Repost: Gucci Files Lawsuit Against Forever 21 for Ripping off Its Stripes & Motifs

Gucci has reportedly filed multiple cease-and-desist letters to Forever 21 following apparent copyright infringement on a number of the fast fashion retailer’s items.

According to Fashionista, Gucci sent the first of these letters as early as December 2016, which demanded that Forever 21 pull all items featuring “any and all use of” blue-red-blue stripes. A second followed in January and a third in February, both of which expanded the complaint to not just the blue-red-blue stripes but green-red-green stripes as well. Gucci stated that the stripes are “confusingly similar” to those of its own.

Far from rolling over however, Fashionista also reports that Forever 21 is now seeking legal protection against the threat. The fast fashion retailer filed a legal complaint on Monday.

“Forever 21 is not infringing any Gucci trademark,” states the case document. “Gucci’s trademark registrations relevant to this dispute should be canceled. Gucci’s pending applications should not proceed to registration. This matter is ripe for a declaratory judgment.”

The irony in all of this is that Gucci has itself been accused of plagiarism in the last few weeks — first of copying designs from legendary Harlem courtier Dapper Dan, and then by two other separate designers.

Forever 21 is also no stranger to disputes over plagiarism. In the last year alone it has been accused of ripping off Kanye West, Thrasher and Emily Oberg. Stay tuned for more information on this one.

  1. Diba mas trademark ng Gucci yung Supreme canvas nila? i have one na baseball cap with that supreme canvas design pero may red and black stripes din. Pero i kinda agree na confusing yung ibang design ng F21 lalo na yung red and black.

    1. Forever 21 is not worth naman the money you spend for their items, sa totoo lang. Poor quality, most pa ang rip-off. There are other retail stores na mas may quality kaya.

    4. 11:05PM Halos lahat naman ng retail stores ngayon ay talamakan ang pag rip-off...Zara, H&M, Forever 21 and yet dinudumog pa din sila ng mga tao lalo na pag Sale season dito sa 'Pinas. Uniqlo lang talaga ang pinaka okay...good quality ang mga items nila.

    5. True. Sa H&M medyo okay pa, di agad naghihimulmol yung jeans pag nilabhan mo, tapos okay din mga dresses.

      Pero Uniqlo talaga ang pinakamaganda. Ang ganda ng basics nila.

  6. long before gucci used those stripes, dami nang ganyang stripes... hello mga jacket ng lolo ko nung 60's and ng tito ko 70's to 80's puro stripes.

    and if kinopya man nga ng forever21, sama hindi na lang... kasi honestly baduy mga designs ng gucci with those stripes - on soft cloth dress, in shoes na rip off lang ng stan smith na inalter lang nilagyan ng stripes come on? parang coloring book ng bata, skirt na may garterized stripes. baduuy!

    5. But that's the whole poimt of f21 (and h&m na din). Ginawa nilang accessible sa masa ang mga design at style ng mamahaling brands, kaya nga they were able to kill off their competition tulad ng gap, american apparel, banana republic, etc.

    7. Different strokes for different folks. If I could shop just one luxury brand my entire life I'd probably go with Gucci. I especially love the classic designs. I'm not a fan of the flashy ones (maybe because I don't have clothes to pair with it) but I could appreciate why some people would be drawn to it.

  8. Yung stripe ng classic gucci is green/red. On another note, marami naman nadin ibang brands na gumamit ng striped cuffs sa jacket..way before naglabas ng ganyang design yung new designer ng gucci. Kaya malabo na may patunguhan itong case.

  9. That's funny. I always thought Tommy Hilfiger yang blue and red design na yan. I obviously don't pay attention sa high-end brands pero the stripes have been done over and over that nobody owns that particular motif anymore.

  10. Ever since I can remember, the green-red-green and the blue-red-blue rib is synonymous to Gucci. You see that rib and you know that the person is wearing Gucci. Obviously, F21 wants to knock-off the look and what the design connotes. Gucci is right to sue.

    1. 9:34PM Yes the green-red-green talaga is Gucci ever since. Biglang umeksena yung blue-red-blue dahil inincorporate ng new designer ng Gucci sa ibang designs niya yan para siguro bigyan ng 'modern twist' at babagay sa 'maximalist' aesthetic ng brand ngayon.

  12. Wow... pati ba naman stripes inaangkin. They have no case. It's like saying Chanel owns the quilt pattern look (which they are really known for). Unless the brand name is specifically stamped into the items etc. there is no case.

    2. Newsflash- trademark is not restricted to the logo only. A pattern can be trademarked and most luxury designer brands take their trademarks seriously. ex: Burberry's tartan design is a registered trademark. In the case of Gucci they maintain federal trademark protection for those specific stripe combinations.

  14. Hmm. I wonder kung may mangyayari sa case na ito, dahil ang premise talaga ng f21 eh pag knock off ng mamahaling signature brands sa mas murang halaga. Lumaki na nga ang kumpanya nila at hindi napigilan ng mga brands na kinokopya nila. At least yung h&m medyo nakakaalis na sila sa ganitong image, dahil may original designs na sila na ipinapasuot sa mga artista sa red carpet (though hindi ko alam ang quality, di ako mafashion na tao lol).

  18. itong Forever 21 most of their clothes you can also find in Tiangges or bangketa. Nothing special. The shop lang ang mukhang sosyal pero once you wear the clothes, nothing fancy at all. It doesn't stand out.
