Letter from a Reader: Abusive Police Officer

Dear Fashion PULIS,

I have been a follower of your blogsite, FashionPulis.com ever since your first article came out in February. I find your blogsite both entertaining and informative. My family would truly appreciate it if you can publish this story to expose the abusive use of power by some policce officers.

Let me share with you a very unfortunate incident that happened recently to my cousin, Bert James Millendez, who was a victim of the abusive behavior of Police Officer Michael Dubria. 

The tragic incident took place in a commercial area near the entrance of Central Park Village in Bangkal, Davao City last June 10, 2011. That evening, a group of young professionals, students from UP Mindanao and Ateneo de Davao University together with some of their parents parents were having a send off party  for my cousin Bert James who was departing for the United States the following day.

When Dubria came out of a massage parlor that was located near the bar where the party was happening, he spotted  my cousin, Bert James, standing beside his Toyata Fortuner conversing on the cellphone. For some reason, Dubria got irritated with what he saw and instantaneously in public view assaulted and kicked Bert James who was then prompted to defend himself. Right there and then, Dubria brought out his gun and pointed it on my cousin's face which scared the hell out of everyone present at the scene.

Luckily, Bert James' dad, Atty. Millendez, was present at the party and his friends rushed to him to inform him of the commotion that was happening outisde. Atty. Millendez came to the rescue, spoke calmly to Dubria and was able to avert the tragic incident. Everyone at the party admired James’ Dad who prudently came into the scene with a cool head to prevent any shed of blood and merely accepted Dubria’s apologies.

For the Beta Sigma group and comrades of Bert James from UP Mindnao and Ateneo de Davao, the behavior of Dubria was unforgiveable. His unruly behavior is offensive to human intelligence and civil society. As a police officer, it is expected of him to respect basic human rights. What will happen to ordinary citizens who would not speak out and simply condone Dubria’s impulsive character? If the higher authority will not be informed of his wrong doings, then the entire community will be forever at his mercy.

  5. well this is not new. abusive police officers abound nationwide.

    but not to be crude about it, is this the right media to use to report this story? why not go to the local government of davao? they can deal with this situation better since they are there.

    also, for this kind of behavior to stop. kudos to fp! iba ka talaga, pati politics you got it covered!

    sumbong niyo na lang kay tulfo or sa PNP. :) or sa friends ng daddy ng someone na lawyer sa story. madami namang connections yun, for sure. kung dito kasi nakapost yan, medyo malabong umabot yan sa kinauukulan. unless, yung asawa ng pulis, nagbabasa ng fashion pulis. hehe.

    btw, no comment pa din ba swatch dun sa isang letter sender?

  9. I am from DAVAO CITY. And our city is so bent on kicking out from the force bad police officers like that. we did that lots of times before, pati pension and retirement stripped off... im sure it can be done again.

  12. if you are really serious about teaching the cop a lesson, I think you can file a case with the ombudsman's office... although it may take a few years for the case to be resolved but if he's found guilty he could be dismissed from duty without the retirement benefits...

  14. Ganun-ganun na lang, walang kagatol-gatol, nambugbog ang pulis? Bakit kaya, ano nag trigger? Was the victim loud on the fone? Grabe naman, naka drugs ba ang pulis? Antagal ko bago mag comment kasi nako-confuse lang ako as to how a police officer could react that way without rhyme or reason...meron bang ibang info na di nabanggit sa story?

  23. know the story first before you comment... huwag naman bias... bakit kaya naging abusive c col? baka naman me ginawang di kanaisnais ang subject....parang inihian ata ng subject ang car ni col. nung nakita ni col. pinagsabihan pero siguro naumpisahan ng umihi eh itinuloy na lang, yun siguro nagtrigger sa col.. bakit dog ba sya para sa car umihi? kung walang CR pwede naman cgurong sa pader, diba?

