Open Letter to Abe Licudan

Mr. Abelardo O. Licudan Jr (aka Abe Licudan),

Greetings!

I am one of the persons you have insulted in your comment “MADAMING AIDA DYAN HAHAHA”, this being said authorizes me to write an open letter for you and the rest of people like you.

I have learned from your twitter account @abenextdoor that attached after your name is two letters, MD. Hence, I would like to call your attention by reminding you of the General Principles of your Code of Ethics under Sec. 1 Art. 1 (Philippine Medical Association), which states “The primary objective of the practice of medicine is service to mankind irrespective of race, age, disease, disability, gender, sexual orientation, social standing, creed or political affiliation. xxx”

There are several more provisions of your Code of Ethics that you have violated through your tasteless remark. It is beyond the bounds of possibility that a young professional like you would forget the most basic duty being demanded to you by your profession.

I am not a linguist, but I am in a profession that demands a lot of readings and construction of words. In consideration of the language you have used, it is apparent that you were warning the other guy for people infected with HIV and AIDS roaming around JP Morgan Chase & Co. I don’t know how to properly address you, I cannot stomach calling you, your title, for your negligence to consider the foremost principle you have to be always reminded that is – not to discriminate.

Basing from your act of subconsciously leaving such remark, you are not capable to uphold the demands of the profession you have chosen. Again, I’m calling your attention to Sec. 2 Art. 1 of your Code of Ethics, which states, “A physician assumes the obligation of maintaining the honorable tradition that confers the well-deserved title of a friend of mankind.” From the foregoing facts, you failed to adhere to your call of duty to be a friend of mankind. Can you keep up with other Doctors who knows how to treat people like me infected with HIV better than the way you have treated us with your one liner comment?

I am not in the medical profession, but I know that my condition is a chronic disease; hence, it is a serious matter. It is an issue being addressed by the United Nations, World Health Organization, and our Government per se. If you are not aware as you’ve been apparently busy with other matters, that you even failed to review your Code of Ethics, Philippines today has one of the most alarming numbers in the increase as to HIV infection as per data collected by the Department of Health for the Month of May.These facts being said, I don’t know where to place your ignorance for a very delicate matter that you choose to laugh at considering you are in the medical profession.

Now, let me call your attention with our laws. Your comment was made under someone else’s profile who mentioned that he was in JP Morgan Chase & Co., then you said “MADAMING AIDA DYAN HAHAHA.” Even a grade one student would understand that what you were saying was this “JP MORGAN CHASE & CO., is a den for people with AIDS.” I don’t know where you got your data on this, but mind you, this comment under our law is tantamount to a criminal liability under Art 360 of the Revised Penal Code, it states that “Any person who shall PUBLISH, EXHIBIT, or cause the PUBLICATION or EXHIBITION of ANY DEFAMATION IN WRITING or by similar mean shall be responsible for the same. xxx”

There four essential elements of libel, namely: (1) The imputation must be defamatory; (2) The imputation must be made publicly; (3) The imputation must be malicious; and (4) The person defamed must be identifiable. All of which are present in the libelous remark you made in social networking.

If truth be told, that it was a joke, there can be no better title to address you than this A DENSE MINDED MEDICAL GRADUATE, until then, you’re just that. I don’t know you personally but basing from your ostentatious sense of humor I doubt if you deserve to be called a Doctor. You may earn your license or you may have it by now, but that does not align you from the likes of the Doctors who have been working hard for people like me and who have protected, sheltered, and defended us from people like you. 

I cannot fathom the idea of entrusting our lives much more our society’s health welfare to you and the rest of your breed. But more than my fright of entrusting my life to you is the fear that your ignorance can no longer be cured because despite and regardless the years you have spent in the academe about our condition you neglected to recognize the intricacy of our condition. You have failed to understand and empathize to the labyrinthine disease that you merely referred as “AIDA.”

If in any way, you’ll escape through the legal causes of your actions, I bet that you won’t escape the horror of that day you made this single mistake of addressing our condition in an inappropriate manner.

Abe, I am an HIV-Positive, there is no cure for my disease, but I humbly ask you to cure your ignorance through proper education. Transcend more than what is written. People living with HIV are humans just like you, we have emotions as well, we get hurt, vulnerable, and people die due to complications brought by our condition. I am writing this open letter on behalf of those who have died due to aids related diseases.

