Letter from a Reader: NCCA Used Public Money to Send Its Secretariat Officials to Venice Biennale 2015?

Dear Fashion Pulis,

Allow me to share through your blog about the current events and issues at NCCA also known as National Commission for Culture and the Arts, hoping that it reaches more people concerned.

We hope that something immediate is done about this recent issue.

1. The NCCA sent a delegation headed by its Chairman, Felipe M. De Leon, Jr., to grace the opening of the Venice Biennale on May 5, 2015. The duration of Official Travel of said delegation to Venice is May 5-13, 2015.

2. The NCCA delegation is composed of top-level management officers: Adelina Suemith (OIC Executive Director), Marichu Tellano (Head, Plan/Policy Formulation and Programming Division), Myla Buan (Board Secretary), Herence Llapitan (Head, National Endownment Fund for Culture and the Arts Division), Susan Dayao (Head, Administrative and Finance Division), Bernan Joseph Corpuz (Head, Subcommission on Cultural Heritage Section), Ferdinand Isleta (Head, Arts Section), Renee Talavera (Head, Subcommission on Cultural Communities and Traditional Arts Section).

3. NCCA’s top management (heads of divisions and sections) is on travel EN MASSE overseas at the same time for more than a week.

Questions:

Is the NCCA then left supervised by designated officers-in-charge during the duration of travel? Is this practice (top positions filled in by OICs while head honchos all are on travel together for one event only) considered ethical by government?

What was the rationale for the selection of the composition of NCCA’s delegation? Do their official tasks and terms of reference really entail travel? Were they invited to attend the opening and were offered to be hosted prior to their selection as part of the NCCA delegation?

If this travel was authorized and considered official business, where did their Travel Authorities come from? The NCCA is under the Office of the President, so the MalacaƱang should be aware of such delegation?  If not, why shouldn’t the OP be informed?

If the NCCA fully funded the travel of its officials (airfare, local accommodations, allowances, etc.), is NCCA, therefore, in violation of the austerity measure (AO 103) being implemented by the government that is not yet lifted?

Aside from its top officers and the featured artists (Jose Tence Ruiz, Manny Montelibano, and curator Patrick Flores), did the NCCA delegation include artists, gallery operators, and art critiques, who could have been benefitted from the most prestigious and oldest contemporary art exposition in the world?  If not, why were NCCA administrators prioritized?

What do we expect from NCCA’s delegation? Would the NCCA Chairman, as Commissioner of the Philippines Pavilion have an official itinerary during the duration of his travel? How about the rest of his delegation? If merely part of the delegation, how incompetent could the Head be that he would need 8 or so assistants?

How much is the total fund allocation for the Philippine participation in the Venice Biennale 2015 and sources of funding? How much was allocated for the NCCA delegation?

The NCCA, according to its Implementing Rules and Regulation of Republic Act 7356 (Law Creating the National Commission for Culture and the Arts, April 3, 1992), is to administer the National Endowment for Culture and the Arts (NEFCA) for cultural programs, projects, and activities (Rule XIV: NEFCA).

Is the agency allowed to give grants to its own employees?

If the NCCA funded its own delegation through its NEFCA, is this not a clear violation of the law?

Would not RA 7356, Rule XVII: Code of Ethics, prohibit the NCCA officers and employees of the Secretariat from getting funded though the NEFCA which is established for grants for artists and cultural workers?

Why did the NCCA Board of Commissioners approve the funding of such through NEFCA? Was there a project proposal from its employees that was evaluated and approved through channels? Being the final approving body, why did the NCCA Board allow the members of its Secretariat to get grants?

How can the NCCA delegation to Venice have concurrent contracts as grantees and regular full time government employees at the same time?

Should NEFCA be used for the NCCA officials and secretariat’s projects, personal development, trainings, local and international travels, and other similar undertakings? What are the requirements and formal rules being implemented by the NCCA to ensure the legal utilization of NEFCA for such?

It should be noted that this is already the second time the NCCA did send delegation under the NEFCA funding. In 2014, NCCA sent another delegation of employees to attend the exhibit opening of “Philippines, Archipelago of Exchange” at the Paris Musee Du Quai Branly.

Hoping that these questions and concerns will be addressed accordingly.

    1. I smell something fishy with the letter sender. As in umaalingasaw talaga sa lansa parang amoy matris na! If his concerns are valid, why send it to FP's blog and not to the approrpiate venue. Inggit lang si Ate hindi nasama sa outing, este official trip.