  25. As far as I know, merong LAW na nagbabawal umihi kahit saan. . Hindi nagsecellphone ang Bert James millendez na yan, umihi yan sa sasakyan ng col.. Sabi sa story ng sender young professional yan, eh ganyan na ba ang mga young professionals ngayon? Both parties here I think may mali, but come to think of it, what provoke the police officer to be abusive??????!!!!!!

  26. may violation naman palang ginawa ung BERT JAMES MILLENDES kaya tinawag attention nya... ikaw pa naman umuhi in public place at sa kotse ng isang colonel di ka ba maiinsulto? and besides, violation un pag ihi kahit saan. nasa bar man kaya yang si BERT JAMES MILLENDEZ na yan, WALA BANG C.R. HELLO????!!!!! or haven't he heard of a comfort room???? if i were the police, i would definitely file a case against this F****** BERT JAMES MILLENDEZ & THE ONE WHO POSTED/BROADCASTED THIS... the case i'm going to file is the violation and MORAL DAMAGES!     the sender/the user drbeautifulheart has removed the video he uploaded in one of the websites because he was being UNTRUTHFUL in his letter. he stated that his cousin, BERT JAMES MILLENDEZ was only conversing on the cellphone when the colonel ALLEGEDLY assulted & kicked him...the truth is, this BERT JAMES MILLENDEZ made a violation by URINATING IN PUBLIC PLACE. they DIDN'T include/stated this violation in their letter. I WONDER WHY???? WHAT IS THEIR PURPOSE IN NOT TELLING THE TRUTH???? WHAT IS THEIR HIDDEN AGENDA???? I DON'T THINK THE COLONEL WOULD JUST ASSAULT & KICKED SOMEONE WITHOUT REASONS. i do not know either of them (the sender/BERT JAMES MILLENDEZ & the colonel), I just want an UNBIASED opinion here. do not judge a person just because you've read or heard of something about him from someone you knew. BE CRITICAL...RE-EXAMINED IF IT IS A FACT OR A FICTION... IF THE STORY HASN'T BEEN FABRICATED...SOMETHING IS REALLY MISSING IN THEIR STORY..

  28. i am from davao city. i have heard a lot of the colonel but being abusive is not one of them. in fact he is a very well-mannered police officer. a true gentleman. not only that, he is one of the best police officers in davao city and the philippines as well.

  29. i have seen the video the one that drbeautifulheart has uploaded and removed... i have also read the comments. one of the comments is this, this drbeautifulheart had run for congress last election and didn't make it. and there were some questions on the campaign funds he used (SOMETHING FROM A FOUNDATION). the critic/the one who made the comment of this is obviously really pissed of with drbeautifulheart. he said that "is the money of the foundation really for the beneficiaries ..or for the benefit of the doubt"...
    is he really credible for someone to believe in his letter in which they had a deceitful intent??? oh well, think about it! why would he removed the video...somthing is really wrong with their letter..

You mentioned that the parents were there when the incident happened, i assume that the police officer and the parent of this BERT JAMES MILLENDEZ talked already and settled things out, ANO ANG PINUPUTOK NG BUtCHI nitong Sender at naggulo pa??? To Fashion Pulis, thank you for not being bias, napost pa rin ang comments namin, and na- clear ang lahat!!!   31. they are claiming that they belong to a group of professionals, graduates of UP MIN and ADDU? huh ngayon lang ako nakarinig na professionals naturingan and sa kotse pa ng may kotse iihi. excuse me sabi ninyo u love Davao, eh bakit kayo nagkakalat ng dumi ninyo. and besides what's the problem kung nagpamasahe ang isang tao as long as nagbabayad...nagreklamo ba ang massage parlor na di nagbayad si Col.   32. the subject umihi sa car ni col. tinawag ang pansin biglang talikod itong si Bert pa dedma. yhan ba na mention sa letter nila. WALA..kasi ang laking kahihiyan na pag nalaman ng members ng association nila na ang isang kasama nila ay di pala marunong umihi sa Rest Room....only i heard that a frat member is involve into this kind of case dahil lang di marumong gumamit ng rest room. NAKAKAHIYA ka Bro. then ang bias pa ninyo. why are u so atat na atat in spreading this in cyberspace? puede ba ung di kasali tumigil. wala ngang sinabi ang daddy eh kayo pa.don't be biased....kala ko taga davao tayo...eh kayo lang ang sumisira sa magandang image ng davao.