I hope that one day, you’ll cross the bridge and choose to be enlightened rather than being left inside the box of ignorance that kills people like me.

Matagal ng naririnig na madami may AIDS sa call center pero if you are not promiscous and you practice safe wherever you are working ma mention man yan o hindi there is no reason to be affected unless u know someone na infected or ikaw mismo either way karapatan nya magreact he was teasing a friend.

    7. di ko rin alam ang stats, pero yong mga doctors kasi usually alam talaga nila kung nasan ang mga may kaso ng hiv/aids. mukhang nadulas si doc at naprint pa. pag may hiv ka kasi tini-trace nila kung saan mo posibleng nakuha, so ayon. yong isang doctor na kilala ko nabanggit niya ang isnag sikat na gym naman. siguro parang center ng web, kaya na-identify na marami doon.

      Does a doctor cease to be a doctor when he is off-duty? Or with friends? Or when he's on Social Media? What does the Hippocratic Oath mean to Dr. Licudan? Was it merely a requirement he recited upon graduation from medical school? What of those of us, who are not doctors, but have enough in life, what responsibility do we have to elevate awareness for incurable infectious diseases?

Ang comment ng isang doctor ay sadyang nakaksakit lalo na kung pagtatawanan ang isang taong hundi ninais magkasakit ng HIV ngunit kasabay sana kung paano mo lninais na ma educate lahat ng tao about sa sakit/ sitwasyon at paghihirap ng may ganyang karamdaman e mas ma educate ang lahat at mas maintindihan ng lahat ang mga paraan para hundi makakuha/ mahawa ng nasabing sakit. Sabi nga prevention is better than cure, pero mas masakit ang hindi na nga magamot e pagtatawanan ka pa rin.

    The statement by the doctor cannot be considered libelous under our Revised Penal Code.

    Let me direct you to this jurisprudence laid down by the Supreme Court of the Philippines:

    Under Article 353 of the Revised Penal Code of the Philippines, libel is defined as a public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status or circumstance tending to discredit or cause the dishonor or contempt of a natural or juridical person, or to blacken the memory of one who is dead. Thus, the elements of libel are: (a) imputation of a discreditable act or condition to another; (b) publication of the imputation; (c) identity of the person defamed; and, (d) existence of malice. [Daez v. Court of Appeals, G.R. No. 47971, 31 October 1990, 191 SCRA 61, 67]

    On the other hand, to satisfy the element of identifiability, it must be shown that at least a third person or a stranger was able to identify him as the object of the defamatory statement. In the case of Corpus vs. Cuaderno, Sr. (16 SCRA 807) the Supreme Court ruled that “in order to maintain a libel suit, it is essential that the victim be identifiable (People vs. Monton, L-16772, November 30, 1962), although it is not necessary that he be named (19 A.L.R. 116).” In an earlier case, the high court also declared that” … defamatory matter which does not reveal the identity of the person upon whom the imputation is cast, affords no ground of action unless it be shown that the readers of the libel could have identified the personality of the individual defamed.” (Kunkle vs. Cablenews-American and Lyons 42 Phil. 760).

To the letter sender, if you want this doctor to be punished you can have him suspended by filing a formal complaint better if there are other HIV patients na magrereklamo kasi nga as you said labag yang sinabi niya sa code of ethics ng mga doctors. Lastly pwedeng idemanda siya mismo ng JP morgan sa sinabi nya nakakadumi ng pangalan ng company considering na kilala talaga sila

  16. nursing grad ako, pero nahiya ako sa balat ko nung, may nakilala akong posit, natakot ako matalsikan ng laway niya. Stigma got me. And yun mga kaibigan ko, naging laughing stock namin. But then I realized, hindi nakakatawa, kailangan natin sila intindhin at kailangan natin maging mas educated pagdating sa sakit na ito. Hindi lang alam ng iba satin, nasa 33M na ang bilang ng posit dito sa bansa. Anyone can have it. Gusto ko din mag sorry kung naging joke namin ang pusit pusit dati. Sorry from the bottom of my heart, though wla ako sinabhan directly, and ngayon bumabawi ako by educating other people too to help end the stigma.

  18. While Posit Bo created HIV and AIDS awareness over this post, I think he was TOO enraged to call out Abe Licudan over his bitchy, but nonetheless private, comment ("Madaming aida dyan!").

    That being said, does Posit Bo had the right to call out Abe Licudan for a post that was said in a private conversation?

