In the interest of justice, if an international tribunal is already investigating or hearing the charges against a person accused of crimes against humanity, the PH Gov may opt to allow that int tribunal to proceed with investigation or hearing and, if necessary. Transfer or surrender the person charged.

      No local court warrant needed.

  7. Palusot nalang kasi yang ayaw sumuko dahil naghihintay pa sa local court ng warrant. Paawa nalang yan e. Dami nyong pinapatay nuon tapos ok lang. Kung order ng pangulo at nasa batas naman dapat magpahuli na tong si Bato. Ang bagal bagal pa nyang supreme court kumilos e ano pang taon nagpapapatay si Duterte mula pa nung mayor sya gang sa nagpresidente. Talagang mabagal o walang hustisya sa Pinas.

  9. The DOJ clarified it is not labeling Senator Bato a fugitive and he will not be arrested for now despite the ICC arrest warrant. It will wait for the SC ruling on the implementation and enforceability of the warrant. In other words, he’s a free man.

  10. As soon as PH recieved the arrest warrant, they have to act on it because it is a valid warrant that the country is obliged to acknowledge. The local curt does not need to issue another warrant. Just think of it like this - kung merong arrest warrant ang isang tao galing sa regional trial court at napunta ito sa isang district court, hindi na kailangan mag issue ng isa pang arrest warrant ng district court dahil meron na. Ang arresting officers ng district court - ang attached na police detachment nila ay gagamitin ang arrest warrant ng regional court. Yung lang yun, hierarchy. Ang ICC International court arrest warrant works like that - napadala na nila sa Pilipinas ang arrest warrant - di na kailangan ng Phil. supreme court or any other courts to release another arrest warrant for the same case. The NBI are empowered and expected to arrest Bato because of the ICC warrant dahil sa naganap ang alleged crimes against humanity noong time na parte pa ng Pilipinas ng ICC. Any aiding and abetting on the part of anyone, offical man o hindi, citizen man ng Pilipinas o hindi - are going against the force of the warrant. Therefore si Robin and even the senators and officials who helped him were aiding and abetting and International fugitive.

    If he flees abroad, as long as he goes to a country that is signed up to the ICC, that country's law enforcement are tasked by virtue of the warrant to arrest him.

    1. Sa ICC nag-file ng kaso kasi mataas na opisyal — presidente ang gumawa ng krimen. Kung sa Pinas ang trual walang mangyayari kasi pwedeng gamitin ng presidente ang
      clout nya or connection. In fact, nag postpone ng investigation ang ICC nung nagrequest ang Duterte administration noon at sinabi ng administration na sila na ang mag-iinvestigate sa EJK. Kaso nung nag-follow up ang ICC, walang maibigay na report ang duterte administration kaya tinuloy ulit ng ICC yung investigation.

  17. Malamang ito si Bato nag sisisi na nagpa gamit ki APC. Kun nanahimik siya at di nag expose sa senado di sana na magnify ang kaso niya, walang tag na fugitive at di nagka TRO. Ngayon sirang sira siya, sira din an senado at pare parehas sila pinag tatawanan!!!

    8. 5:42 if you cannot honor your agreements as a nation - your debts, your conventions, your legal remedies - paano mo masasabi na isang independent (sovereign, capable, no hegemonic influence) ang iyong bansa? Consider this - can you call a human being independent and capable kung hindi niya kayang ihonor ang legal na kasunduan sa iba? A state, a country has legal obligations. This includes the treaty that came with ICC membership previously. Gets mo ang sadyang nagpapakamangmang lang?

    9. 2:42 the flow of law is like this - the highest court can hear cases from the lowesr if the lowest courts fail them. ICC has been set up for justice beyond national courts to remedy the abuse of power at the national level. EJK victims saw no hope because the Davao family hold power and influence that will not give them the chance for a fair trial - thus, they went to th global court if the ICC. ICC decided their case has merit.
