Father of Girl Who Suffered Burns in Flight Eyes Suit vs Airliner

The father of a six-year-old girl who sustained first-degree burns after a Cebu Pacific flight attendant accidentally poured hot water on her arm is considering filing charges against the employee and her company.

“I will be filing a negligence case dun sa (against the) flight attendant,” Ryan Rey Quilala told INQUIRER.net on Sunday.

Quilala, who works as a prosecutor for the Office of the Ombudsman, said he will also file a claim for damages against Cebu Pacific for the “anxiety” and “trauma” their family experienced during the incident last May 27 while they were on flight 5J 8974 from Davao City to Manila.

The lawyer said the flight attendant not only spilled “steaming hot water” on the right arm of her daughter Reanne but also did not know how to apply first aid.

Quilala said the flight attendant “simply asked for an apology instead of immediately administering first aid treatment” as his daughter cried in pain.

“Had it not for the request of my wife for any medication the entire flight crew will just watch in vain,” he said.

He claimed that the flight crew was not properly trained and equipped to handle emergency situations.

“Di ba, ang first aid treatment ay running water? Ang ginawa nya linagyan nya kaagad ng plastic bag. Hindi pa iyong ice bag…plastic talaga na puno ng ice. In-apply nya directly sa skin ng anak ko,” he said.

(Isn’t it that first aid treatment for burns is running water? What she did is she took a plastic bag. Not an ice bag…but a plastic bag filled with ice. She applied it directly to my daughter’s arm.)

Quilala said they had to stop the flight attendant because it was “erroneous” for her to do so. He said they instead used the child’s towel to wrap the ice.

According to the World Health Organization, ice should not be directly applied on burns because “it deepens the injury.”

The lawyer said they also asked for a burn ointment, which was handed to them after 20 minutes.

“Yung burn ointment na dinala pa nila in Deutsche. Sabi ko paano ko malalaman kung pang-burn? Tinignan pa namin yung box for English translation. Tsaka lang nya chineck kung expired,” he added.

(The inscription on the burn ointment they gave us was in Deutsche. I asked them how will we know if it is indeed for burns. We had to check the box for the English translation. And it was only then that they checked if it was expired.)

He pointed out that such medication should always be readily available since flight attendants regularly serve hot beverages and food.

After verifying that it wasn’t expired, they applied the ointment on the child’s skin. When they got home, they had the family doctor attend to Reanne. The doctor confirmed that it was a first degree burn.

No response

Amid handing over a handwritten complaint to Cebu Pacific, Quilala said they have yet to receive an acknowledgement from the company.

“Sabi nung senior flight attendant nila mag-iemail sa akin the next day so I gave them enough time. Wednesday, Thursday, hindi nakipag-communicate sa akin so Friday I decided susulat na ako sa Cebu Pacific,” Quilala said.

(The senior flight attendant assured me that they will e-mail the next day so I gave them enough time. Wednesday and Thursday came and they have yet to communicate with me so I decided to send a letter on Friday.)

A copy of the letter was also sent to the Civil Aeronautics Board and the Civil Aviation Authority of the Philippines.

“In view of your seeming indifference to this incident please be advised that I will pursue all means and legal actions to protect the rights of my daughter and that of my family under Section 15 of the DOTC-DTI Joint Administrative Order No. 01 (Series of 2012), Articles 1170, 2217, 2219(2), 2221 and 2229 of the New Civil Code, and other pertinent laws, rules and regulations,” Quilala said in the letter.

He said he never wanted media attention but after a television network saw his Facebook post, he decided that he “might as well tell the truth.”

Quilala said he is hoping that their case would be an example for other disgruntled passengers of Cebu Pacific.

“Kasi baka may ibang biktima na tumatahimik na lang syempre yung hassle, yung gastos. Some of them cannot afford yung abugado to protect their rights,” he said.

(Perhaps other victims don’t do anything because of the hassle and the expenses. Some of them cannot afford a lawyer to protect their rights.)

INQUIRER.net attempted to get the side of Cebu Pacific but the lines were busy. Initial media reports said the company is still investigating the incident.

      And thus, I think that the real issue of the parents is more on their (CebuPac) lack of training and preparedness rather than the actual burn itself.

      And lest someone implies otherwise, I am not from CebuPac or any of the Gokongwei companies.

    13. While I would have to agree na kulang nga sa taining yung staff, the fact that they didn't know how to apply first aid, BUT please hindi nakaka-trauma ang 1st degree burn. I'm a nurse so I KNOW. Kung 2nd or 3rd degree yun and natuklap yung balat, yes di na yun dapat pagtalunan. So in this case, the parents can still sue the staff or the airline company for negligence. Pero yung trauma, OA na yun.

  7. damn.... there you go, cebupac... i was a flight attendant also at Cathay Pacific years ago, and we were trained for 6 months before my first International Flight... mahirap ang training, at the same time mahirap when I applied, ang strict ng guidelines and your qualification should be almost near to perfection... di dapat nagpapanic otherwise, mali mali na ang magagawa mo... yes this attendant wasnt trained well, sinabak agad sya and poor her, lawyer pa nakabangga nya... sayang ang career... hope cebupac will not try to cover up...

  8. Id prolly do the same if I had the resources. I feel sorry for the kid. I kinda feel sorry for the FA also, only cause shes not properly trained. Anyway its still the airlines' responsibility to address and fix the issue right away, I dont think the fa should be held liable financially, though she should be reprimanded by the company .