    Given that Abe Licudan is in such a profession, bawal na ba syang mag-joke around with his friends? Should we all get offended, and gain the right to sue libel, whenever something distasteful offends us?

Someone that should be looking out for people who are being stigmatized for having an incurable diesease. He has a title and a license that he should be upholding.   21. I think it's terrible that in our country there is still a lot of ignorance when it comes to infectious diseases, sexually transmitted diseases, and on how to treat other people respectfully, overall.

    Being respectful is a basic tenet, not only, of the medical profession, but also of living life in general. What has become of our Filipino culture? Are we so ignorant that our sensibilities do not apply when the subject is about sexuality transmitted diseases? What of compassion?

    There are still a lot of people or potential patients who do not know how to, or simply refuse to address their symptoms by seeking medical attention for an infectious disease due to fear of discrimination, rejection, and humiliation--from the public AND WORSE from medical professionals. By this fear alone, we have managed to preclude the treatment of, or maybe even the possibility of proactively preventing the escalation, HIV to full-blown AIDS.

    It is annoying that there are people who make light of the subject and joke about HIV/AIDS as a disease to "be careful of" in the context that one would acquire it like one would a cold or a cough. But more appalling, when we hear such blatant ignorance from a doctor. #stoptheignorance #endthestigma

    5. Salamat sa ganitong comment. Kaya lang kasi maraming mayayabang na mga doctors dito sa atin. Yung unprofessional behavior nila hindi naman kinokorek ng kinauukulan unless sobrang grabe. Yung mga pangungutya na ganyan, unfortunately, madaling nakakalampas. Sabihin nila joke lang naman. Tao lang naman na nagkakamali, etc... at totoo yung sinabi mo na maraming hindi gusto magpagamot dahil sa takot na baka sila pahiyain ng mga hospital workers pati ng mga doctors kung sakali mang positive sila. Ewan ko kung may magagawa pa ba para magbago yung ganyang ugali, kasi mukang nasa pagpapalaki talaga ng magulang ang mabuting asal. Wala sa taas ng pinag-aralan.

And point per point, the sender was very determine to return the shameful remarks that the careless "Doctor" used.     4. 1:31am. Andoon na kasi ang karamihan ng klase ng tao. May matanda,bata,gay,lesbian,mayaman,mahirap,malandi,mahinhin,etc. Base sa experience ko... First job ko and naculture shock talaga ako (from a conservative family). Umagang umaga tambay karamihan ng mga agents sa inuman and dun nagsstart yung mga affairs nila. Swap ng partners halos every other month (daig pa Hollywood). Girl,boy,bakla,tomboy nagkakaaffair. Awayan ng mga agents minsan manager dahil sa lovelife. Halos karamihan ng mga friends ko na may boyfriend na taga call center nagloko.Di ako tumagalan ng 1 year dahil di ko lang feel yung sobrang liberated na atmosphere. Hindi ko sinasabing lahat ha... may ilan din talagang matitino pero mas madami yung medyo sablay yung morality. If you have a girlfriend/boyfriend/asawa na taga call center and hindi nagloko, swerte mo na.

Kasi kung iisipin mong mabuti nagbigay lang naman ng warning yong doctor sa ibang tao. Buti nga't hindi AIDS ang sinabi eh kasi sa totoo lang hindi ko na-get 'yong AIDA na sinabi niya.   32. I find the rant OA, however i feel sorry for Posit Bo. Anyway, i need to correct some things regarding his idea on Libel according our Penal Law System. The sweeping general statement made by Abe cannot be penalized under our laws. The statetment he made was general and in no way will identify a certain person.

    Let me share to you guys some jurisprudence decided by the Supreme Court that will help you better understand libel.

    Under Article 353 of the Revised Penal Code of the Philippines, libel is defined as a public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status or circumstance tending to discredit or cause the dishonor or contempt of a natural or juridical person, or to blacken the memory of one who is dead. Thus, the elements of libel are: (a) imputation of a discreditable act or condition to another; (b) publication of the imputation; (c) identity of the person defamed; and, (d) existence of malice. [Daez v. Court of Appeals, G.R. No. 47971, 31 October 1990, 191 SCRA 61, 67]

    On the other hand, to satisfy the element of identifiability, it must be shown that at least a third person or a stranger was able to identify him as the object of the defamatory statement. In the case of Corpus vs. Cuaderno, Sr. (16 SCRA 807) the Supreme Court ruled that “in order to maintain a libel suit, it is essential that the victim be identifiable (People vs. Monton, L-16772, November 30, 1962), although it is not necessary that he be named (19 A.L.R. 116).” In an earlier case, the high court also declared that” … defamatory matter which does not reveal the identity of the person upon whom the imputation is cast, affords no ground of action unless it be shown that the readers of the libel could have identified the personality of the individual defamed.” (Kunkle vs. Cablenews-American and Lyons 42 Phil. 760).

