the outcome of her item.