  14. This lawyer seems poised to milk Cebupac dry. I am not a fan of this budget airline since I always believe in the saying "you get what you pay for". So nagtipid ka kaya expect inferior service. I am not justifying the crew and the airline for their erroneous actions but I am starting to smell something fishy with this father's motives. First degree burn is namula lang ang balat no. Parang naarawan ka lang ng matagal. It doesn't even produce blisters. I mean yes the girl suffered and experienced pain pero exaggerated tong lawyer na ito. Abangan ang susunod na kabanata. Well, kaya nga sya lawyer para maghabla left and right. Sayang naman ang pinang law school nya.

Aren't they supposed to be trained for things like this, not just serving food and drinks? Eh kung mas malalang aksidente pa ang nangyari, ano un nganga lang sila?   16. napaka painful ng 1st degree burn..dahil malapit sa nerves yun ng skin natin..and imagine 6yrs old..ikaw ba matitiis mong maagrabyado at makitang dumadaing ng sakit ang anak mong maliit obviously ang mga nagsasabi na "1st degree lang pala" o "parang sunburn lang" e wlang paki sa mga bata,walang anak o pabayang magulang siguro... d fact na walang natanggap na maayos na 1st aid ang bata e tlagang kademademanda na.... kht siguro na adult ka at ikaw nabanlian ng kumukulong tubig e hihiyaw sa sakit, saka paki nyo ba kung afford nila magdemAnda... ayaw nyo ba un may lumalaban na sa mga kumpanya na inaabuso na tayo..nagbabayad tayo ng tama, substandard na quality ng products/goods and services ang natatanggap natin instead na ibash natin..dapat nga supportahan ntn ng magimprove naman yang cebu pacific, sana matulad sila sa mga company sa US na madali idemanda or ma-file-an ng lawsuit para maayos nila serbisyo nila at ng matakot sila mademanda...

Siguro if baby yung natapunan feel ko pa alala ng tatay niya. Kaso 6yrs old, never ba yan nagalusan o napalo? Masakit pa yata ang galos na dumugo kesa sa parang sunburn. Mahapdi lang saka madali mawala, pwede nga imoisturizer lang yan. Depende siguro if buong limb niya nabuhusan kaso hindi naman yata.

    1. Agree. Cancelled na pala flight mo, malalaman mo lang a day before. So ano tingin nila? Di ka nagbo-book ng hotel na you have reserved for early on, and late cancellation would mean additional cost for you ng dahil lang sobrang late sila magsabi ng cancellation?

  19. I work for 5j. Based from the FA's story, natalsikan un bata accidentally, hindi nabuhusan. Walang galos un bata. The parent accepted her apology. She apologized, end of story, or so she thought. Biglang may exaggerated stories na lumabas. Syempre andyan na un story, wala pa investigation from our camp so everything is once again, trial by publicity

  22. In my own personal experience, my mom also had the same incident, twice. first was hot water, then 2nd time around it was hot coffee. My mom's clothes was soaking wet and the flight attendant did not even offered a towel to wipe or any assistance or apology. Sobrand napaso si mama but glad that she had thick shirt on. From that time on, we never flew Cebu pac, what if nabuhusan face or skin ni mama, di na maibalik yun noh.

  23. buti nga sa cebu pac na iyan, i remember nung pauwi na kami sa cebu from manila last may 9 2014, hindi kami pina check in kasi late daw kami ng 3 mins eh sila nga yung may kasalanan bat kami na late ng pagpapacheck in kasi isang pila lang yung ginamit nila! tapos papabayarin pa naman kami ng 7k isang tao papa rebook nung na delay na flight, hindi man lng kami pina chance passenger kaya ayun nag barko nlng kami pauwing cebu kahit na mangiyak ngiyak nako dun sa naia! kakainis talaga mga taga cebu pac. hindi sila accommodating ever! --karma nila yan!

  33. Haha ang kumukulong tubig ay more or less 100 degrees celcius. Ngayon, ang 60 degrees, 3 sec lang kailangan para makaproduce ng 2nd or 3rd degree burn. Yung sa bata na 6years old na, first degree lang nakuha. Do the math. May incompetencies na observed pero exaggerated ang anxiety and trauma brought by the incident. Sa totoo lang

  37. napanood ko sa news wala ngang sugat o mark yung bata na napaso..nakahanap lang ng butas yung tatay para perahan ang cebu pac, magwala ka kung halos matuklap balat ng anak mo dahil sa banli, natamlasikan lang naman.. tsaka wag mo isisi sa fa nangyari sa anak mo dapat sa window seat mo pinaupo yung bata, eh ikaw pa nakaupo sa window seat kasi!!

  38. Uo mgkakaroon daw sila ng flight sa Us at Europe and according to their management possible na magkaroon ng 1 euro fare.... ano avail kau??

  39. Mag-aavail si pobreng Pinoy tapos kapag may masamang mangyayari, sasabihin nila hindi sila liable kasi budget airline sila? Ano yun, kapag habang lumilipad yung eroplano tapos nahulog bigla isang engine, expected dapat yun kasi nga "budget airline" lang sila? C'mon people, you don't scrimp on basic sh*t like the safety and comfort of your passengers. They're what makes your business a business.