This type of insensitivity is what is causing a lot of high risk individuals to not get tested or help. They feel that individuals who were supposed to help and understand them (family, friends, medical and government workers) are looking at them like they're dirt. Those living with.hiv can still lead healthy, normal lives. Sabagay, we are living in a very hypocrisy riddled culture.

    CONFIDENTIALITY

    Sec. 30. Medical confidentiality. – All health professionals, medical instructors, workers, employers, recruitment agencies, insurance companies, data encoders, and other custodians of any medical record, file, data, or test results are directed to strictly observe confidentiality in the handling of all medical information, particularly the identity and status of persons with HIV.

    ection 33. Penalties for violations of confidentiality. – Any violation of medical confidentiality as provided in Sec.s 30 and 32 of this Act shall suffer the penalty of imprisonment for six (6) months to four (4) years, without prejudice to administrative sanctions such as fines and suspension or revocation of the violator's license to practice his/her profession, as well as the cancellation or withdrawal of the license to operate any business entity and the accreditation of hospitals, laboratories or clinics.

  40. Can we just view HIV as any regular disease? Bakit ba butthurt masyado mga may HIV? Akala ko ba acceptance ang gusto nyo, bakit paimportante masyado? Papansin? Pwede bang maging normal na lang na may sakit? Ano bang pagkakaiba ng sakit nyo sa sakit ng ibang tao? Geez di naman ganyan mga may Hepa, TB, High Blood o Diabetes! Yung mga mamatay nga na may cancer hindi ganyan, ano bang ikinaiba nyo sa iba? Kayo mismo ang nagdraw-draw ng attention sa inyo para mas mapag-usapan at kutyain! Just be responsible citizens and stop spreading the disease, promote safe sex, promote awareness and testing!

They are not merely illnesses that can be dismissed as "pareho-pareho lang dapat," we are talking about real people going through physical & emotional suffering, and difficult times all-around for the sick and their families and loved ones. Insensitive and extreme comments like yours are part of the problem because instead of being compassionate, you choose to be impatient with pleas for understanding and sensitive treatment. The Doctor was clearly out of line, given his position; and even he acknowledged that. Maybe having more exposure to the real world will help you change your opinion and give you a more enlightened world view.

  50. AIDS is unlike cancer, kahit super healthy ang lifestyle mo may chances na magkaroon ka. If you are the type of person na mahilig mag one night stand na akala mong mauubusan ng sex partner e mataas ang chance mo na magkaAIDS. As for the letter sender, I'm not sure kung paano nya naacquire yung HIV virus and if sa said company sya nagwowork, pero parang sobrang galit naman nya sa comment nung Dr na as if tinag yung pangalan nya at kinutya ang pagkatao nya. It's good though na na publish ni FP itong issue na to kasi para medyo nalimutan na sya ng iba kasi dumadami ang nakakaroon instead na kumukonti. Parang ang hirap din minsan mabigyan sila ng respect dahil yung iba kahit may sakit na continue pa din sa bad habits and ng hahawa pa ng iba! (Exception ofcourse yung mga nahawa through blood transfusion and yung mga nahawa ng asawa). For me mas rude yung mga sinabi ni letter sending saying the Doctor is ignorant, etc.. Obviously ang nagkaka AIDS (na naaacquire through casual sex) ang ignorante.

  51. I don't see how this thread is RAISING PUBLIC AWARENESS ON HIV/AIDS which is what we should be doing to prevent the spread of this dreaded illness. What this thread is doing is creating so much hate and anger when our energies should be directed towards constructively letting this doctor know that AIDS is not something one should joke about especially given his profession. To Posit Bo, I don't know how you contracted your illness and it is sad. But this negative attention you've attracted is not doing anyone any good. Maybe settling it once and for all with Doctor Abe in privacy would be a better option?