    3. For sure hndi nyo alam kalakaran ng gobyerno natin. Mas ok pa dito kay FP kesa sa ombusdsman, or any goverment agency. First hindi nila ito mapapansin, 2. Magagapang lang ito, 3. Baka ikaw pa kasuhan.. Ako nag work na ako sa isang gov. Corporation, kaya alam k, dumi at baho.. hndi lang naman sa mataas na katungkulan ngyayari ang corruption,mas corrupt pa nga yung mga goverment regular employee, kesa sa appointed officials at hndi regulAr.. Sabi nga nila diba, gusto m ng trabhong tamad, at pitiks pero sagana sa benifits, may goverment work ka.. Sure yun..     5. Agree with you 8:23, Philippine bureaucracy is laden with too much fat! I once went to a top government bank. Believe you me, ang kausap ko dun is supposed to be an executive, but when i went to his office, nothing was going on there, walang activities. I was shocked, feeling like his position was just invented to accommodate him, pero sa tutoo, it's not needed. Puro kwentuhan at tawanan lang ang inabutan ko until I left. and these people get FAT salaries every month. Naawa ako sa bansa ko. Naawa ako sa sarili ko.

Bago naman i.approve ng malacanang ang travel authority andun lahat documents to support the participation.

Tax po iti ng bawat pilipino na nghirap magtrabaho at ni hindi makuha magbakasyon tapos sila itong pa Venice lang.Aminin na natin na may ibang officials sa atin ang gagawa ng kunwar'y purpose ng pag travel para makasama lang sa Libre ng Bayan.

    4. The government pays for it talaga but you need a travel authority to be allowed to travel and para mabigyan ng allowance. Mukhang sa NCCA din nagwowork tong sender kasi he knows the details. Sana tinignan nya ung TA. Anyway, masisilip naman yan ng COA. If you want it to be audited edi magrequest sya sa COA na nakaassign sa NCCA. Sana wag lahatin ang mga govt employees. I'm an accountant sa isang govt agency and believe me pag nagpprocess kami ng mga ganyang disbursements, ang sarap sa feeling ang mag-deduct ng mga unnecessary expenses. Ofcourse I won't vouch for NCCA pero yun nga, wag naman sana lahatin.

  15. I always witness this kind of govt practice though from a diff govt office. Really sickening. Instead of capacitating the vulnerable sector umiikot lang sila sa buong mundo using project funds and label it as benchmarking visits. Wala naman dalang knowledge/partnership paguwi. Alam na.

  18. Anton, you have valid points for someone who sourgrapes but it doesn't mean that they are right. These people are from NCCA of the Philippines, and if there are right people to represent the country on an official and approved business be it outside the country, it will be them. I am not from NCCA but I work in the government and my common sense tells me that official business to represent the company's domain is being done in all industries, be it government or private. Their airfare and board and lodging is of course funded by their funds, but their expenses for extra leisure is not, just as how it happens in any company sending their executives for meetings abroad. We have to know what's the purpose of their business there. If it's only to facilitate a ribbon cutting there, then I think they are too many. But if it is to learn the preservation of culture and arts of Venice from their executive counterparts in Europe, then you would have to reassess your points. For the meantime, have a donut. Do not be too sour about it.

      Anton should be aware that this kind of action has implications on people's careers. In government, if you are fired, you lose your pensions and benefits, so the accusations are serious and life-altering.

      I hope he is not just trying to raise a fuss if he is not serious about his allegations.

  25. Junkets are normal practices in government, sad to say. But after reading Anton's point again, if the funds for artists was indeed used for employees, NCCA has to be questioned by the Civil Service Commission and the Ombudsman. Competitions and raffle draws automatically disqualifies members of the organizers' office and their relatives to a certain degree. So if NCAA gave grants to its employees, is this not a clear case of corruption?

  26. The same thing happened in 2013 when a HUGE delegation of NCCA officials also went to Paris for the Philippine exhibit at the MusƩe du quai Branly. Junket naman po talaga mga yan for NCCA employees.

Hndi k nilalahat pero yung iba working in goverment agency, akala nila all mighty sila, for example, sa isang goverment agency, nakapila ako, yung girl, nag tatanong re: kasambahay law, yung govt. employee, nakikita k pano nya tinatarayan, mataas ang boses, parang yamot na yamot sya, sa babae na nagtatanong. Yung itsura nung ale, nakakaawa, sa mukha nya, gusto nya pa magtanong, pero natatakot sya.. Nung ako na magtatanong, hndi naman sya ganon.. Bakit kaya? Baka may regla lang?

  31. They violated government austerity measures especially for travel by govt officials (I understand that AO 103 has not been lifted). Di pa pwedeng magbyahe ng maramihan ang mga government officials. Google nyo AO 103. or Administrative Order 103 ng malacanang.

  32. Feeling ko, gawain talaga nila sa NCCA yan! It started probably with small trips or small groups and dahil nakakalusot, now here comes the grand entourage! Lang hiya, ang lakas ng loob nilang gumawa ng ganyan. Makakapal ang mukha. Samantalang ang liliit ng binibigay nilang grants sa artists na talagabg legit na nagre-represent ng Pilipinas. Ano daw ang ginawa nila dun e di naman sila artists? Critics ba sila? Nag attend lang ng ribbon cutting. So extravagant naman! Don't you think so?
