Trouble in Fantasyland

The successful venture of the three movie outfits squashed all competitors, making the producers ecstatic over the box-office results. Their partnership enlivened the dying movie industry and moviegoers looked forward to another venture of the three. However, the co-production may not happen ever again.

Designer L filed a case on the violation of his intellectual property rights against the producers of the movie. The case stems from the use of the design of L in the costume of the villain in the final scene. In the movie credits, the name of Designer L appeared, which seems to imply that he allowed the use of his design. However, this is not the truth! Designer L never gave his consent for the use of his design in the movie. The question is whether any production person even approached him at all to ask permission.

One of the smaller movie outfits quickly washed its hands of any involvement in the case and immediately pointed to the stellar movie outfit as responsible for the production. Soon, the smaller movie outfit will attempt to clear its name of any involvement in the said case. The stellar movie outfit has yet to issue a statement on this matter.

While everyone thought all is well in the land of enormous profits, this situation merely reflects that all successful ventures will vanish into fantasy with a lawsuit involving millions.

  5. Ah the movie was the top-grosser last MMFF. =) Wooo tapos may sequel na naman daw this year. 10M pa ata ang hinihingi ni Desinger L. Aww. =))

Grabe naman P10Million ang damage na hinihingi kunsabagay tama nga naman bakit di nagpaalam na gagamitin ang design Nya..anyways yakang yakang bayaran yan ng 3 outfits P280M naman ang gross sales ng movie nila!

  17. sa Hollywood uso ang ganitong klaseng demandahan about copyrights chuva...just like yung ginamit na tattoo design sa 'the hangover 2'...sana masampolan yang mga movie outfits na yan para matuto.

    ito yung movie na may kapartner din na isa pang movie before eh, pero that time parehi silang gumagamit ng sword, yung ngayon kasi na kapartner nya maraming anak.

  19. Ay in fairness sikat si designer sa international scene at edgy at magaganda ang designs. Ginamit lang naman ni Lady Gaga design niya sa latest music video niya.

  25. I'm not a lawyer but this is my opinion: This would have been a less of a problem (or successfully sued) if the movie did not acknowledge the Designer L at the end credits. Clothes designed are not subject to copyright laws, I believe. That's why, say, Calvin Klein can design a dress that looks similar to, say, Michael Kors. Copyright or intellectual property laws do not cover clothes. Those laws will cover the tag or brand logo (e.g. the Gucci logo) but not the design of the clothes itself.

    But, since they acknowledged the Designer in the credits, they're almost admitting that they knowingly used the design. I still don't know if that's going to be successful at court but the chances became bigger. Also, if Designer L successfully proves that it is an Art work rather than a dress/costume, then that may also prove some legal culpability on the movie productions' part.

  27. Oh please, it's obvious the designer wailing "foul!!" copied the design of the count's red armor from Bram Stoker's Dracula (1992) He really needs to get over himself.

    3. The MMFF movie admittedly copied (PD admitted it) and even put his name on the credits without asking permission. They should've just hired him diba? Yun yung issue. Sus.

    5. The first time I saw this outfit on a model, my first gut reaction was...it looks so much like the Japanese-designed armour from Bram Stroker's Dracula!!!! Nangopya din ang designer.

  31. homay gad...obsessed naman pala si designer sa ganyang klaseng art muscle design na ganyan. dami nyang creations na puro ganyan. at ang mga creations nya sa pag-design and decorate ng edifices ay kakaiba...weird...at parang alien creatures ang dating....kakalerQUI. google nyo name nya tapos click nyo images. yun na!

  36. I believe that DL had the right to demand compensation but 10 million smacks greed.

  38. i feel really bad for the artist. the producers really should compensate him for the use of his design. and they should also pay for damages. not everything can be justified by profit. there is such a thing as morality. stealing is stealing any which way you look at it.

  39. in my opinion pagdating damit pwede naman na magaya ung design, i am not sure if may patent issue pa dun. if "LR" was acknowledge at the end of the film we'll malamang he has knowledge na gagamitin ang design i doubt naman na ganun kalaking production eh makakalimutan nila ang do's and dont's. siguro the issue was raised because naging top grosser ung film and he wants to have additional bonus.

  40. yung designer L. N. kaylangan nya naman talagang maghabol, bigtime na designer na to, isa sa design nya sinuot ni lady gaga yung muscles ba yun. di ako sure. pero nasuot na ni lady gaga.

  41. This is what i know. Prodcution designer of the movie told L even before the shoot that they will use his design for the costume of the villain and the designer said its okay. The PD told him that in a way, it will help his career since theyre going to credit him. What the PD failed to do is to at least make an agreement but since he didnt expect this will happen, he didnt bother. It's just so ironic why is he complaining just now? Its been 2months! My sources told me that one film outfit of a rival movie (na tinalo pati ng horror movie) was the one pushing L to take it to court. Sore loser i guess.