  37. o nga naman...why kept it a secret na umihi in public tong c millendez? what is the intention of the letter sender at nagsinungaling sya? di tama ung gumawa ka ng ibang situation which did not happen in the first place. puro lng paninira ang ginawa ng letter sender at ni millendez. bakit ka nga naman umihi in public place? bakit dun din sa vehicle ng isang colonel? wla ba kyong sasakyan? di naman karespe-respetado ang gnawa mong pag iihi millendes. kahit sa sariling vehicle mo pa ikaw umihi, still mali kung nasa public place ka. umihi ka na lng sana sa pants mo kung ihing-ihi ka na talaga at di na makapasok sa c.r. ng bar na pinuntahan nyo, acceptable pa un kaysa sa ginawa mo.

  40. if i were in milendes shoes, i would really be ashamed of what he did. imagine james millendez' action has been compared to the kids...the kids! and what, he is a professional from a prestigious school like ADDU or UP MIN? and they are even proud to say that they graduated from these reputable schools wherein their actions are unacceptable. may i also ask, are these schools proud of what you've done? i am a product of ADDU but never in my life did i do such an embarassment in my alma mater's name and neither did i drag the name of ADDU especially in an intolerable situation like this. to what you've done bert millendez, i get to think "are all the new/fresh graduates of ADDU & UP MIN, the young professionals as you said, are all like you?" what you did is very degrading on the schools' prestigious name. be professional. grow up!

    and as for the letter sender, you yourself is to be blamed for all these fiascoes. by dragging the names of the schools in your letter, you have tarnished the good name of the schools & you've just proven to the readers (& feel free to include yourself) your being ignoramus. you know, you can't put a good, respectable & a true gentleman (by word & by deed) down this way. i still believe that in PNP, there are many policemen from PO1 to 5-star general whom we can trust & they are doing their job for the country & people's benefit.

  41. i have read and reread the letter, and it took me a long time to understand the situation. i kept asking what really provoked the colonel in doing what the letter sender accused of him. i can sense that something's amiss in this letter, something that the sender would not want to reveal. a high ranking official wouldn't just assault or kicked someone without valid reason especially if he is a graduate of PMA. i for one would be cautious with my actions if i were in the colonel's shoes (di nya sasayangin ang pinaghirapan nyang mga taon sa baguio).

    i can feel that there is a piece missing in the puzzle/letter. as i scrolled down on the comments, i find it hard to believe that there are people who made negative comments, did they really read the letter?

    on the latter part of the comments...THERE IT IS! the missing piece of the puzzle popped up. and i have figured out that mr. bert james millendez has violated an ordinance. the puzzle that has made my mind boggling has put all the pieces together.

    my question now is why did the sender had to concoct a story like what he wrote in his letter? what is his intention and he deliberately haven't included what mr. millendez did? i believe and think that the sender is being evenhanded/biased to all he wrote against colonel dubria. what kind of game is he playing at?

    reply to PHIPOL & ANONYMOUS (june15 @ 3:12pm): not all policemen are the same. do not generalize the scalawags from the good ones. i still believe that there are many policemen who are doing their jobs dutifully, may it be from PO1 to 5-star general. it is unfair for the honest policemen to be tainted with. the PNPs' are still doing their fair share of work to keep us all from harm, they put their life at risk to be of service to our city and country and it for our own benefit.

  48. Yes there are always two sides to a story. I believe the letter was biased because it did not state the motive for the officer's action. If one would read the letter carefully, even without reading the comments, it is clear that the letter sender omitted a part of the story that triggered the incident. As a person who do not know any of the parties involved and read the letter as is, I think I have doubts on the credibility of the letter's content.
